Ulteig performed a review of non-standaxd holes drilled into several 2x"LD floor joists as well as the
misplaced garage portal frame holdowns for a residence under construction located at 4306 Swect
Street in Eagan, MN as directed by Dave Young of M. W. Johnson
The first set of flo~r joist holes in qucsHon is a group of three to five holes thxough several joists,
approximately 7/8` in diameter, spaced approximateiy Y' - 1~/z" on center, located in the center third
of the joists. The second set of hotes includes varying sizes that ate thiough both a single joist and a
double joist, located toward the end of these membixs. Refer to the attached plan and pictures for
more informaticn.
The (2) Simpson MAB23 holdowns at eadt side of the garage door openings specified in ihe "Master
Garage Laterat Frarning" packet issued by lilteig {Pxoject 207.0276 dated 3-9-06} were not put in
correctly. An alternate connection is required.
Ulteig perEornied a sfi•uctural analysis oE these conditions and determined that the floor framing is
structur211y ldequate with thc current holes in place, but the following requirements are required at
each side of the garage doors to ensure Code compliance:
1. Vexify a mini~um of (7) 10d nails through the extexior sheathing into thc sill
plates, d~
2. Two Simpsott'/z" x 6" Titen HD anchors with 2° diameter oversized washers are

Dear Ms. Maruthaiah and Mr.Madhavan,
The City of Eagan has received from Jacobson Engineers & Surveyors the attached grading and
drainage plan (Project No. 213029; April 26, 2013) as your combined plan: 1) to restore the
conservation easement area, as required;and 2)to re-grade City Pond LP-26.6,as you propose.
You should recall Robert B. Bauer, City Attorney, first corresponded with you on November 28,
2012, directing your prompt attention to the restoration of the conservation easement area in
cooperation with Eric Macbeth, the City's Water Resources Manager. I understand Mr. Macbeth
subsequently informed you the City may consider a proposal to modify City Pond LP-26.6.
Additional interactions in person, by phone, and via email between Mr. Macbeth and you occurred
during the winter to clarify matters. I acknowledge winter conditions prevented reasonable
progress until mid to late April.
I have reviewed the attached grading and drainage plan. Based upon my review of your plan and
discussions with your engineer, I cannot accept the proposed design out of concern for the safety of
your family and any visitors to your home. While the design meets the storage capacity needs and
may be acceptable from a water quality treatment perspective, the pond grading required to
accommodate your desire for access to the lake would create slopes to the pond that would be
steeper than what is acceptable. The concern is that a person, especially a child or physically
challenged person, could slip or fall into the pond and not be able to get out due to the steepness of
the slopes.
City staff have expended a significant amount of time in attempting to assist your efforts to
properly address your violation of the conservation easement and filling of the storm pond within a
drainage and utility easement. The time has come to have this matter resolved. I am open to hear
other solutions and am willing to discuss any remaining options, but a resolution of the matter that
is satisfactory to the City must be completed by August 15, 2013. Please contact me at your
earliest convenience to discuss the resolution.

The fence we are proposing to erect will be an extension of an already existing six foot batt�en
board cedar privacy fence on the easterly�undary of ow property. The e�ctension of the
existing fence will follow the s$me path and will be sotely on our property as detetmined by
our surveyor.We propose to extend the fence in a southerly direction abo�20 feet into thc•

Contracting, Inc. Hedges added that on the May 10, 2010, City staff received a letter from the
contractor requesting that his construction forces be allowed to work 24 hours a day, Monday—
Sunday.
Mr. McNamara noted that the original schedule proposed is being requested to be
changed in order to allow construction to occur from May 15 through May 27.
Councilmember Tilley moved, Councilmember Bakken seconded a motion to approve
the revised construction schedule from May 15 through May 27, and allow work to occur 24
hours a day throughout the approved time period.

VII. CONSERVATION EASEMENTS &ENCROACHMENTS
City Administrator Hedges introduced the item noting that as a condition of development
approval,the City has required the dedication of conservation easements over environmentally
sensitive areas of plats. Hedges added that the purpose of the conservation easements are to
protect the pre-development character of the area and to allow it to remain in its natural state for '�
the benefit of the general public and the adjacent property owners.
Public Works Director Colbert provided an overview on the conservation easements
currently in place within the City of Eagan. Colbert added that as a result of routine compliance
inspections and proactive education efforts over the past several years, City staff is discovering
that some property owners have either already violated the terms of the conservation easement
with an existing encroachment, or expressed an interest to do so in the near future. Mr. Colbert
inquired with the City Council as to the level to which the Council would like staff to investigate,
enforce, and educate the public with regard to conservation easements.
The City Council reviewed four potential options with regard to enforcement of
conservation easements. The Council provided direction to proceed with the option of
"Compliance Enforcement". Under such a practice, staff would conduct routine inspections and
administratively mandate a scheduled compliance action for restoration of the property to its
natural conditions. The Council voiced their consensus that under this policy, a property owner
would have the right to appeal directly to the City Council should there be a disagreement over
compliance with a conservation easement. The Council also directed that correspondence be
sent to all property owners who have conservation easements on their property to educate them
regarding new regulations of such easements. The Council also suggested that conservation
easement compliance would be a potential future topic to include in the Experience Eagan
Newsletter.
