Dear Mr. Vimr:
On October 17, you had requested consideration from the City
Council for deferment of the second lot equivalent assessment
obligation against your property under the above-referenced
project.
Based on your earlier concerns expressed to the City staff and
Council, a Special Assessment Committee comprised of the City
Attorney, City Administrator, Public Works Director, Community
Development Director and Finance Director reviewed this request and
recommended to the City Council that consideration be given to
allowing a deferment up to five years with interest for those
existing homesteaded properties where public improvements are being
installed and the size of the parcel indicates its potential for
future subdivision creating additional buildable lots. On October
17, the Council accepted the staff's recommendation for allowing
this deferment through the execution of a formal agreement which
would be recorded at Dakota County against this property for full
disclosure of all potential future buyers of this property.
Enclosed you will find a copy of this agreement for your
consideration and execution.
Once this agreement has been executed and returned to the City, it
will be counterexecuted and forwarded to the County for recording.
Upon receipt of this agreement from you, the City would be happy
to issue a written statement indicating the acceptance of this
agreement and the present pending assessment roll will be adjusted
to ensure that all future special assessment searches will reflect
only a pending assessment of $12,000 against your property for this
project.

On June 25, I received your written objection to the proposed
assessments against the above-referenced parcel scheduled to be
considered by the city Council at the formal public hearing on July
2, 1991.
You were noticed that the proposed assessment for this parcel would
be $31,620.54. After discussing your concerns and reasons for
objection, additional research was performed to determine that on
November 9, 1989, the City Council determined the maximum
assessment obligation for this parcel would be $24,000 based on an
appraisal performed for this parcel. Subsequently, a Waiver of
Hearing of Special Assessment was executed by both of you on
November 9, 1990, agreeing to the assessments in the amount of
$23,819.96.
This letter then is to inform you that your assessment that is
being presented to the City Council on July 2 has been revised from
the original amount of $31,620.54 to the previously agreed upon
amount of $23,819.96. This letter will serve as confirmation of
the modification of the assessment roll being presented to the
Council.
If you have any other questions or concerns regarding this project,

Special assessment deferral agreement between the undersigned property
owners and the City of Eagan in connection with City Project No. 543R.
Skyline Road/Sibley Hills Drive (Streets & Utilities) Dakota County,

WHEREAS, Donald & Rose Vimr, husband and wife, presently constitute
all of the fee owners of certain real property situated in the City of
Eagan, Dakota County, Minnesota, generally described as Lot 11. Treffle
Acres; and
WHEREAS, The City of Eagan proposes to assess the owners pursuant to
Minnesota Statute Section 429; and
WHEREAS, it has been determined by the City that the special
assessments will be allocated on a per lot basis and;

ability to further subdivide their property to create two buildable
sites; and
WHEREAS, these subdividable lots would be allocated a special
assessment based on two lot equivalents.
NOW, THEREFORE, the City of Eagan and the undersigned property owners
do hereby resolve and agree as follows:
1. The undersigned hereby authorize the City of Eagan to levy a
special assessment against their property estimated in the amount of
$24,000 at the time of the Final Assessment Hearing for the two (2) lot
equivalents.
2. The City agrees to defer payment on that part of the principal
assessment allocated to the future buildable lot presently calculated at
$12,000. This deferment would be for a maximum period of five years from
the date of the adoption of the final assessment roll for the above-
referenced project by City Council action. Interest would continue to
accrue and be due and payable at the rate of 9% per annum. At the end
of the five year period and upon receipt of a written request from Mr.
Vimr, the matter will be open to review by the Council.
3. At the end of the five year deferment period or upon formal
Council action approving a lot split or subdivision of this property
(whichever occurs first), the deferred principal and interest amount
would become due and payable within 30 days or spread over a subsequent
fifteen (15) year period as a special assessment against this property
or newly created lot, depending upon which occurrence precipitated its
payment.
4. That the undersigned hereby acknowledge that the public
improvements will benefit the above property and hereby specifically
waive any and all rights to contest the amount of the special assessment
and the deferred special assessment pursuant to
Minnesota Statute Section 429.

