APPLICATION SUMMARY: An application has been submitted
requesting a Preliminary Plat for the Ridge Haven Addition. This
plat consists of fourteen single-family lots on 5.2 R-1-zoned
acres located along the south side of Sibley Hills Drive and east
of Highway 13.
EXISTING CONDITIONS/SITE PLAN: Currently there is an existing
homesite on proposed Lot 12 that will be removed.

stovepipe"-shaped lot is now served by a long, shared driveway
with an exception at the northwest portion of the site.. The
width at the proposed street right-of-way line is 20' and 50' is
required. EithEr a Variance will be necessary or all of the lots
will have to be shifted to the east. All other R-1 lot
requirements have been satisfied. The lots vary in size from
12,000 SF to 18,600 SF (stovepipe lot). The gross density of the
plat is 2.7 units per acre. Lots 1, 2, 3, 4, and 14 have double
frontage on both Sibley Hills Drive and the internal street.

On May 3, 1990, Stan Lexvold had a telephone conversation with
Brian Mathison, Norma Hendrickson's son, about when their yard was
going to be final graded and turf established. He stated that they
were waiting for the builder (Joe Miller Homes) to come and
complete the work. He also agreed that some type of retaining wall
will have to be constructed.
Phone calls were made to Joe Miller of Joe Miller Homes questioning
when he was going to complete the grading. He said he would come
in and do some grading after the retaining wall was constructed.
It was discussed with the homeowner and he was concerned about the
water runoff that was eroding his property.
A meeting was set up with Don Prettyman, the developer of Prettyman
Heights and also Mark Zabel from Dakota County Soil and Water to
discuss the Developer's responsibilities and its in-place erosion
control fencing. As a result of this meeting, various locations
of their erosion control fencing were repaired and a temporary
diversion was graded in on the Prettyman Heights property to carry
the runoff in a ditch in a northeasterly direction out to Sibley
Hills Drive and outletting into the street. Brian Mathison has
stated that little or no erosion has happened since the temporary
diversion was constructed.

On August 20, 1990, the slopes behind and to the south of the house
located on Lot 5, Block 1, Ridgehaven Acres were checked for 3:1
slope compliance. The four locations checked ranged from 2.21:1
to 2.57:1. See attached sheet for approximate locations.
On October 11, 1990, a meeting was held at the City of Eagan
concerning the grading of Lot 5, Block 1. In attendance were Steve
Ramsey-developer; Peter Knaeble-Ron Krueger & Associates, Inc.;
Brian Mathison, homeowner's son and City of Eagan staff. The
developer's grading contractor was unable to attend.
On October 15, 1990, a letter was sent to Steve Ramsey-developer
informing him that 3:1 slopes are obtainable with minor grading and
construction of a retaining wall. Steve Ramsey was then going to
notify his grading contractor.
On October 25, 1990, a letter was sent to Brown & Cris from Ron
Krueger & Associates stating that two items of work, one being the
lot grading, had to be completed to the satisfaction of the City
prior to the final pay estimate being approved. several phone
conversations with Steve Ramsey since October 25th have resulted
in absolutely nothing.

As of December 10, 1990 there has been no change in the site work.
Pictures enclosed were taken June 20, 1990.
On December 11, 1990 a machine was moving the eroded material that
had been piled on city right-of-way onto private property.
City Staff Position:
3:1 slopes are obtainable with some minor grading and the
construction of a retaining wall. Runoff protection must be
provided from the Prettyman Heights property.

You had requested that City staff review the street cleaning bills
associated with the clean-up operations in the Ridgehaven
development. In your opinion, the debris and sediment cleaned from
the streets in the Ridgehaven development is a result of the
Prettyman Heights development not complying with the erosion and
sediment control measures. For your information, the Prettyman
Heights development has received its share of street cleaning bills
associated with street cleaning operations within their
development.
At this point, the City is not in the position to determine what
percent of the bills associated with erosion and sediment washed
into the Ridgehaven development is from the Prettyman Heights
development, and what percent of the erosion and sediment existing
in the Ridgehaven development is indeed from the Ridgehaven
development itself. Each development is responsible for the clean-
up operation in their respective development. If there is an
inequity in your opinion, the burden of proof of the inequity is
between you and the adjacent development.

conform to the approved grading plans submitted April 14, 1989.
Developments in the City of Eagan are required to construct

Enclosed is a print of the grading plan where approximately the
slopes were checked for 3:1 conformance.
Please advise what corrective action is going to be taken to

Dear Steve:
This letter is in reference to two items, #1 being that Lot 5,
Block 1 will be graded such that the 3 to 1 slopes shown on the
Development Grading Plan can be adhered to. The 3 to 1 slopes are
obtainable with minor grading and construction of a retaining wall.
Item #2 is the existing berm located on the north side of Lot 1,
Block 1. The existing unrestored condition of this berm is
unacceptable.
You have two options, either remove the berm completely or cut the
berm down at least 2' feet so it blends more pleasing to the
terrain of the property. If the berm is cut down, the material
could be moved easterly and blended into the adjoining vacant lot.
In either case, the City requires a minimum 8 foot boulevard, the
area properly graded, topsoil and sodded from the back of curb to
the existing maintained yard.
With your cooperation this work should be all completed by October
26, 1990.

In our conversation with Stan Lexvold we stated that we would provide up to 2
hours small dozer time to work around the home owner's retaining wall in exchange
for a complete release of all liability from Haven Enterprises and Steve Ramsey;
Don Prettyman, et.al. TriLand Company; Orr Schelen Mayeron & Assoiciates; Ron
Krueger & Associates, and the homeowners. If everyone agrees to these releases,
we will provide the dozer time as discussed.
Regarding the berm situation, we restate our original position. The material
was put there upon approval of Steve Ramsey. We graded and seeded this berm
on July 13, 1990 to the satisfaction and approval of Orr Schelen Mayeron's
representative, Richard Keeling. Currently, the seed appears to be doing very
well. If someone now desires this to be moved, we will move it, but only if
we are compensated for our time, material and equipment.
We hope that these issues can be resolved soon as our last day to file lien
rights is fast approaching. We have instructed our attorney to commence lien
action on November 15, 1990 if we have not received final payment.
Please review with all parties concerned and advise. Thank you for your
cooperation.

Based on your letter to Mr.Peter Knaeble of Ron Krueger
& Assoc. dated October 31,1990 concerning your final
payment for the above mentiond project, I would like to
address the two issues that seems to be of concern to both
myself and the City of Eagan.
In regards to the slope around the property in question
it appears that your donation of two hours dozer time would
be adequate to obtain the work needed to satisfy the City,
but I think you should contact the homeowner to start this
work before freeze up.
In regards to the berm that you put in at the entrance of the
project I thought I was trying to help you by letting you put
this excess dirt from the road contract with the City, however
I did tell you that the berm would have to shaped and sodded
to satisfy the City. Now that the City is not happy or satisfied
with what you have left there I am forced to ask that you contact
Stan at the City to see if he would accept any thing less than
completely removing the berm. fie has told me he would. But at
this time I request that you either remove the berm, correct
it to the satisfaction of the City of Eagan, or I will be forced
to hire someone else to complete this work and back-charge the
cost of same against your contract and final payment.
Please let me know what you intend to do concerning the two above
mentioned problems as soon as possible, because this work needs
to be completed before winter.
