The area is supposed to drain off your property and into the storm sewer on the adjacent MVTA property. After our phone conversation I inspected the site a~d found, in my opinion, that there is room to improve the grading and drainage on the MVTA property in the area between your property line and the.bottom of their slope. This could improve the drainage on yow property. On April 3, 2006 1 met with a representative from the MVTA and looked at the area in question. He agreed that there is room for improvement. He DID NOT commit to making any improvements at this time. However, he did agree to talk to some contractors, get some prices to do the necessary improvements and will present the estimates to his boss for final approval. [t is the City's desire for the MVTA to complete this work as soon as conditions allow and we have conveyed this to them. It should be noted, if the work does take place and is done cottectly, it will be in the City's opinion that the MVTA has done everything possible to address the situation and we will not be in a position to request any further work from them in that particular area. If the work is done propedy, it is my opinion that runoff from the MVTA property onto your property will be significantly reduced if not totally eliminated. As we've ' previously discussed, let me remind you that time is of the essence in getting us the as- built information on the storm sewer and retaining walls so the new easement can be recorded in a timely manner before the home is complete. As Pve stated on several previous occasions, both on site and during telephone conversations, the City can not issue the Certificate of Occupancy on the home until the easement has been officially recorded. During my inspection I noticed that the retaining wall appears to be encroaching into the area of the new drainage and utility easement. We will need ten feet from the centerline of the pipe in both directions, as is the City minimum for easements. Also, the wall wraps around the side of the existing manhole and is within a few feet of the manhole casting. As I stated to you on several occasions, the City does not allow permanent structures (i.e. retaining walls) to be placed in City easements. The Ciry assumes that this is a temporary location for the wall to allow for construction traffic above the wall and it will be moved closer to the house and out of the easement at a latter date. Please notify us if this is not your intention. Finally, prior to construction, there were two City owned signs, one marking the manhole and the other marking the flared end. During my visit, I did not see these signs. The one at the manhole is marked "MH" while the one at the flazed end is marked "FES". These signs must be replaced before construction is completed on the site. Ovexall Cnading Plan fox development: With pxelunuiazy and final subdivision appxovals, the developex (in this case Epic Development) is =equired to submit an overall xough grading plan (with 2-foot contout level of accuxacy) foz the entite development. The City zeviews this plan and it is noted in the development contract between the developex and the City. As-Built Gzading Plan: Upon completion of the Tough ~ading, the developez is xequized to submit an as- built ~ading plan to the City vuifying that the site has been gxaded to the ~ades ptoposed with the ovexall gtading plan, again to a 2-foot contour level of detail. Lot Survev: Priox to the issuance of a building pexmit, the builder is zequixed to submit a lot survey indicating existing and ptoposed spot grades on that individual lot.
