1. This case affects three parcels of land situated in the
City of Eagan, Dakota County, Minnesota, described as follows:
Lot Two (2), Block Two (2), in Sibley Terminal Industrial
Park, according to the plat thereof now on file and of
record in the office of the Registrar of Titles within and
for said County and State
Parcel No. 10-68050-020-02CI
Subject to an assessment of $33,123.34 for lateral storm
sewer
Hereinafter ("The Holman Parcel")
and
Lot One (1), Block Two (2), Sibley Terminal Industrial Park,
except that part lying southeasterly of a line which lies

2. Respondent City of Eagan adopted a special assessment of
June 4, 1991 relating to City of Eagan Improvement Project No.
578 affecting the following described area:
Lots 1 through 5, Block 1, and Lots 1 and 2, Block 2, Sibley
Terminal Industrial Park. ("Project Area")
3. The Holman Parcel, The Corner Lot and The Lahr Parcel
are all within an area designated for industrial uses. The
Holman Parcel and The Lahr Parcel are presently used for
industrial uses. The Corner Lot is undeveloped.
4. All parcels of the Project Area are within the same
drainage district established by the City of Eagan.
5. The Holman, Corner and Lahr parcels had not previously
been assessed for a lateral storm sewer project.
6. The fair market value of The Holman Parcel, parcel no.
10-68050-020-02CI and the Corner Lot, parcel no. 10-68050-010-
02CI combined prior to the City of Eagan Improvement Project No.
578 was $294,400.00.
7. The fair market value of The Holman Parcel, parcel no.
10-68050-020-02CI and the. Corner Lot, parcel no. 10-68050-010-
02CI after completion of City of Eagan Improvement Project No.
578 was $325,000.00.
8. The fair market value of The Lahr Parcel, parcel no. 10-
68050-011-02CI prior to completion of City of Eagan Improvement
Project No. 578 was $97,465.00.
9. The fair market value of The Lahr Parcel, parcel no. 10-
68050-011-02CI after completion of the City of Eagan Improvement
Project No. 578 was $108,000.00.
10. The fair market value of the Holman Parcel, The Corner
Lot and The Lahr Parcel increased as a result of the City of
Eagan Improvement Project No. 578.
11. The special benefit to The Holman Parcel and The Corner
Lot was $5,457.00 per acre. The special benefit to the Lahr
Parcel was $5,164.00 per acre.
12. The Appellant claims costs and disbursements under
M.S. 429.081 for expert witness fee of $2,000, plus other
disbursements (see counsel's affidavit) in the amount of
$427.85, all of which are fair and reasonable for the prosecution
of this appeal.
CONCLUSIONS OF LAW
1. The assessment formula adopted by the City of Eagan was
adopted pursuant to Minnesota Statutes Chapter 429 and was not
arbitrary and capricious.
2. The completion of the City of Eagan Improvement Project
No. 578 did increase the fair market value of The Holman Parcel,
The Corner Lot and The Lahr Parcel.
3. The maximum special benefit to The Holman Parcel and The
Corner Lot when put to their highest and best use is $5,457.00
per acre.
4. The maximum special benefit to The Lahr Parcel when put
to its highest and best use is $5,164.00 per acre.
5. The City of Eagan shall reallocate the special
assessment at the rate of $5,457.00 per acre for Holman and
corner lot parcels, and $5,164.00 for Lahr Parcel with the
resulting special assessments as follows:
The Holman Parcel $19,864.00

6. The Appellants have prevailed on their appealed special
assessment, are entitled to recover their costs and the

3. The properties of Appellant have not been benefitted to
the extent of the cost of the special assessment affecting each
parcel; the special assessment is unfair and unreasonable.
4. A portion of the special assessment represents costs not
related to the improvement of Appellant's properties.
5. The manner in which the special assessment has been
apportioned among the properties, at the uniform rate of $9,099.82
per acre is unfair and unreasonable.
6. The special assessment is unfair and unreasonable and
contrary to the requirements of Minnesota Statutes Chapter 429, due
process and equal protection of law under the Fourteenth Amendment
of the Constitution of the United States and Section 7 of Article
I and Section 1 of Article X of the Constitution of the State.of
Minnesota.

present this objection to the entire Eagan City Council at its
meeting on June 4,x.,1991.
My clients have raised several technical and financial objections
to the project and reiterate those objections as it relates to the
adoption of the special assessment now being considered. These
objections have been expressed to the Eagan City Council and to the
City's engineers and to the City's Attorneys. In general the scope
of this project far exceeded the type of project necessary to
appropriately benefit my clients' properties.
Most importantly the project cost proposed to be assessed to my
clients far exceeds the increase in value to their properties
attributable to this project. A uniform rate of assessment of
$9,099.82 per acre is wholly inappropriate in this case. Part of
the project cost should be paid from general funds and a rate of
assessment reflecting the.benefit to the affected property should
be developed.
While this project might substantially benefit some properties in
the drainage and assessment area, it does not obviously benefit my
clients' properties. This project only burdens my clients with an
increased special assessment in the amounts set forth above. Some
entities, such as the Metropolitan Waste Control Commission, whose
trunk sewer line will be protected from future erosion are not

