NOW THEREFORE, the Grantors, in consideration of,One Dollar
($1.00) and other good and valuable consideration to them in hand
paid by Grantee, receipt of which is hereby acknowledged, hereby
grant to Grantee, its successors and assigns, a permanent easement
for driveway purposes, together with full and free rights of access
for vehicles and pedestrians over the followinq described property:

County, Minnesota, according to the recorded plat thereof,
described as follows:
Beginning at the northeast corner of said Lot 7, thence westerly
along the north line of said Lot 7 twenty-one (21) feet, thence

feet southerly of the said northeast corner, thence northeasterly
along said east line to the point of beginning and there
terminating.
Said easement shall benefit and be appurtenant to all and any portion

run with Grantors' land and the title thereto and shall be binding on
Grantors and their hei=s, successors, and assigns and any person who

~ TEMPORARY GRADING EASEMENT
THIS INDENTURE, made and entered into this day of ,
1986, by and between DENNIS ROSE and VICKIE ROSE, husband and wi~
as Grantor, and TRI-LAND PROPERTIES, INC., as Grantee.
WITNESSETH WHEREAS, said Grantor is the owner of the tracts of
land in the City of Eagan, Dakota County, Minnesota legally described
as follows:

NOW, THEREFORE, the said Grantor, in consideration of One Dollar
($1.00) and other good and valuable consideration to it paid by
Grantee, receipt whereof is hereby acknowledged, hereby grants an
easement to the above premises to said Grantee, its heirs and
assigns, for temporary grading purposes, said easement to expire
December 31, 1986, said easement to include the following described
area:

The Grantee shall have the right to do whatever is necessary for
the enjoyment of the rights herein granted, including the right of
clearing the easement area to allow for the use of the land as stated
herein and for ingress and egress to and from said tract of land and
over and across said easement only for the purpose of grading said
property. The grading to be performed is for the purpose of creating
approximately a 33$ slope. After grading, Grantee shall re.store said
property to a condition as near as reasonably possible to its
original condition.
And the said Grantor, for itself, its heirs, executors,
administrators and assigns do hereby release said Tri-Land
Properties, Inc., its successors and assigns, from all claims for any
and all damages resulting to said land by reason of the grading
activities.
