I received your email with the site survey of the 4611 Sweet Street property.
The fence we are proposing to erect will be an extension of an already existing six foot batten
board cedar privacy fence on the easterly boundary of our property. The extension of the
existing fence will follow the same path and will be solely on our property as determined by
our surveyor. We propose to extend the fence in a southerly direction abmit 20 feet into the
drainage easement shown on the survey of the property. We have shown the existing fence on
the survey highlighted in red and the proposal extension highlighted in pink.
The purpose of the extension is to reduce road noise from HWY 3/South Robert Trail and
provide more privacy. The extension of the fence will be same height, material and comply in
all regards with the ordinance. A fence may be erected in an easement per the ordinance
which I have attached.

A. Conservation Easement Encroachment
Lot 3, Block 1, Sweet Place
Action To Be Considered:
DENY (or APPROVE) a request for encroachment upon a Conservation Easement located on
property identified as Lot 3, Block 1, Sweet Place.
Facts:
➢ As a condition of development approval, the City has required the dedication of
conservation easements over environmentally sensitive areas of plats. A dedication of
conservation easement occurred with the recording of the Sweet Place pla# and
specifically upon Lot 3, Block 1 (4611 Sweet Street).
➢ The purpose of the conservation easements is to protect the pre-development character
of the area and to allow it to remain in its natural state for the benefit of the General
Public and adjacent/riparian property owners. Most conservation easements have been
granted along shorelines of lakes or wetlands or within heavily wooded areas.
➢ Under the terms of the conservation easement, which is recorded against the title at the
County, the owner retains fee title to the property but is prohibited from placing man-
made structures within the easement area and also from removing trees (other than
diseased trees) or maintaining turf/landscape.
➢ The terms of the conservation easement provide that no such encroachment is
permitted within the easement area without prior written consent of the City.
➢ The City has 48 conservation easements encumbering over 150 parcels within the City.
➢ Within the realm of performing typical tasks, City staff are discovering that some
property owners have either, already violated the terms of the conservation easement
with an existing encroachment or, expressed an interest to do so in the near future.
These encroachments encompass a range of activities within the easement area such as:
storage of boats or docks; construction of fire pits or trails (wood chips, concrete pavers,

Conservation Easement Encroachment-Lot 3,Block 15weet Place(4611 Sweet Street)
City Administrator Osberg introduced the item noting the Council is being asked to deny or approve a
request for encroachment upon a Conservation Easement on property located at 4611 Sweet Street.
The property owners have been informed by City staff of a violation of the conservation easement on
their property(fence and mowing).
� Public Works Director Matthys gave a staff report and �rovided additional information. -
Property owners,Chuck and Camille Witzke,addressed the Council regarding the conservation
easement violations on their property. They gave a summary of their request and were available for
questions. The Witzke's stated they have no problem taking down the three panels of fencing, bringing
the fence to its original state, but feel the 10 to 32 feet of vegetation along the shoreline to be adequate
and are requesting that they be allowed to maintain it as is.
Water Resources Manager Macbeth provided additional information on the conservation easement
encroachment.
The Council discussed the conservation easement encroachment.
Mayor Maguire moved,Councilmember Fields seconded the motion to approve a request for
encroachment upon a Conservation Easement located on property identified as Lot 3, Block 1,Sweet
Place with the condition of removal of fence within the conservation easement and to allow the
continuance of the mowing as it exists today,subject to an executed agreement to be prepared by the
City Attorney. Aye:4 Nay:0
Planned Development Amendment-Storchak LLC—A Planned Development Amendment to
Allow a detached trash enclosure located at 3435 Washington Drive
City Administrator Osberg introduced the item noting the Planned Development Amendment(PDA)was
recommended for approval by the Advisory Planning Commission at their November 5, 2014 meeting.
Osberg noted the request is for a PDA to allow a detached trash enclosure upon property located at
3435 Washington Drive. City Planner Ridley gave a staff report.
Mayor Maguire opened the public comment,there being no public comment, he turned the discussion
back to the Council.
, ENCROACHMENT AGREEMENT
This Encroachment Agreement is made and entered into this �day of ,i'i ,
2015, by and between Charles Witzke and Camille Witzke, husband and wife (heremafter
"Landowners"), and the City of Eagan, a Minnesota municipal corporation (hereinafter the
"City"). (The City and the Landowners are collectively referred to as the "Parties").
WHEREAS,Landowners are the fee owners of Lot 3,Block 1, SWEET PLACE and their
address is 4611 Sweet Place, Eagan,Minnesota 55123 (hereinafter the"Property"); and
WHEREAS, the Property is subject to a Conservation Easement in favor of the City
dated May 26, 2015 and recorded in the office of the Dakota Caunty Recorder as Document No.
�, 2347891 (hereinafter the"Conservation Easement"); and
WHEREAS, under the terms of the Conservation Easement, the Landowners were
prohibited from altering the easement area covered by the Conservation Easement without the
prior written consent of the City; and
WHEREAS,the City discovered that there was a fence and non-native vegetation within
the easement area; and
WHEREAS, the Landowners requested that the City a11ow the fence and non-native
vegetation within the easernent area; and
WHEREAS,the City Council of the City agreed that the current vegetation could remain, '
but that the fence would need to be removed and that the Landowner would n.eed to enter into
this Agreement to allow the non-native vegetation to remain.
NOW, WHEREFORE, in consideration of the foregoing and other good and valuable '
consideration, the receipt and sufficiency of which is hereby acknowledged, the Parties agree as
follows: '
1. ENCROACHMENT WITHIN THE EASEMENT AREA. The Landowners shall be
permitted to allow and maintain the existing vegetation to remain within
the easement area as it currently exists to date.
2. No MoD�F�CAT�oN. Except for the encroachment referenced in paragraph
1 above, a11 other terms of the Conservation Easement remain in full force '
and effect and no other modifications to the easement area may be made
by Landowner without the express written consent to the City. `
