The dismissal centered around the failure by the Greers through their attorney to properly file their Notice of Appeal with the District Court within the time frame set forth in the statutes. Following the City Council meeting on July 7, 1992, I requested direction from the City Council in connection with a request by the Greers' attorney, Joe Christenson to seek to settle the Greers' claim against the City somewhere around $.5o on the dollar of the assessment. As you may recall, the Council was not inclined to settle this matter for anything less than the amount of the total assessment particularly in light of the fact, that the Greers next door neighbor had lost her appeal at the trial court. Yesterday I had an opportunity 'to meet with Joe Christenson, whom again, sought to try to reach an accommodation for his clients. His clients still have until the end of July to contest the decision by the Court of Appeals to the Minnesota Supreme Court. Any such action would necessitate an expense of a couple of thousand dollars to the City. Mr. Christenson's present offer to the City in return for waiving the Greers' right of appeal, would be to have the City remove the sanitary lateral from the assessment roll at this time. The sanitary lateral assessment is in an amount equal to $4,129.50. Mr. Christenson's alternative would be that this amount would be payable by the Greers and/or their successors at the time that the Greers' septic system fails to work or prior thereto if they should choose to connect to the City system. This payment would be made in lump sum prior to their connecting to the system. Mr. Christenson explained that the Greers are elderly homeowners whom could not "afford" to bear the total costs of the assessments. He indicated that the Greers' mortgage company paid the first half of the taxes and assessments due against the parcel and have adjusted the monthly payment due from the Greers to account for the large increase required in their tax escrow for the payment of the assessments. This increase has forced the Greers to not be able to make their monthly payments and they risk the loss of the property to the mortgage company as a result. Mr. Christenson indicated that obviously he would provide "assistance" to his clients so that they would not lose their property, but was hoping the City would likewise help the Greers under the circumstances. our analysis of Mr. Christenson's offer is that there is merit toward reducing the City's exposure to attorney's fees in return for obtaining the full amount of the assessment. Mr. Christenson does not seek to reduce the obligation of the Greers, but rather seeks to defer the payment for the sanitary sewer lateral only. Again, these monies would be collected at the time that the Greers were to connect to the sanitary system. I mentioned to Mr. Christenson that we would review this matter with the appropriate officials at the City and hoped to get him a response following the next City Council meeting. City of Eagan Court of Appeals File No. C3-92-130 Our File No. 206-10331 Enclosed please find a copy of the opinion we received from the Court of Appeals affirming the trial court's dismissal of the Greer assessment appeal. As you recall, the Greers served the City a Notice of Appeal from the special assessment on July 26, 1991 but the Notice of Appeal was not filed by Dakota County District Court until August 7, 1991. The Notice was filed 12 days after it had been served on the City contrary to Minn. Stat. §429.081 which requires that the Notice shall be filed with the Court Administrator 10 days after its service on the City. The Greers were assessed approximately $18,000.00 for the Skyline Project. The Court of Appeals' Opinion very much follows the arguments and cases we discussed in our brief and upholds the dismissal of the assessment appeal. The Court of Appeals disagreed with the Greers' argument that Rule 6.05 of the Minnesota Rules of Civil Procedure added three mailing days to the ten-day limit imposed in Section 429.081. As we argued before the Court, Rule 6.05 applies only to service and not to filing of documents and, secondly, applies to situations where a time period is triggered when a party receives service of a Notice. In the present case, the Greers were entirely in control of the date of filing. The Court of Appeals adopted our argument and distinguished the two cases the Greers used in their brief to support their position that filing was not an important part of the process of the assessment appeal. As we explained, and as the Court held, in the Vernco case, the Court looked only at service on the city which still must be done within the time limits of Section 429.081. Also, the Court of Appeals adopted our interpretation of the Andrusick case cited by Greers and held that Dakota County District Court never obtained jurisdiction over the subject matter, namely, the assessment appeal and only had jurisdiction over the City through the proper service. The Greers may petition for review of the Court of Appeals' decision by the Minnesota Supreme Court. The Supreme Court does not have to hear an appeal of a decision by the Court of Appeals and it is entirely within