Utilities) Dakota County, Minnesota.
WHEREAS, Donald & Rose Vimr, husband and wife, presently
constitute all of the fee owners of certain real property situated
in the City of Eagan, Dakota County, Minnesota, generally described
as Lot 11, Treffle Acres; and
WHEREAS, The City of Eagan proposes to assess the owners
pursuant to Minnesota Statute Section 429; and
WHEREAS, it has been determined by the City that the special
assessments will be allocated on a per lot basis and;
WHEREAS, it was further determined that Lot 11, Treffle Acres,

described as commencing at the southwest corner of Lot 12,
said TREFFLE ACRES; thence easterly along the south line
thereof 285.05 feet; thence easterly 102.33 feet along a
tangential curve, concave to the north, having a radius of
270.00 feet and a central angle of 21 degrees 42 minutes 51
seconds to a point in the west line of said Lot 11 and the
point of beginning of the line to be described; thence
continuing northeasterly 56.63 fact along said curve having
a radius of 270.00 feet and a central angle of 12 degrees 01
minutes 00 seconds to a point on the southeasterly line of
said Lot it and said line there terminating.
Together with a permanent easement for storm sewer and
drainage purposes over, under and across that' part of said

that part of said Lot 11 which lies from 12.50 feet to 25.00
feet each side of the above described centerline.
The side line: of said easement shdll be lengthened or
shortened to terminate on the boundarins of ;=did Lot 11.

The grant of the foregoing permanent easement for right-of-way
and utility purposes includes the right of the City, its contractors,
agents and servants to construct, reconstruct, inspect, repair and
maintain a public roadway, utilities and appurtenances over, under,
across and through the premises, to erect and maintain signs in
conjunction with the public's use of said roadway, utilities and
appurtenances and any signs erected in conjunction with the use of
the roadway and appurtenances.
The grant of the foregoing permanent utility easement for storm
sewer and drainage purposes includes the right of the City, its
contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct, ine:peet, repair and
maintain pipes, conduits and mains; and the further right to remove
trees, brush, undergrowth and other obstructions. After completion of
such construction, maintenance, repair or removal, the City shall
restore the premises to the condition in which it was found prior to
the commencement of such actions, save only for the necessary removal
of trees, brush, undergrowth and other obstructions.
And the Landowner, for itself and its successors and assigns,
does covenant with the City, its successors and assigns, that it is
well seized in fee of the lands and premises aforesaid and has good
right to grant, convey the easements herein to the. City.

Per our prior discussions, Martin DesLauriers has dropped off at
our office the plot plan and topographical survey (a copy for your
is enclosed) from 1958 when Vimrs built their house. Don Vimr
reports that the white area with the dimensions is his drawing. He
scaled the dimensions from the plan and field measured with his
100 foot tape the measurements as shown. This is the information
that he has provided in response to our request for a survey.
Mr. Vimr also reports that he will be out of town from August
24th through September 5th in the event that you need to enter
his house for any reason.

performed by Mr. Ray Connelly, analyzing the proposed assessment
for the Skyline Road public improvement was completed. Jim
Sheldon, our City Attorney, is presently reviewing the appraisal