expected to pay any cost of this project yet they will receive a
substantial benefit. In addition one other property owner received
a direct benefit when erosion problems were corrected.
It appears that such a large project was required because other
land owners and developers in the area have recently altered
surface water flows and drainage patterns. A storm sewer, which
has provided adequate drainage for my clients' properties for many
years, was simply abandoned rather than being integrated into the
project in a logical and cost effective manner.
The maintenance of the existing storm sewer which was abandoned
should appropriately have been paid from general funds of the city
of Eagan. This storm sewer which was installed in approximately
1970 was part of a special assessment against my clients'
properties at that time. In 1971 my clients paid approximately
$7,000 as a special assessment for improvements including a storm
sewer system.
While this new system is designed to handle "maximum density of
development" for the drainage and assessment area it is important
to recognize that the density of development of my clients property
has remained essentially unchanged since the early 1970's. Unless
my clients are priced out of this property by increased special
assessments and other taxes it is highly unlikely that the density
of development of this property will change in the foreseeable
future.
As you know, my clients strenuously objected to the aspect of the
project which required easements across both of their lots.
Despite their objection to the construction of the extension and
two storm sewer intakes at either side of the driveway into the
Holman Erection property, HECO Company was willing to grant the
City of Eagan the easements requested on June 25, 1990. My clients
only agreed to this based on the indication that this part of the
project would be constructed in the street if the easements are not
granted. The City of Eagan and its engineers refused to eliminate
this unwanted and unnecessary aspect of this project.
The design of the project has impaired my clients use of its drive
access. The intakes into storm sewer system are poorly located
and do not serve any purpose. Water drains from the Holman
Erection lot into the street through the center of the drive and is
not entering the storm sewer system.
The greatest portion of this project affects a general benefit to
the City of Eagan and the MWCC notwithstanding the incidental
benefits to each property. A substantial erosion problem has been
corrected and the life of a holding pond which was filling with
sediment has been substantially extended. obviously the primary

purpose of this project was not to affect the properties within the
local area.
Significant and costly aspects of this project related to
maintenance and repair of the storm sewer system originally
installed in the early 1970's. The properties already had an
adequate surface water drainage system and should not be assessed
the costs of the repairs. Many other municipalities recognize that
the reconstruction of standard improvements should be financed
through general revenues of the city. In this case a substantial
portion of the cost of the project should be financed from general
revenues and only those properties receiving a new benefit should
be included in the area affected by the special assessment.
The properties owned by HECO Company are clearly not within the
area receiving any kind of new benefit and should not be included
in the special assessment area.
Please note that this letter is intended to preserve the right to
appeal the amount of any assessment.

1970 was part of a special assessment against my clients'
properties at that time. In 1971 my clients paid approximately
$7,000 as a special assessment for improvements including a storm
sewer system.
While this new system is designed to handle "maximum density of
development" for the drainage and assessment area it is important
to recognize that the density of development of my clients property
has remained essentially unchanged since the early 1970's. Unless
my clients are priced out of this property by increased special
assessments and other taxes it is highly unlikely that the density
of development of this property will change in the foreseeable
future.
As you know, my clients strenuously objected to the aspect of the
project which required easements across both of their lots.
Despite their objection to the construction of the extension and
two storm sewer intakes at either side of the driveway into the
Holman Erection property, HECO Company was willing to grant the
City of Eagan the easements requested on June 25, 1990. My clients
only agreed to this based on the indication that this part of the
project would be constructed in the street if the easements are not
granted. The City of Eagan and its engineers refused to eliminate
this unwanted and unnecessary aspect of this project.
The design of the project has impaired my clients use of its drive
access. The intakes into storm sewer system are poorly located
and do not serve any purpose. Water drains from the Holman
Erection lot into the street through the center of the drive and is
not entering the storm sewer system.
The greatest portion of this project affects a general benefit to
the City of Eagan and the MWCC notwithstanding the incidental
benefits to each property. A substantial erosion problem has been
corrected and the life of a holding pond which was filling with
sediment has been substantially extended. Obviously the primary

purpose of this project was not to affect the properties within the
local area.
Significant and costly aspects of this project related to
maintenance and repair of the storm sewer system originally
installed in the early 1970'x. The properties already had an
adequate surface water drainage system and should not be assessed
the costs of the repairs. Many other municipalities recognize that
the reconstruction of standard improvements should be financed
through general revenues of the city. in this case a substantial
portion of the cost of the project should be financed from general
revenues and only those properties receiving a new benefit should
be included in the area affected by the special assessment.
The properties owned by HECO Company are clearly not within the
area receiving any kind of new benefit and should not be included
in the special assessment area.
Please note that this letter is intended to preserve the right to
appeal the amount of any assessment.

The following Agreement is entered into this inth day
of October , 1990, by and between HECO COMPANY, a Minnesota
corporation, herein referred to as "Landowner", and the CITY OF
EAGAN, a Minnesota municipal corporation, herein referred to as
"City".
WHEREAS, the City is in the process of constructing drainage and
utility easements under Eagan City Project No. 578; and
WHEREAS, Landowner is the owner of Lots l and 2, Block 2, Sibley
Terminal Industrial Park ("Premises"); and
WHEREAS, the City requires easements over a portion of the
Premises, said easement being set forth on the attached Exhibit "A".
NOW THEREFORE, for good and valuable consideration, the receipt
and sufficiency of which is hereby acknowledged, Landowner and City
hereby agree as follows:
1. Landowner agrees to grant the easements attached as Exhibit
"A".
2. City agrees to pay to Landowner the sum of Two Thousand and
no/100 Dollars ($2,000.00).
3. City's contractor is prohibited from interrupting access to
the Premises during any regular work week. Construction of the storm
sewer crossing the driveway to the Premises must be completed during
a weekend unless prior approval is given in writing by Landowner.
Access shall be restored prior to the beginning of the regular work
week and the driveway must be restored to its original condition as
soon as practicable.
