Based on your earlier concerns expressed to the City staff and Council, a Special Assessment Committee comprised of the City Attorney, City Administrator, Public Works Director, Community Development Director and Finance Director reviewed this request and recommended to the City Council that consideration be given to allowing a deferment up to five years with interest for those existing homesteaded properties where public improvements are being installed and the size of the parcel indicates its potential for future subdivision creating additional buildable lots. You were noticed that the proposed assessment for this parcel would be $31,620.54. After discussing your concerns and reasons for objection, additional research was performed to determine that on November 9, 1989, the City Council determined the maximum assessment obligation for this parcel would be $24,000 based on an appraisal performed for this parcel. Subsequently, a Waiver of Hearing of Special Assessment was executed by both of you on November 9, 1990, agreeing to the assessments in the amount of $23,819.96. Skyline Road/Sibley Hills Drive (Streets & Utilities) Dakota County, Minnesota. WHEREAS, Donald & Rose Vimr, husband and wife, presently constitute all of the fee owners of certain real property situated in the City of Eagan, Dakota County, Minnesota, generally described as Lot 11. Treffle Acres; and WHEREAS, The City of Eagan proposes to assess the owners pursuant to Minnesota Statute Section 429; and WHEREAS, it has been determined by the City that the special assessments will be allocated on a per lot basis and; WHEREAS, it was further determined that Lot 11. Treffle Acres, has the ability to further subdivide their property to create two buildable sites; and WHEREAS, these subdividable lots would be allocated a special assessment based on two lot equivalents. NOW, THEREFORE, the City of Eagan and the undersigned property owners do hereby resolve and agree as follows: 1. The undersigned hereby authorize the City of Eagan to levy a special assessment against their property estimated in the amount of $24,000 at the time of the Final Assessment Hearing for the two (2) lot equivalents. 2. The City agrees to defer payment on that part of the principal assessment allocated to the future buildable lot presently calculated at $12,000. This deferment would be for a maximum period of five years from the date of the adoption of the final assessment roll for the above- referenced project by City Council action. Interest would continue to accrue and be due and payable at the rate of 9% per annum. At the end of the five year period and upon receipt of a written request from Mr. Vimr, the matter will be open to review by the Council. 3.
