The south lot line lies along the right-of-way of Wescott Road which was improved, presumably to the west line of Section 13, in the year of the deed. Survey stakes on the south line had been removed as a part of that improvement projec[. Some time after our house was constructed, I prepared a scale drawing of the lot for landscape planning purposes. This drawing disclosed an apparent problem on the west lot line. At my request, the City of Eagan re-surveyed the entire south line of South Hills and replaced survey stakes. The stake at the southwest corner of our lot lies considerably west of the end of the improved Wescott Road and in the middle of the en[rance to the driveway of our neighbors to the west, Mr. and Mrs. Richard Lutz. A line run from this stake to the existing stake at the northwest corner of the lot cuts off a pie-shaped piece of that driveway. Note that the City of Eagan regraded that driveway entrance to meet the new grade of Wescott Road and unecessarily removed a tree from the westerly portion of our lot to provide proper slope based on the erroneous allignment of the neighbor's driveway. Discussion with the plat surveyor has so far shed no light on the matter nor have I talked with the County Sutveyor to determine the status of the southwest corner marker of the section which should lie in the middle of Wescott Road. Since this encroachment by my neighbor's driveway is clearly an encumbrance on the title to our lot, you must remove it under the provisions of your warranty. We are not now in a position to convey marketable title in the event we wish to sell. Any acceptable cure includes relocation of the offending driveway to its proper allignment considering the above noted Wescott Road project. Since the driveway has been in place in excess of fifteen years, it represents a potential cloud on the title which must be removed. This could be accomplished by a recordable Quit Claim deed from the neighbors to us, or failing to acquire such a deed, by an action for Registration of Title cutting off any claims of others. Tt is my understanding that Wescott Road is to be improved to the west this summer. Accordingly it is imperative that this matter be resolved expeditiously so that the curb-cut for my neighbor's driveway can be made in the correct location. The following is what i have found: There is a lot corner stake placed at the eouthwest corner of Lot 2. Although we did not place this monument, I have no reason to expect that it is not in the proper position. This monument is in the approximate center ofa gravel drive. Based on this, the drive encroaches severai feet into Lot 2. I researched our survey notes from the time our aurvey vork began on this property in 7971. At that time, we have no record of the drive encroaching onto this property. As a backup to this, there are county survey records indicating that the center of the drive prior to the upgrading of Wescott Road was 9 feet west of the section line or the weet line of Lot 2. There is also indication that when Weecott was upgraded that the county regraded this driveway entrance. In making a comparison between aerial photos that have been taken over the years, I beiieve that it is evident that the drive ' has moved east. Therefore it is my opinion that this encroachment problem has occurred do to the upqzading of Wescott and the re9rading of the drive entrance and that this took place sometime after 1973. Christenson President ' MEMO TO: DIRECTOR OF PUBLIC WORKS COLBERT FROM: CITY ADMINISTRATOR HEDGES DATE: JULY 16, 1987 SUBJECT: RUSS HEADLEY/DRIVEWAY ENCROACHNiENT ISSUE I met with Russ Headley, who resides at 3793 South Hills Circle (Lot 2, Block 1, South Hills lst Addition), on Tuesday, July 14, to discuss a lot line encroachment that he is claiming occurred when Wescott Road was improved in the late 1970's. Apparently, when Wescott Road was upgraded to its present terminus, adjacent to the South Hills Addition, the improvements stopped approximately 14 feet short of the west aoundary line. As a result, the parcel immediately to the west of Mr. Headley's, owned by Mr. Richard Lutz, was given a driveway access which encroaches approximately 8-9 feet on Mr. Headley's property. According to Mr. Headley, the Lutz driveway was below the existing Wescott grade by several feet and as a part of the Wescott Road improvement project, his driveway was improved to match the new established grade and relocated to match the west boundary line of the terminus of the Wescott Road improvements. According to Mr. Headley, the monuments show clearly the driveway is encroaching on his property. The reason he is b--inging these issues to the City's attention is to make sure that the driveway cut for Lutz's property is placed at the proper location once the Wescott Road improvements are made so there is no encroachment on his property. i4ould you have our survey team investigate further and please contact Mr. Headley at 454-3199 to communicate your findings with him..