the Supreme Court's discretion to grant further review. The Greers have 30 days from the filing of the Court of Appeals' decision with the Clerk of Appellate Courts which is July 30, 1992. If you have any questions, please do not hesitate to call. O P I N I O N FORSBERG, Judge Appellants Joel and Elaine Greer sought to bring an action in district court appealing a special assessment levied on their property by respondent City of Eagan. The Greers appeal from the district court's grant of summary judgment to the City dismissing their assessment appeal as untimely. We affirm. FACTS The Greers own property in Eagan, Minnesota. In January 1989, the Eagan City Council authorized a public works project under which street, sewer, water laterals, and other improvements were to be constructed in the right of way adjacent to the property. At a final hearing held on July 2, 1991, the city Council levied a special assessment of $16,812.45 against the Greers' property. On July 26, 1991, the Greers served a Notice of Appeal from the special assessment on the City by serving the city clerk. Five days later, on July 31, 1991, the Greers' attorney sent by first class mail a copy of the Notice to the Dakota County District Court for filing. In a letter to the clerk of district court, the attorney stated: "It is imperative that the Notice of Appeal be filed with your office within ten days of the date of service on the city and, therefore, we would appreciate your prompt attention to this request.". However, the Notice was not stamped "received" by the district court until August 6, 1991, eleven days after it had been served on the City. The Notice was stamped "filed" on August 7, 1991, twelve days after it had been served on the City. Following a hearing, the district court determined the Notice was not timely because it was not filed with the district court within 10 days after its service on the city clerk, as required by Minn. Stat. § 429.081 (1990). The district court therefore granted -2- summary judgment to the City, and dismissed the Greers' assessment appeal. ISSUE Did the trial court err in granting summary judgment? ANALYSIS summary judgment is appropriately granted where there are no genuine issues of material fact and one party is entitled to judgment as a matter of law. Minn. R. Civ. P. 56.03. The facts of this case are not in dispute, and the sole issue is whether the trial court properly applied the law. Minn. Stat. 5 429.081 (1990) provides in pertinent part: Within 30 days after the adoption of the assessment, any person aggrieved * * * may appeal to the district court by serving a notice upon the mayor or clerk in the municipality. The notice shall be filed with (Emphasis added.) The Greers argue that their assessment appeal should be considered timely under Minn. R. Civ. P. 6.05. That rule provides in pertinent part: Whenever a party has the right or is required to act within a prescribed period after the service of a notice or other paper upon the party, or whenever such service is required to be made a prescribed period before a specified event, and the notice or paper is served by mail, three days shall be added to the prescribed period. The Greers insist that under this rule, the 10-day time period set out in section 429.081 may be enlarged to 13 days when a notice of appeal is mailed to a district court for filing. -3- However, rule 6.05 discusses service of papers, not filing. In addition, rule 6.05 extends the time period for a party when that time period is calculated from the date that party receives service of a notice or other paper, See 1 David Herr & Roger Haydock, Minnesota Practice § 6.8, at 157 (1985). Rule 6.05 does not apply to situations like this where the time for filing is solely within the control of one party, and is not affected by the actions of the other party. The result reached here is generally consistent with the few cases cited to us by the parties which deal with appeals under section 429.081. In Wessen v. Village of Deenhaven, 284 Minn. 296, 170 N.W.2d 126 (1969), a property assessment was adopted on December 28, 1966. The property owners mailed notices of appeal to the city attorneys on January 6, 1967; on January 12, they delivered notices to the sheriff for service on the mayor; on January 19, the notices of appeal were personally served upon the mayor; and on January 30, the notices were filed with the district court. At that time, section 429.081 required an appeal to be taken within 20 days after adoption of an assessment. The property owners in Wessen argued that their appeal was timely under Minn. R. Civ. P. 3.01, which provided that an action commences when the summons is delivered to the proper officer for service, provided actual service is made within 60 days after such delivery. The property owners also argued that service upon the attorneys was timely under Minn. R. Civ. P. 5.02, which provided -4- that service upon a party's attorney, including service by mail, is sufficient. In dismissing the appeal as untimely, the supreme court noted that application of rule 3.01 "would mean that a notice of appeal need not reach either the mayor or the village clerk until 80 days after the assessment