CITY OF EAGAN
WHEREAS, a regular meeting of the City Council of the City of
Eagan, Dakota County, Minnesota, was held on the 4th day of April,
1995, at 7:00 p.m. at the City Hall located at 3830 Pilot Knob
Road, Eagan, Minnesota; all members being present; and
WHEREAS, pursuant to M.S.A. §412.851, the Mayor convened the
public hearing to consider the proposed vacation of a drainage and
utility easement lying over and across the following described
property:
The southerly 5.00 feet of Lot 1, Block 2, Prettyman
Heights, Dakota County, Minnesota, according to the
recorded plat thereof.
The northerly 5.00 feet of Lot 2, Block 2, Prettyman
Heights, Dakota County, Minnesota, according to the
recorded plat thereof.
WHEREAS, the Council at a regular meeting on the 7th day of
March, 1995, accepted a petition to vacate said drainage and
utility easement pursuant to a petition and scheduled a public
hearing on the vacation for the 4th day of April, 1995, at 7:00
p.m. at the City Hall; and
WHEREAS, Affidavits of Publication of Notice of Hearing in the
Dakota County Tribune, dated March 23, 1995 and March 30, 1995,
relative to the proposed vacation were submitted; and
WHEREAS, said Notices of Hearing were posted at the City Hall;
and

WHEREAS, there appearing no objections to said vacation and
the Council desiring to vacate said drainage and utility easement;
and
WHEREAS, it having been determined that other than petitioner,
there are no other parties, including public utility companies,

easement, and there being no objections;
NOW THEREFORE, upon motion by Councilmember Hunter, seconded
by Councilmember Awada, all members voting yes, it was RESOLVED
that the drainage and utility easements lying over and across the
following described property is hereby vacated:

Heights, Dakota County, Minnesota, according to the

, 1984, by and between the CITY OF EAGAN, a
Munici ali of the State of Minnesota, (hereinafter called the CITY,
and the Owner and the Developer identified herein.
The terms "Developer" and "Owner" as used herein refer to
SKYLINE HEIGHTS PARTNERSHIP whose address is 1480 Skyline Drive,
Eagan, Minnesota 55121.
WHEREAS, the Developer has applied to the City for approval of
the plat or subdivision known as PRETTYMAN HEIGHTS, located within
the City; and
WHEREAS, the Owner and Developer agree to notify potential
buyers of all lots within PRETTYMAN HEIGHTS that all lots (Lots 1
through 18, Block 1, Lots 1 through 4, Block 2 and Lots 1 through 41
Block 3) are in a high water pressure zone and a pressure reducing
valve shall be installed in each home below the elevation of 875
feet. All costs shall be the responsibility of the Owner and
Developer and shall be installed to prevent damage due to high water
pressure.
NOW, THEREFORE, the City, Owner and Developer agree as follows:
1. Recording. This agreement shall be recorded with the Dakota
County Recorder so as to provide notice to the owners of all lots
within PRETTYMAN HEIGHTS (Lots 1 through 18, Block 1, Lots 1 through
4, Block 2, and Lots 1 through 4, Block 3). The owner shall provide
and execute any and all documents necessary to implement the
recording of this agreement.
2. Notice. The recording of this document shall constitute
notice to all owners and future owners of property in PRETTYMAN
HEIGHTS that all lots (Lots 1 through 18, Block 1, Lots 1 through 41
Block 2, and Lots 1 through 4, Block 3) are in a high water pressure
zone and that a pressure reducing valve shall be installed in each
home below the elevation of 875 feet. All costs shall be the
responsibility of the Owner and Developer and shall be installed to
prevent damage due to high water pressure.
3. Validity. If any portion, section, subsection, sentence,
clause, paragraph or phrase of this agreement is for any reason held
to be invalid, such decision shall not affect the validity of the
remaining portion of this ..ontract.
4. Binding Agreement. The parties mutually recognize and agree
that all terms and conditions of this recordable agreement shall run
with the land herein described and shall be binding upon the heirs,
successors, administrators and assigns of the owners and developers
referenced in this Contract.

RESOLUTION
WHEREAS, the Eagan City Council adopted a Resolution, dated January
4, 1977, and filed February 8, 1977, as Document No. 483435 with the Dakota
County Recorder; and
WHEREAS, said resolution provided that the application for waiver
of plat covering property described as the east 200 feet of the south half (S1/2)
of the north half (N1/2) of Government Lot 9 in Section 4, Township 27, Range
23, be approved, provided, however, that no further building permits will be
granted by the City of Eagan on said parcel or on Lot 14, Treffle Acres, it being
understood that said two parcels will be combined under one ownership; and
WHEREAS, the Eagan City Council has now approved the plat for
Prettyman Heights, which subdivision includes all of the property described
above; and
WHEREAS, in order to terminate the Resolution, it is necessary that
the City Council adopt a Resolution rescinding said action;
NOW, THEREFORE, upon motion by Egan , seconded by_

for April 4, 1995.

It was recommended to approve the filth and final payment for Contract 94-06 In the amount of $21,704.78
to McNamara Contracting and authorize the acceptance for perpetual City maintenance subject to all
warranty provisions.

accept the resignation of Anil Deodhar and eliminate one alternate position on the Airport Relations
Commission.

Hunter moved, Awada seconded a motion to approve the consent agenda. Aye: 5 Nay: 0
WADING POOL
Mayor Egan introduced this item as approval of the wading pool proposal. After a brief introduction
by Administrator Hedges, Parks and Recreation Director Was explained the proposal as well as the options
of a heater, chemical system, and enclosure of the filtration system. He noted that the Advisory Parks,
Recreation & Natural Resources Commission had some concerns relative to the timing and location of this
wading pod. It was felt that it should be included as part of an aquatics system, rather than a stand alone
facility.
Considerable discussion followed concerning whether this is the proper location for a wading pod.
Counclimember Hunter stressed that this wading pod was part of the decision regarding the Civic Arena
to broaden its appeal to the community. He feels the decision to build this pod at this location was made
two years ago and should go forward. People made contributions to this facility that was marketed as a
multi-use facility. The location of this pod was the subject of a Council workshop, and this location was
agreed upon. To deviate from that decision takes away the integrity of the project
Councitmember Wachter stated he feels it should be part of an aquatics facility. Councilmember
Awada stated she feels it should be In the central area Mayor Egan feels there are better locations;
however, agreed that this pod was used to raise support for the civic arena.
Discussion followed concerning getting an analysis of where a second sheet of Ice could be located,
but Parks and Recreation Director Vraa reminded the Council that the bids will expire by then. After some
discussion regarding the options, Hunter moved, Egan seconded a motion to approve the wading pod
proposal, including the heater option. Aye: 4 Nay: 1 (Wachter opposed.)
