The conditions consisted of site improvements such as constructing a bituminous parking lot, landscaping, erosion control, grading, and cleaning out Pond No. CP-8. It is my understanding that some of these items have been completed. In a court case, the City of Eagan reached a settlement with W. Hardman to drop the case if he paid a $200.00 fine. We, therefore, will not require the current or future owners of this property to comply with these conditions. This fine was paid on November 13, 1992. New building additions will be subject to the landscaping requirements of the City Code. A remodeling permit was recently issued to Overhead Door Company for this building. A final inspection will be required, but a Certificate of Occupancy will not be issued due to the limited scope of construction. A Certificate of Occupancy is not required for occupancy of this property. JOHNSON INVESTMENT COMPANY -- IMPROVEMENT PROJECT 11247 THIS AGREEMENT, dated this ? day of February, 1982, between the CITY OF EAGAN, Dakota County, Minnesota, called City, and R. L. JOHNSON INVESTMENT COM- PANY, INC. and R. L. JOHNSON, individually, called Johnson; WHEREAS, R. L. Johnson Investment Company and R. L. Johnson had agreed with the City of Eagan to install certain street improvements to Alexander Road ac- cording to agreement between the City and Johnson dated June 26, 1978, and in addition thereto, a performance bond was submitted by Johnson to the City dated June 26, 1978; and WHEREAS, subsequent hereto and on June 28, 1978, Johnson petitioned the City to install said improvements by letter dated June 28, 1978; and WHEREAS, the City of Eagan has now installed said improvements under Improve- ment Project 11247 and has prepared an assessment roll in anticipation of assess- ing benefited land adjacent to said Alexander Road consisting of lots in R. L. Johnson 1st Addition and Eagan 13 Industrial Park; NOW, THEREFORE, for and in consideration of the mutual covenants herein con- tained, the parties agree as follows: 1. The City hereby agrees to assess Lot 1, Block 1, and Lot 1, Block 2, R. L. Johnson lst Addition, and Lots 1 and 2, Block 1, Eagan 13 Industrial Park, for all assessments relating to the Alexander Road Improvement Project #247 con- sisting of a total of $184,988.19 as follows: $10,799.08 per acre for each of the above described lots abutting on and adjacent to Alexander Road. 2. In the event that the owner or developer oClots,l or•2, Block 1,'; Sibley Terminal Industrial Park, applies for and acquires a building permit from the City of Eagan to construct a building substantially located on the northerly 228 feet of Lot 2, Block 1, Sibley Terminal Industrial Park at any time within ten (10) years from the date of the execution of this Agreement, then the City of Eagan agrees to assess either of said lots where such building permit is granted for street improvements to Alexander Road, provided, however, that the principal access to any such proposed building is from Alexander Road to the south. Such assessments shall be levied at the rate of $67.21 per front foot of frontage that each of said lots abuts on Alexander Road and is benefited thereby plus interest at the rate of eight (8%) percent per annum from the date of this Agreement with interest for the last year of said term to be prorated. The 10 amounts of said payments, including interest, less a ten (10%) percent service charge paid to the City of Eagan for. the assessment costs and all other neces- sarily related costs of said assessment shall be reimbursed to R. L. Johnson Investment Company or R. L. Johnson or its successors or assigns as designated by R. L. Johnson Investment Company and R. L. Johnson within sixty (60) days after receipt of payment of said assessment installment on an annual basis until all of said installments have been paid for such improvements and reimbursed to R. L. Johnson Investment Company, R. L. Johnson of their successors or assigns. 3. It is understood, however, that in the event that the City is unable or precluded from levying assessments by state or federal law including judi- cial interpretation of such laws against Lots 1 or 2, Block 1, Sibley Terminal Industrial Park, at the time of the granting of such building permits or in the event that such owners or developers of said lots successfully challenge any special assessments by reason of state or federal law including judicial interpretation of such laws levied against such lots, then the City shall not be required to reimburse Johnson for any of the improvements assessed for Alexander Road as described above. It is understood that this paragraph con- templates the construction of buildings on the north of Lots 1 and/or Lot 2, Block 1, Sibley Terminal Industrial Park, and not on the higher ground at the south end of Lot 1 and/or Lot 2, each of which southerly locations has access to Terminal Drive. 