The above-referenced assessment appeal was scheduled for court trial
on February 26, 1992. The Bosela/Wood property was assessed
$17,801.00 as part of the Skyline Project and the Court upheld the
entire amount of the assessment. A copy of the Judge's Order is
enclosed.
The Honorable Harvey A. Holtan presided at trial and Mr. Bosela and
Ms. Wood appeared pro se. Ms. Wood had with her a copy of an
appraisal performed for them by Ed McMenomy dated December, 1991. Ms.
Wood stated however, that she had not told Mr. McMenomy he would have
to be present at trial that day. I told the Judge that I objected to
having the appraisal admitted at trial without Mr. McMenomy's
presence as the city would not have the opportunity to cross-examine
Mr. McMenomy. The Judge agreed. I attempted to explain to Ms. Wood
that without evidence from an appraiser, her case would be extremely
difficult as she had the burden of proving the City's assessment was
improper. Judge Holtan informed Ms. Wood likewise. Prior to the Judge
taking the bench, I had offered to settle the case with Ms. Wood for
$15,000.00 but she told the Judge and myself that that offer was
unacceptable.
The Judge then proceeded to conduct the trial. After the Court
received a certified copy of the assessment roll, Ms. Wood took the
stand and gave her reasons for her belief that her property had not
benefitted $17,801.00, the amount of the assessment. On cross exam,
Ms. Wood admitted that Mr. McMenomy's post-project value was
$80,000.00 and that during a conversation with his office just prior
to trial, someone from McMenomy's office told Ms. Wood that the
pre-project value was $62,000.00.
After Ms. Wood concluded, I moved for a directed verdict arguing to
the court that Ms. Wood had not met her burden to disprove the City's
assessment. Judge Holtan agreed and granted the City's motion for
directed verdict upholding the $17,801.00 assessment.
Ms. Wood has the opportunity to appeal the Judge's decision but based
on the very limited trial record, it is extremely unlikely such an
appeal would be successful. Ms. Wood was protesting to Judge Holtan
that she did not realize she needed to have Mr. McMenomy present, but
judge Holtan told her that if a person chooses to represent herself,
that person is responsible for knowing the major rules of evidence at
least generally.

FOR JUDGMENT
The above-captioned matter was set for court Trial and was heard
by the Honorable Harvey A. Holtan on February 26, 1992. The
Appellants appeared pro-se. The Respondent City of Eagan was
represented by its attorney, Annette M. Margarit. Testimony was taken
and at the end of Appellants' evidence, the Respondent moved for a
directed verdict pursuant to Rule 50.01 of the Minnesota Rules of
Civil Procedure.
FINDINGS OF FACT
Based on the testimony offered and evidence admitted at trial the
court makes the following Findings of Fact:
1. That Appellants Ms. Frances E. Wood and Mr. Edward J. Bosela
have an interest in property with a street address of 1426 Skyline
Road, Eagan, Dakota County, Minnesota.

2. That the parcel located at 1426 Skyline Road was assessed by
the City of Eagan in a total sum of $17,801.55 for a public
improvement project.
3. That prior to the improvement project, a gravel road ran in
front of Appellants' property giving them access to Pilot Knob Road.
4. That after the project, the road in front of Appellants'
property was paved and was a through street from Pilot Knob Road on
the east to Highway 13 on the west.
5. That the project included water main and sanitary sewer
lines in the street in front of Appellants' property with stubs
making the utilities available to Appellants' property.
6. That for purposes of its Motion, Respondent relied on a
certified copy of the assessment roll adopted by the Eagan City
Council on July 2, 1991 admitted as evidence at trial, and on
testimony by Ms. Wood that her appraiser, Edward McMenomy, opined
that the post-project value of the property was $80,000.00 and that
the pre-project value was $62,000.00 according to the information Ms.
Wood received from Mr. McMenomy's Office, and Mr. McMenomy's report.
CONCLUSIONS OF LAW
Based on the above Findings of Fact the Court makes the following
Conclusions of Law:
1. The special benefit to Appellants' parcel is at least the
amount of the special assessment levied by Respondent.

the City is hereby granted.
2. That the Court Administrator shall enter Judgment
accordingly.