Liberty' Self-Adhering SBS Membrane Roofing Base Sheet Installation Guidelines
READ ALL INSTRUCTIONS COMPLETELY PRIOR TO INSTALLATION.
The Systems:
1. Premium two-ply system (eligible for 10 year material limited warranty and GAF Material Corporation 12-Year Golden Pledge' or 1D-Year System Plus limit-
ed warranties) is constructed with two plies of self-adhering membranes applied only to primed plywood decks. This system consists of one Liberty- Base
ply (Liberty" Base Sheet) and a top ply of a granule surfaced cap sheet (Liberty- Cap Sheet).
2. Single Ply System (eligible for 5 year material limited warranty) is constructed with a single ply of a granule surfaced cap sheet (Liberty Cap Sheet) applied
directly to a primed plywood deck. (NOTE: See Liberty- Cap Sheet Installation Instructions for complete system information.)
GENERAL GUIDELINES, SURFACE PREPARATION & PRECAUTIONS:
The Liberty' self-adhering SBS roof membrane system must be installed
on roofs having positive drainage with slopes between 1h" per foot and 6"
per foot. Areas of ponding water are unacceptable.
Apply Liberty" membranes only when the weather is dry and material
temperatures (air, roof deck, membrane) are between 457 and 95"F.
Ap ly Liberty' Base self-adhering membrane directly to a minimum
15132.primed plywood deck.
• Membranes must be installed only to structurally sound decks.
• The plywood deck surface must be dry and clean, free of dust, dirt and
debns.
INSTALLATION - Liberty" Base:
1. Startingq at the low point on the roof, strike a chalk line 27" up from and
parallefto the eave9gutter edge of the primed deck.
2. For the first course of LiberW Base, where no gutter is to be installed,
use a 27"wide sheet. Cut 1 14' from the sheet width.
3. Where a gutter is to be installed, use a sheet width of 27" lus the
height of Cuter The Liberty- Base is to be installed to the fascia
board behindthe gutter.
4. Align a manageable lenTrh (a length that allows a wrinkle and bubble
free installation) of this 7rst course of Liberty" Base sheet with the chalk
line. Confirm that the sheet is flush with the roof edge or runs down the
fascia the height of the gutter to be installed.
5. Fold back the upper edge (not the eaves edge) of the Liberty' Base
membrane to expose the underside of the membrane and remove onl9
the upper portion, approximate) 7'h' wide remaining, of the split-back
release film on the underside oPtthe membrane.
6. Gradual)Y set the membrane back into place, makinU sure that the
upper edge remains aligned with the chalk line. Apply even w'essure
afc nq the entire length of the membrane (from center to outer edge) to
avoid air bubbles or wrinkles.
7. Fold up onto the roof the hover portion of the Liberty Base membrane,
remove the remaining release film and then lay the Liberty' Base back
onto the roof. Apply even pressure along the enure length of the mem-
brane from center to outer ell e) to avoid wrinkles or air bubbles.

READ ALL INSTRUCTIONS COMPLETELY PRIOR TO INSTALLATION.
The Systems:
1. Premium two-ply system (eligible for 10-year material limited warranty and GAF Material Corporation 12-Year Golden Pledge or 10-Year System Plus
limited warranties) is constructed with two plies of self-adhering membranes applied only to primed plywood decks. This system consists of one Liberty"
Base ply (Liberty" Base Sheet) and a top ply of a granule surfaced cap sheet (Liberty' Cap Sheet). (NOTE: See Liberty" Base Sheet Installation Instructions.)
2. Single Ply System (eligible for 5 year material limited warranty) is constructed with a single ply of a granule surfaced cap sheet (Liberty Cap Sheet) applied
directly to a primed plywood deck.
GENERAL GUIDELINES, SURFACE PREPARATION & PRECAUTIONS:
1. The Liberty" self-adhering SBS roof membrane system must be installed
on roofs having positive drainage with slopes between lb" per foot and 6"
per foot. Areas of ponding water are unacceptable.
2. Apply Liberty' membranes only when the weather is drryy and material
temperatures (air, roof deck, membrane) are between 4 *F and 95°F.
3. Apply Liberty- Ca self-adhering membrane directly to a Liberty' Base or
a minimum 15132 primed plywood deck.
• Membranes must be installed only to structurally sound decks.
• The plywood deck surface must be dry and clean, free of dust, dirt and
debris.
INSTALLATION - Liberty" Cap:
NOTE: The Liberty' Cap is manufactured with a release film on the merrier

4. Gradually set the membrane back into place, making sure that the
lower edge remains aligned with the drip edge. DO NOT REMOVE THE
SELVAGE FILM. Apply even pressure along the entire length of the
embrane (from center to outer edge) to avoid air bubbles or wrinkles.
