WHEREAS, a regular meeting of the City Council of the City of Eagan, Dakota County, Minnesota,
was held on the 4th day of October 2022, at 6:30 p.m. at the City Hall located at 3830 Pilot Knob Road,
Eagan, Minnesota; and
WHEREAS, pursuant to M.S.A. §412.851, the Mayor convened the meeting to consider the vacation
of right-of-way lying over and across the following revised described real property in the City of Eagan,
County of Dakota, State of Minnesota, described as follows:
That part of the Right of Way lying southwesterly and adjacent to, Lot 3, Block 4, Manor Lake 4th

WHEREAS, the Council at a regular meeting on the 7' day of June 2022, accepted a petition to
vacate said right-of-way pursuant to a petition and scheduled a public hearing on the vacation for the 5tn
day July 2022, at 6:30 p.m. at the City Hall; and
WHEREAS, an Affidavit of Publication of Notice of Hearing in the St. Paul Pioneer Press newspaper,
dated June 9 and June 16, 2022, relative to the proposed vacation was submitted; and
WHEREAS, it having been determined that other than petitioner, there are no other parties,
including public utility companies, having an interest in said right-of-way, and it appearing that it is in the
public interest to vacate such right-of-way, and there being no objections;
WHEREAS, the Council at a regular meeting on the 4th day of October 2022, approved a revised legal
description of the right-of-way previously approved at the July 5th Council meeting.
NOW THEREFORE, it was resolved that the right-of-way lying over and across the following revised
described property, as shown in Figure 2 which is attached, is hereby vacated:

This Amended and Restated Drainage and Utility Easement is dated mbtr Zo,
2022 and replaces that certain Drainage and Utility Easement dated May 27, 2022 and recorded
with the Dakota County Recorder's Office on July 29, 2022 as Document No. 3551450 (the
"Agreement"). This, Agreement is made this 'ad"' day of �a arr� }gym. � , 2022,
between Trinidad J. Uribe III, a single person, (hereinafter referred to as "Landowner"), and the
City of Eagan, a municipal corporation, organized under the laws of the State of Minnesota,
(hereinafter referred to as the "City").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby
grant and convey unto the City, its successors and assigns, a permanent drainage and utility
easement, over, across and under the following described premises, situated within Dakota County,
Minnesota, to -wit:
That part of the vacated Right of Way lying southwesterly and adjacent to, Lot 3, Block 4,
Manor Lake 4th Addition, which lies southeasterly and northeasterly of the following
described line:
Commencing on the most northerly point of Said Lot 3, thence South 24 degrees
22 minutes West, assumed bearing, along the northwesterly line of Said Lot 3,
70.00 feet, to a point of curvature of Said Lot 3, also being the Point of
Beginning of the line to be described; thence continuing South 24 degrees 22
minutes West 34.96 feet; thence South 56 degrees 20 minutes 33 seconds East
65.86 feet; thence South 9 degrees 00 minutes 37 seconds East 8.27 feet to the
centerline of Todd Avenue; thence South 65 degrees 38 minutes East along the
centerline of Todd Avenue 72.32 feet, more or less, to the northwesterly Right
of Way for State Trunk Highway Number 3, said line there terminating.

The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains; and the
further right to remove trees, brush, undergrowth and other obstructions. After completion of such
construction, maintenance, repair or removal, the City shall restore the premises to the condition
in which it was found prior to the cormnencement of such actions, save only for the necessary
removal of trees, brush, undergrowth and other obstructions.
And the Landowner, his heirs and assigns, does covenant with the City, its successors and
assigns, that it is the Landowner of the premises aforesaid and has good right to grant and convey
the easement herein to the City.
