Margarit DATE: March 11, 1992 RE: Heller v. City of Eagan Assessment Appeal INTRODUCTION Phillip and Valerie Heller own a parcel of land in the City of Eagan with a property identification number of 10-77250-120-00. This parcel is marked on the attached map. On July 2, 1991, the City assessed the Heller parcel as part of Project 543R in the total sum of $49,277.80, broken down as follows: Sanitary Lateral .................$10,599.05 Water Lateral .................... $ 6,183.10 Services..... .................$ 2,211.00 (two full services and one water) Storm Sewer Trunk ................ $ 6,461.90 Street Area ...................... $ 8,853.95 Street Front Foot ................$14,968.80 The City has purchased an easement across the Heller property for storm water pipe which discharges water onto the DeLosh parcel. RECOMMENDATION I recommend to the Council that this matter be resolved by reducing the assessment on the Heller parcel to $40,000.00. The recommendation is based on discussions with Ray Connelly, the City's appraiser, and our experience with the DeLosh trial as described below: 1. If this matter were to go to court, it is possible the court could find that prior to the Project, the Heller parcel, although currently only one lot, could be split into two lots, with a northern lot taking direct access from Skyline Road via a long driveway along the western border of the parcel. Each of the two lots would be greater than an acre so that the Hellers would not need to plat the parcel. I This analysis is consistent with Judge Lynch's decision in the DeLosh case. In that case, Judge Lynch split the DeLosh parcel into two lots of several acres each and assigned a value of $45,000.00 per lot. Each of the DeLosh lots would be substantially larger than the two lots available on the Heller parcel, so it is our opinion that the lots on the Heller parcel prior to the Project would have an estimated fair market value of $40,000.00 each. The total gross value of the parcel would be $80,000.00. In Delosh, Judge Lynch reduced the gross pre-project value by sales commissions and development costs. Applying his theory to the Heller parcel, the value of the parcel prior to the Project can be determined as follows: $80,000.00 (2 x 40,000) - 8,000.00 (10% sales commissions) - 6,000.00 (3,000 per lot as Judge Lynch used) $66,000.00 2. After the Project, the Hellers presumably could split their parcel into four lots as indicated on their preliminary plat proposal. One of the lots would take access and all utilities from newly constructed Skyline Drive which was not part of the public project. The other three lots would take direct access from Skyline Road. Two of the lots take full' utilities from Skyline Road, and the lot upon which the Hellers' residence lies takes only water from Skyline Road, as part of the Project. Presuming the four lots could be sold for approximately $35,000.00, the average of the comparable sales that Ray Connelly used in his appraisal of the DeLosh property which was found by Judge Lynch to be the most credible, the Hellers would gross $140,000.00 from the sale of the four lots. The cost of developing the two additional lots would be approximately $30,000.00. This number comes from Ray Connelly's testimony in the DeLosh hearing that the cost of an improved lot in Eagan is approximately $15,000.00 per lot. Additionally, sales commissions of $3,500.00 for each of the two additional lots would have to be included in the cost of development. The cost of development can be determined as follows: $140,000.00 - 30,000.00 (development costs) - 7.000.00 (sales commission) $103,000.00 - 66.000.00 (value of property prior to project) $ 37,000.00 Benefit i 3. We have had discussions with appraiser Ray Connelly and he concurs with our estimate of benefit to the Heller parcel. Mr. Connelly is of the opinion that each of the two additional lots on the Heller parcel receives a maximum benefit of $15,000.00. Additional benefit should be attributed to the homestead lot for the paved road access and water main. CONCLUSION Based on the above-stated rationale and Mr. Connelly's opinion, I recommend to the Council that the Heller parcel be reassessed from its levied assessment of $49,277.80 to $40,000.00 to be proportionately divided up among all of the assessed items. That more specifically the grounds for Appellants' appeal in this matter are as follows: 4.1 Appellants' property is not benefitted to the extent of said assessment. 4.2 The criteria and method used to determine the assessment upon Appellants' property is not a proper one for the imposition of a special assessment, is not in accord with Constitutional, Statutory or municipal assessment policy requirements and is, therefore, arbitrary and capricious and, this, deprives Appellants of their property without due process of law, contrary to the requirements of the United States Constitution and the Minnesota Constitution. 4.3 The total costs of improvements in Project No. 1OP543 were not proportionately distributed among all property owners benefitted by the said improvements. 4.4 The improvements in Project No. 1OP543 are excessive in scope and are designed to favor other land owners who are not being similarly assessed. 