between HUTTNER CONSTRUCTION INC., a minnesot7d corporation, herein
referred to as "LANDOWNER" and the CITY OF EAGAN, a municipal
corporation, organized under the laws of the State of Minnesota,
hereinafter referred to as the "CITY".
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar
($1.00) and other good and valuable considerations the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the City, its successors and assigns, a temporary
easement for slope purposes, over, across and under the following
described premises, situated within Dakota County, Minnesota, to-wit:
A temporary easement over, under and across the following
described property:
The northerly 30 feet of lot 5, block 1, SUNCREST,
according to the recorded plat thereof, Dakota County,
Minnesota
Said temporary easement shall be for the construction of Birch
Street and shall terminate when said Birch Street has been
constructed west of Sunwood Trail, or January It 1999, whichever
comes first.

The grant of the foregoing temporary easement shall be
restricted to slope purposes, but includes the right of the City, its
contractors, agents and servants to enter upon the Easement Premises
at all reasonable times to construct, reconstruct, inspect, and
repair slopes and the further right to remove trees, brush,
undergrowth and other obstructions within the Easement Area. After