was adopted." Wessen, 284 Minn. at 299, 170 N.W.2d at 128. such a result, the court concluded, was contrary to the statute: [W]e must assume that when the legislature specified service within 20 days, notification, and not simply commencement of the action, was intended. The short time allowed can only be construed as intended to facilitate the orderly operation of municipal government and eliminate unnecessary delays in the prescribed assessment procedure. Id. The court further concluded it need not reach the property owners' claim that service upon the attorneys by mail was timely under rule 5.02, because even if such service was proper and valid, the notices still were not timely filed with the district court within 10 days after that service. Id. In Vernco. Inc. v. Township of Manvaska, 290 N.W.2d 443 (Minn. 1980), the supreme court reversed the district court's dismissal of an appeal from a proposed assessment. In so doing, the court stated: Plaintiffs attempted to serve their notice of appeal from the proposed assessment for the improvement of a road in Martin county by leaving a copy at the home of the township clerk with his mother. The district court dismissed the appeal, concluding that Minn. Stat. 429.081 (1978) requires service of the notice of appeal personally upon the mayor or clerk of the municipality. -5- While we agree that substitute service upon a municipality is an impermissible method of statutory service, the fact is undisputed that the township received actual notice of the appeal within the time provided by Minn. Stat. 429.081 (1978). We therefore conclude that such actual notice within the time limitations provided by statute is sufficient to confer jurisdiction upon the district court. Vernco, 290 N.W.2d at 444 (citations omitted). Wessen and Vernco both suggest that while a notice of appeal need not be personally served upon a municipality as required by section 429.081, the municipality must still have actual notice of the appeal within the time limits of section 429 081. Thus, under the reasoning of either case, the Greers' appeal is untimely. In Andrusick v. City of Aoole Valley, 258 N.W.2d 766 (Minn. 1977), the supreme court affirmed dismissal of an appeal from an assessment on the ground that the district court lacked jurisdiction because the notice of appeal was improperly served upon the city clerk on a holiday. The court reasoned that because an appeal in an assessment proceeding initiates a "civil action," the notice of appeal is a "civil process" which may not be served on a holiday under Minn. Stat. S 645.44, subd. 5. Andrusick, 258 N.W.2d at 767-68. The court also noted that although assessment proceedings are initially legislative and administrative in nature, the judicial system is invoked when the notice of appeal is "properly served and filed." Id. at 767. Thus, under Andrusick, the district court in this case never obtained subject matter jurisdiction because the Greers' appeal was not timely filed with the court. -6- Finally, the Greers argue their Notice should be considered timely because the City has not been prejudiced and dismissal of their appeal is unduly harsh. However, given our conclusions that the statute must be strictly construed and that proper filing with the district court is jurisdictional, we have little discretion to consider such equitable arguments or to waive the statutory time limits. FACTS In January, 1989 the Eagan City Council authorized Public Improvement Project No. 543R and its partial financing through special assessments. A final assessment public hearing for Project 543R was held on July 2, 1991, at which time the Eagan City Council levied special assessments on the benefitted properties. Joel Greer and Elaine Greer are the owners of property located at 1428 Skyline Drive in Eagan, PID No. 10-77250-062-00. The City of Eagan assessed the Greers $16,812.45, for street and utility improvements connected with Project 543R. Petitioners served their Notice of Appeal of Special Assessment to the City Clerk for Eagan on July 26, 1991. See Affidavit of E. J. VanOverbeke. A copy of the Notice of Appeal was received by Dakota County District Court in Hastings, Minnesota on August 6, 1991 and filed August 7, 1991, twelve days after the Notice was served on the City. See Ex. A, certified copy of the Notice of Appeal. ISSUE I. Should Petitioners' Assessment Appeal be dismissed for failure to file their Notice of Appeal with the District Court within ten days after service upon the Mayor or Clerk as required by Minnesota Statutes Section 429.081? DISCUSSION through which a property owner can appeal an assessment. The statute provides, in relevant part; Within 30 days after the adoption of an assessment, any person aggrieved, who is not precluded by failure to object prior to or at the assessment hearing, or whose failure to so object is due to a reasonable cause, may appeal to the District Court by serving a Notice upon the Mayor or Clerk in the municipality. The days after its service. (Emphasis Added) As stated above, Minn. Stat. §429.081 requires a property owner to do three things in order to appeal a special assessment: 1. object to the assessment before or at the