Dear Mr. Garr:
This letter is a follow-up response to your telephone request of June 23, 2006. You
requested an update regarding your concerns about the elevation of Pond BP-35 as a result
of the October 4, 2005 storm. The focus of your concern is the elevation of the pond
resulting from this storm.
As we have previously discussed, the pond reached a higher elevation than was anticipated
after the construction of the July 2000 Storm Mitigation improvements. City staff
inspected the outlet and downstream drainage system for any possible restrictions the day
following the storm event. No evidence of any type of restrictions or obstructions was
found. Staff and our consultant also researched the design of the existing storm drainage
system. The consultant ran a computer model simulation of the storm event and analyzed
the impact of such a storm on the drainage system. After running numerous options, only
one possible scenario seems plausible.
The normal outlet for the pond had to become restricted early in the storm event. Because
of this restriction, the pond elevation rose quickly until it reached the top of the safety
outlet structure. While the grated overflow top of this outlet structure then maximized the
over-sized pipe connection to the downstream system (Pond BP-35.1) as intended, the pond
level continued to rise, although at a greatly reduced rate. The maximum level of the pond
from the storm reached a higher level than projected from such a storm event, but
apparently only because of the reduced ability of the pond to discharge at its design rate
early in the storm event, likely because of some type of restriction that eventually cleared
itself.
While I can appreciate the concerns that the pond appeared to be outside its typical range of
operation and beyond the expected limits of the October 4 storm, the experienced water
levels were contained at an elevation sufficiently below affecting any structures. As close
as the pond appeared to get to the walkout levels of the homes surrounding it, the storm
drainage system enabled it to handle runoff from this significant storm event without
affecting the homes, even with the likely restriction of the normal outlet. The drainage
improvements constructed since the July 2000 storm event allow this pond to address a
storm event of 10" to 12" in a 24 hour period without impacting adjacent homes under
normal outlet conditions, as well as a lesser, yet significant, event with the primary outlet
restricted. In both situations, the pond can become very close to the lowest entries, but, in
accordance with the design, would not affect the structures.

I believe you may have been looking for more assurance that Pond BP-35 would not reach
such an elevation again with a similar storm event. I can tell you that our City maintenance
crews have placed this outlet on an ongoing inspection schedule along with other critical
locations throughout the city. We will inspect it after every major storm event to remove
any debris that may have accumulated to insure its functionality for the next storm event.
We would also like to encourage the homeowners' association to regularly check the area
in front of the outlet structure between storm events to ensure that debris is not present that
could block the outlet and inform City Maintenance personnel of any concerns. If it would
be helpful, we would be happy to place markers that reflect the design 1% (100 yr) high-
water elevation for quick and convenient reference by the adjacent homeowners.

Dear Burt:
Thank you for meeting with me to discuss your concerns about the elevation of the pond behind
your home as a result of the October 4, 2005, storm. As a follow-up to our meeting, I also wanted
to acknowledge the telephone conversations we have had further discussing the matter. I
appreciate this opportunity to respond to your request.
In addition to researching the plans of the existing storm sewer system, City staff have visited the
site to inspect the downstream pipes for any possible blockage. While the overland outflow and
pipe outlet for the pond appear to be free of any potential restrictions, the pond characteristics and
existing stone retaining walls look like they may be creating some misunderstandings about the
expected pond elevations.
As we have discussed, the pond rarely has water present due to its terrific rate of infiltration or
soaking into the ground. When it typically does have water present the elevation of that water
appears to be a maximum of about 906.0 feet above sea level. The earthen berm on the north end
of this portion of the pond that we have discussed has a height of about 913.0, or 7 feet above the
typical pond water level.
Contrary to what I mentioned yesterday, water has three ways of exiting this pond; soaking into
the ground, overtopping the berm, or by storm sewer pipe. In order for the water to exit the pond
via the pipe, the water level must be at a minimum of 910.0 feet, only 3 feet below the top of the
berm and 4 feet above the typical pond elevation. After a significant storm event, such as the rain
storm of October 4, the pond level could easily get to 911.5 feet before exiting the pond at the
storm sewer outlet structure.
The retaining walls that were observed to be inundated with the pond water as a result of the
October 4 storm appear to be well within the range of elevations from 906.0 to 913.0 and actually
within the drainage or ponding easement. While I can appreciate that the pond was outside of its
typical range of operation and appeared to be beyond the established control limits as a result of
the October 4 storm, the experienced water levels were well within the design of the storm sewer
system. The retaining walls should not have been constructed in their existing locations, as they
were not included upon the City reviewed grading plan for the development nor was separate
approval obtained from the City at a later date. At this point there will not be any action by the
City of Eagan to remove said retaining walls, but there could be consequences upon a failure of
any of the walls.
Regarding the elevation of the pond (Pond BP-35) north of Diffley Road and west of Johnny Cake Ridge
Road as a result of the same storm, it also appeared to be within the limits of the design of the storm
sewer system. As close as the pond appeared to get to the walkout levels of the homes surrounding it, the
storm sewer system enables it to properly address drainage from an even larger storm event without
flooding the homes. The drainage improvements constructed since the July 2000 storm event will allow
this pond to address a storm event of 10" to 12" in a 24 hour period without flooding the adjacent homes.
The pond would be very close to the lowest entrees, but, in accordance with the design, would not impact
the houses.
