Dear Mr. Reid:
This letter is a request for help. The problem is that our yard
has been damaged and the potential for more damage exists. The lot
behind our yard is a rather steep up hill, partially unsodded, lot.
A house was buiit on the lot last summer. The present owners, Lee
and Connie Cole, moved into the house last fall. We were assured
by them that their lot would be sodded. However, this has not
happened.
We expect the lot behind our yard to be sodded as soon as possible.
This is necessary to stop the silt from washing down into,our yard.
Can you do something to get this done?
The following is an account of what has happened:
8-9-93 Dirt washed down into the Bosma yard. Gerri Bosma spoke to
Bill Brustell, Eagan city inspector, requesting that the contractor
clean up the dirt. Dale Shepner, Eagan city inspector, spoke to
Aoward Bosma about the situation.
8-10-93 Mike from Midwest Excavating Company cleaned up some of
the dirt from Bosma's yard. The Bosmas were not satisfied with the
clean up.
8-13-93 More dirt washed into Bosma's yard. Gerri left message
for Tom Kirberger, the builder, to please call her or the city
inspector, Dale Shepner. Tom called Gerri and assured her that heL
yard would be restored to her satisfaction.
8-18-93 Due to heavy rain much more dirt and silt washed down into
Bosma's yard. The silt and water came into the garage. Gerri
called Tom Kirberqer and left a message informing him that we need
to talk.
10-19-93 Dale Shepner spoke to Howard Bosma and related that he
had spoken to Tom Kirberqer and that Tom will ha~e the Bosma yard
cleaned up.
10-20-93 A landscaper came to Bosma's yard to give an estimate on
what was needed to restore Bosma's yard. (This landscaper came upon
Gerri's request.)

10-20-93 Lee Cole called Gerri and asked for input on how to clean
up yard. He and Tom Kirberger were meeting that evening. Gerri
requested that yard be cleaned up and sodding be done this fall,
1993. Bosmas want to prevent more dirt form being washed into
their yard. Also, Gerri shared that the landscaper advised that
bales of straw or hay be staked into the ground along the lot line
to stop soil/silt from washing into neighbor's yard(s}.
11-16-93 Gerri spoke with Bill Brustell and requested that bales
be staked into ground along lot line.
11-17-93 Lee Cole expresses his desire to 'fix' Bosma's yard this
fall, 1993. However, nothing was done. (Probably due to onset of .
coid weather.)
4-23-94 Lee tells Gerri that they hope to have Bosma's yard
'fixed' by April 29, 1994.
5-22-94 Sosma's yard is 'fixed'. Lee and Connie laid the sod.
Because the sod in the waterway was too high and therefore the
water would not drain around the garage and out to the street,
Howard Bosma pulled back sod and dug out dirt to lower tie
waterway. Having completed this, the job was satisfactory.
7-14-94 Gerri spoke to Dale Shepner requesting that he apply
pressure on the home builder, Tom Kirberqer, so the newly developed
lot will get sodded. The Bosma yard is getting silt washed into it
from the unsodded backyard. Dale said he would talk to Lee Cole to
determine what agreement Lee and contractor had made.
9-94 More dirt has washed down into Bosma's yard from Cole's lot
when there was a heavy rainfall. Much silt has settled in
waterway. Gerri called Lee and Connie. Lee told Gerri that they
hope to have backyard sodded by second week in October.
10-16-94 Cole's yard is not sodded. Gerri called Eagan Building
Inspector's office requesting help. She tells Nancy that she will
put together a letter with history of this problem and get it to
Doug Reid.
Mr. Reid, we feel that we need someone with authority to get the
Cole's yard sodded. We feel that this problem should never have
happened. We want to emphasize that we are angry about what has
happened because it has been very inconvenient and our backyard
grass is filled with silt. No one likes 'mud' in their backyard.
Also, we are concerned about the future. The potential for more
dirt and silt to wash into our yard exists. The men in your
inspector's office have been very nice and responded to us.
However, the problem still is in our backyard. Also, Lee and
Connie Cole are nice people and we are trying like everything to
not be angry with them. We have taiked and talked. But, THE
PROBLEM STILL IS IN OUR BACKYARD!!!!!

home at 4390 Svensk Lane in Eagan, MN. Enclosed is a copy of the city's home occupations
ordinance. Please read the ordinance carefully.
The proposal appears to be consistent with the City ordinance standards applicable to a home
occupation. Please note that the City ordinance does not allow retail sales from a residential
home. Our determination that the proposal is consistent with City ordinances is based on your

Thank you for taking the time this morning to discuss the firearm application submitted to the ATF by Mr. Kevin Shapiro
who resides at 4390 Svensk Lane, Eagan, MN.
I have attached the e-mail request received from Mr.Shapiro as well as my written response to his request.
The City of Eagan has a Home Occupation ordinance which prohibits over-the-counter sales in R-1 (Single Family)
Zoning. The ordinance can be found here: https://www.cityofeaan.com/home-occupations.
In addition,the letter I sent clarifies"prohibited over-the-counter sales" means that walk-up traffic is also restricted.

Yes, I am applying For an FFL type 01 which is a dealer in Firearms, I will only be
open four hours every Wednesday from 3:30
PM-7:30 PM. What I will be doing from my home is called a "transfer" EX: when an
individual buys a firearm online it needs to
be transferred to them via a licensed FFL Holder so all the background checks can be
done and ensuring that the individual
can legally possess a firearm. I will be charging the individual $25.00 per transfer.