final assessment hearing; -2- Minnesota Statute Section 429.081 (1991) describes the procedure 2. serve a notice of appeal on the city within 30 days of the final assessment hearing; and 3. file the notice of appeal with the district court within 10 days of service on the city. Of these three requirements, the statute expressly excuses failure to perform for a reasonable cause only in the requirement to file an objection. Summary judgment is appropriate when there is no genuine issue of a material fact and either party is entitled to judgment as a matter of law. Rule 56.03, Minnesota Rules of Civil Procedure. In this case, it is undisputed that Petitioners did not file their assessment appeal on time. The right to appeal an assessment is wholly statutory, and, therefore, the conditions for appeal imposed by statute must be strictly followed and will be strictly construed. Ewert v. City of Winthrop, 278 N.W.2d 5451 550 (Minn. 1979) [Property owners do not have a right to jury trial in a special assessment appeal]. The 10-day filing requirement should be strictly enforced against Petitioners regardless of why their filing was late. The Minnesota Supreme Court strictly construed the district court filing requirements of §429.081 in the special assessment case Wessen v. Villaae of Deep Haven, 284 Minn. 296, 170 N.W.2d 126 (1969). In Wessen, the property owners mailed their objection to the mayor on January 12, 1967, personally served the mayor on January 19, 1967 and filed the notices of appeal with the district court on January 30, 1967. The Court dismissed the petitioner's assessment -3- appeal for failing to file the notice of appeal with the district court within 10 days after it was served on the city clerk as required by Minn. Stat. §429.81. The notice was filed eleven days after the mayor was served. The Court concluded that the right to an assessment appeal is granted by statute and there must be strict compliance with the statutory conditions for an appeal. The conditions would "not be extended by construction." Id. at 128. The public policy behind judicial strict construction of the deadline imposed by §429.081 is evident. Without strict adherence to the filing deadline, a city would never know when a property owner really intends to appeal. A municipality needs the certainty of strict appeal deadlines so it can keep its finances in order. "[N]either special assessment proceedings nor the integrity of municipal finances in general can remain intact if special assessments are subject to challenge years after they have been levied." Shortridge v. Daubnev, 425 N.W.2d 840, 842 (Minn. 1988). Further, filing the appeal is a jurisdictional requirement. The district court has no jurisdiction over a city council's legislative decision to levy special assessments until the petitioners properly seek judicial review. Merely giving notice to a city of an anticipated appeal is insufficient to begin the judicial process. The Minnesota Federal District Court recognized the importance of filing the assessment appeal with district court in City of Owatonna v Chicago Rock Island and Pacific Railroad Company, 298 F.Supp. 919 (D. Minn. 1969). In that case, the City of Owatonna was -4- contesting the removal of the Railroad's assessment appeal to federal court. The city argued that an assessment appeal was not really a "civil action" pursuant to federal law and, therefore, removal was not appropriate. The Court ruled that the proceeding was a civil action that could be heard by federal court stating: "Assessment proceedings in Minnesota become a civil action when a notice of appeal is filed in the state district court, a court of general jurisdiction. It is an adversary proceeding between parties and a decision is made to enforce or not to enforce a liability against a landowner on past facts gathered by legislative or administrative officers. (citations omitted) It is true that the proceedings for making local improvements and the subsequent assessment proceedings are initially legislative and administrative in nature. Yet it becomes one of judicial inquiry when an aggrieved person appeals to the district court objecting to the assessment pursuant to Minn. Stat. §429.081 (1968 Supp.). Id. at 921-922. CONCLUSION Minnesota Statute Section 429.081 is not ambiguous. It requires a petitioner to file a Notice of Appeal with the district court within 10 days after service of the appeal upon the mayor or clerk of the municipality. The statute does not provide for a "reasonable excuse" for not filing on time. The time requirement may force a petitioner to serve the Notice on the city and mail it to district court the same day. It may require a petitioner to hand-deliver the Notice to the court. The time period chosen by the Legislature in which a property owner may commence an appeal of special assessments should be strictly adhered to. -5- In the present case, Petitioners' assessment appeal should be dismissed in accordance with the Court's holding in Wessen. Petitioners failed to file their Notice of Assessment Appeal with Dakota County District Court within 10 days after service upon the Eagan City Clerk as required by Minnesota Statute Section 429.081.
