This temporary slope easement, made this day of sF E?siBE.e
1990, between VINCENT STORLAND and NORMA STORLAND, h sband and
wife, herein referred to as "Landowner" and the CITY OF EAGAN, a
municipal corporation, organized under the laws of the State of
Minnesota, hereinafter referred to as the "City".
W I T N E S S E T H:
That the Landowner, in consideration of the sum of one dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the City, its successors and assigns, a temporary
easement for slope purposes, over, across and under the following
described premises, situated within Dakota County, Minnesota, to-wit:
`. i- empbrary slope easement--over--the west -5-.-00 feet
,of Lot Two (2), Block One (1), Norvin Oaks
according to the recorded plat thereof.;'
Said easement to expire August 1, 1991.
See also Exhibit "A" attached hereto and incorporated herein.
The grant of the foregoing temporary easement shall be restricted
to slope purposes, but includes the right of the City, its
contractors, agents and servants to enter upon the Easement Premises
at all reasonable times to construct, reconstruct, inspect and repair
slopes and the further right to remove trees, brush, undergrowth and
other obstructions within the Easement Area. After completion of such
construction, maintenance, repair or removal, the City at its sole
cost shall restore the Easement Premises to the condition in which it
is found prior to the commencement of such actions, save only for the
necessary removal of trees, brush, undergrowth and other natural
obstructions. Excluding the large maple tree. 'rp Q NE.5.
IN TESTIMONY WHEREOF, the Landowner has caused this easement to
be executed as of the day and year first above written.
