Devices for model 9999
The Roman Tub Diverter Device is in compliance with ANSI/ASME A112.18.1M
and CSA B125, and all the referenced standards within them, such as ASSE
1014 for back pressure and back siphonage of the hand held shower. This
product is listed with Intemational Association of Plumbing and Mechanical
Officials (IAPMO), Canadian Standards Associations (CSA), and various state
and city jurisdictions in the United States.
The backflow prevention system in this product consists of a spring loaded
diverter which closes the water passage to the hand shower to prevent back
pressure backflow. The diverter automaticaily opens an air passage to the
roman tub spout when water is not flowing through the diverter, and prevents
back siphonage due to negaUve gauge pressure. Additionaliy, there is a second
check valve located at the discharge of the vatve to the hand shower. Therefore,
the system prevents both back pressure and back siphonage backflow.

CONSERVATION EASEMENT
THIS CONSERVATION BASEMENT is made this 4, f9 day ofr , 2005,
between EPIC DEVELOPMENT, LLC, a Minnesota limited Liability company (hereinafter
referred to as "Landowner") and the City of Eagan, a municipal corporation, organized under the
laws of the State of Minnesota (hereinafter referred to as the "City"),

That the Landau/nor, in consideration of the sum of One Dollar ($1,00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does
hereby grant and convey unto the City, its successors and assigns, a permanent conservation
easement for the purpose of preserving and prateating the natural character of the area, over and
across the following described premises, situated within Dakota County, Minnesota, to -wit;
Those parts of Lots 1, 2 and 3, Block 1, SWEET PJ..ACB, lying southerly of the following
described line: Commencing at the southwest corner of said Lot 3; thence North 14
degrees 25 minutes 46 seconds East, assumed bearing, along the westerly lino of said Tot
3 distant 294.38 feet to the point of beginning of said line to be described; thence South
75 degrees 53 minutes 07 seconds East, a distance of 61.37 feet; thence South 89 degrees
11 minutes 00 seconds East a distance of 95,78 feet; thence South 78 degrees 56 minutes
46 seconds East a distance of 66.30 feet; thence South 68 degrees 27 minutes 17 seconds

The Landowner, for itself and its successors and assigns, covenants and agrees that it
shall not perform nor shall it give permission to any third party to perform any of the following
activities within the Easement Area, without the prior written consent of the City:
A. Constructing, installing, storing or maintaining anything made by man, including
but not limited to, buildings, structures, fences, walkways, clothes line poles and
playground equipment;
B. Parking of vehicles;
C. Planting of gardens;
D. Storage of firewood; or
E, Clear -cutting or removal of native vegetation or trees.
The Landowner, for itself and its successors and assigns, further covenants and agrees
that the general topography of the Easement Area shall be continued in its present condition and
no excavation or change in the topography shall be allowed, save and except as may be required
by any federal, state or Iocal gevernment agency, other than the Landowner, which have
jurisdiction over the Easement Area or as authorized by the City, in writing, as the City shall, in
its sole discretion decide is appropriate; that no cutting or harvesting of any live tree or other live
vegetative cover shall be permitted except as may ire required by any federal, state or Iocal
government agency, other than Landowner, which have jurisdiction over the Easement Area or as
authorized by the City, in writing, as the City shall, in its sole discretion, decide is appropriate.
This easement shall be effective upon Landowner's execution and shall continue in force
in perpetuity.
Landowner reserves the right to occupy and use the Easement Area for all purposes not
inconsistent or interfering with the restriction& set forth herein. The easement granted hereunder
and the covenants contained herein shall run with the land and shall be binding onto the parties
hereto and their successors and assigns.
And the Landowner, its successors ,and assigns, does covenant with the City, its
successors and assign& that it is the Landowner of the premises aforesaid and has good right to
grant and convey the easement herein to the City.