5. Appellants did, prior to the assessment hearing on July 2, 1991, object in writing to the above assessment. WHEREFORE, Appellants ask this Court to set aside the above described assessment against Appellants' property, to order -2- reassessment in accordance with Minn. The property owner's appraiser valued total taking and damages at $23,400 with the majority based on severance due to the location of the easement crossing the subject parcel. The City's appraiser valued the damages at $5,700. In discussions with the Commissioners, they concurred with the City's determination of the value of the property taken for both permanent and temporary construction easements, but also added an additional $10,000 as severance damages to the rest of the property. Attached to this memo is a sketch of the easement on the property. Originally, the easement was proposed to be a straight line across their property. However, based on the Heller's request, the City modified the construction alignment to the final easement description to minimize the impact on the property. Therefore, because the alignment and easement description was changed at the property owner's request to eliminate the claim of damages to the property, it is hard to understand why the Commissioners still felt it necessary to award them an additional $10,000. Also, there are many instances of property throughout the City where easements cross the backyard areas. We do not know of any other similar lot in the City of Eagan that sells for $10,000 less merely because of an easement crossing the rearyard area. Therefore, after discussions with the City Attorney's Office, I feel that it would be appropriate for the city to appeal the Commissioner's award to District Court. This appeal must be initiated by the end of October. If, however, the City Council feels that it is not appropriate to pursue this appeal, it can be dropped and the Commissioner's award paid as a final settlement of this matter. Unless informed to the contrary, the City will proceed with trying to minimize the amount of easement acquisition costs associated with this project. My wife and I have attempted to fully cooperate with the City in this matter and have found all our efforts thwarted. We feel that we are left with no alternative but to contact you directly prior to seeking the assistance of legal counsel. On Friday evening, August 9, 1989, Mr. Joe Earley appeared at our home and hand delivered a package containing easements for us to sign regarding the placement of a storm sewer on our property as part of Project 543R. I had a brief conversation regarding why the easements were being sought at that time since we had been told by the City Engineer that that part of the project would not go forward until Spring 1990. Mr. Earley informed me that the process needed to be started because Condemnation Proceedings had to be started in December if no agreements could be reached so that the City could proceed as soon as possible in the spring. I inquired why the location of the storm sewer had been changed from the consultant's report and what amount the City was offering to pay us for the easement. He said he did not have answers to my questions and that he would get back to me. A few weeks later I started my bi-weekly telephone calls to Mr. Earley seeking answers to the concerns that my wife and I had, and still have, about the situation: Why the location of the storm sewer?; What does the City intend to do to replace all the trees it will destroy in locating the sewer?; What about the trees affected by the temporary easement sought?; What compensation for any trees not replaced?; Where was the road going to be placed along our property?; and What did the City intend to offer to pay for the storm sewer easement? Mr. Earley indicated that he would have the City stake the road and the storm sewer. Finally, in October or November the storm sewer was staked, but the road has not been done to this date. Out of desperation, to start a dialogue about the easement price, I informed Mr. Earley in November or December that the staked storm sewer cut across and rendered non-buildable the two lots that the City's consultants felt could be subdivided on our property, and that based on the average price of the property being developed across the street from us that we felt a fair price for the easement was $100,000. He informed me that the City would have to get an appraiser out to appraise the property. The next I heard about the easements was from my neighbor, Don Vimr, who called me in mid-January to ask if I had been contacted by Joe Earley regarding an offer for the easement on my property. Don explained that he had received a verbal offer based on valuing his land at an undeveloped agricultural rate of $20,000.00 per acre. I certainly don't understand how the City can justify assessing us for roads and sewer at a rate of fully developed property and seek to compensate us at a lower rate. Does that seem fair to you? I waited for my telephone call which, along with all the others, never came. Instead, on February 14, 1990, we received a certified letter signed by Joe Earley accompanied by a Notice of Intent to Take Possession. In the letter, Mr. Earley stated: "Although legal action is now still interested in obtaining purchase. Our office will be order to negotiate further. at the above address. One promise after another has been broken, and the only thing we know for sure at this time is that sometime this spring the City intends to drastically alter the peaceful natural environment of our home, destroying its value and charging us over $40,000 to do so.