4. It is understood and agreed that R. L. Johnson Investment Company and R. L. Johnson and any or all unknown owners of Lot 1, Block 1, and Lot 1, Block 2, R. L. Johnson 1st Addition, and Lots 1 and 2, Block 1, Eagan 13 Industrial Park hereby waive any and all objections to the proposed assessments for Alexander Road and shall waive any and all right to appeal said assessments against such streets. 5. On May 30, 1991, the City issued a temporary Certificate of Occupancy subject to the conditions agreed to by Mr. Hartman. The various conditions required were to be completed within 90 days of the issuance of the temporary Certificate of Occupancy. On November 13, 1991, Jim Sturm, Planner for the City of Eagan, sent a letter to Mr. Hartman noting that Mr. Hartman had not complied with various conditions of the Certificate of Occupancy. Those conditions included: (1) installation of the driveway, parking lot, and storm sewer per approved plans and specifications; (2) use of erosion control fabric and hay bales to stop soil erosion of zoned property in the adjacent lot to the south, Lot 3, Block 2, Sibley Terminal Industrial Park; (3) construction and maintenance of a sediment trap until the area had been seeded and vegetation established; and, (4) submission of a landscape plan for City review and approval. Mr. Hartman responded to these complaints in a November 15, 1991 letter. Michael Foertsch, Assistant City Engineer, discovered that as of March 5, 1992, the following requirements of the temporary Certificate of Occupancy had not yet been accomplished and remain uncompleted: 1. Construct a parking lot with a minimum of 611 Class V (100% crushed) aggregate base and 31, of bituminous surfacing. 2. Entire site must be graded in accordance with the building permit plan including the construction of an earthen berm along the west side of the building. 3. The installation and maintenance of appropriate sedimentation and erosion control measures in accordance with the cities current Soil Erosion Control Manual. 4. After the completion of the grading, all disturbed areas outside of the parking lot and driveway shall be restored with the minimum of 411 of topsoil and seeded with mulch in accordance with the City's Erosion Control Manual. 5. Also enclosed is a boundary survey which was specifically prepared covering the 3195 Terminal Drive property and sets forth the full legal description of that tract. As you can see, these two properties primarily lie in the southeast quarter of the northeast quarter of Section 8 although small portions of each parcel occupy a part of the adjoining quarter quarters to the east and south. We are interested in obtaining more information on the location and amount of filling which may have occurred in the past on either the Safety Kleen site or the 3195 Terminal Drive site. We believe that any filling which may have occurred involved only, or primarily, the Safety Kleen site. However, in order to clarify our understanding of how the grades have changed in this area, I thought topographical maps available from the city would be helpful in showing the grades on both sites both Mr. Tom Colbert January 21, 1993 Page 2 before and after any filling occurred. We believe any filling which did occur happened within approximately the last five to seven years. I would appreciate it if you would check to see what the availability and cost of before and after topographical maps covering these two sites is. AS we anticipated, Mr. Hartman did not appear and Mr. Rogosheske informed the court that Mr. Hartman is no longer in the State. We resolved the cases as follows: Judge Richard Hopper issued a bench warrant which is stayed until November 16, 1992. Mr. Hartman is to pay $200.00 to District Court by November 16, 1992. This sum will later be dispersed to the City of Eagan. If Mr. Hartman pays the $200.00 by that date, the bench warrant will be quashed and these two cases against Mr. Hartman will be dismissed. If he does not pay by November 16, 1992, the bench warrant will issue and we will wait for Mr. Hartman to come back into the State of Minnesota and attempt to pursue a higher fine for his noncompliance. I believe this resolution accomplishes the most the City could hope for with Mr. Hartman not being in the State. As he no longer owns the property, Mr. Hartman cannot make the corrections necessary.
