Dear Mr. Connor:
I sent you on November lst a 2etter together with a proposed Agreement between
Northern uatural Gas Company and the City of Eagan regarding the James Sarker and
Richard Sherer properties in the City of Eagan.
Since that time, Tom Colbert, Eagan City Public Works Director, has reviewed the
Agreement and has made two additional suggestions that should be included in the
Agreement as follows:
1. "In the event that the City of Eagan must repair its sanitary sewer
trunk that is in place and ad3acent to the location of the propbsed Northern Natural
Gas main running across the Sherer property, that Northern shall be responsi6le for
the protection of Northern's proposed gas main lying adjaeent thereto and shall be
solely responsible for the costs of such prote~tion that may be occasioned by the
necessary and reasonable maintenance of Eagan`s sanitary sewer trunk by Eagan."
2. Paragraph 1 of the Agreement should be amended by as follows:
"Eagan hereby grants to Northern the right to instell a 16 inch natural
gas main adjacent to and within the easement acquired by the City of Eagan from, over
and through the Richard Sherer property described on Exhibit "B" including the.right
to maintain and repair such gas main that location, however, such gas main shall be
located no closer than 10 feet from the outside diameter of the Eagan sanitary sewer
trunk lying across and through such property."

2. It will be recommended as to Mr. and Mrs. James M.
Barker, Parcel No. 10-02800-010-83: That the lateral benefit
from trunk sanitary sewer, the water main lateral and the storm
sewer lateral assessments be canceled with the understanding
that the assessments against the property will be assessed at
the then existing rate for each purpose as soon as the Barkers
or their assigns shall acquire a change in zoning of the property,
request additional building permits for the property, convert the
use of the property to another purpose or subdivide the land;
provided, however, that the limitation upon building contained
herein shall not prohibit the Barkers, or their assigns from
building additions or improvements to the present residential
structure or from building or improving separate structures,
(such as garage or utility structures), which do not change
the single-family residential character of the property.
I am assuming that the added language above will present
no problem to you since it was language which was earlier
agreed to us in connection with the environmental litigation.
The Barkers'and Smiths' appeals will be dismissed upon the
favorable action of the City Council approving the staff
recommendations. If the City Council does not plan on meeting
until after the court hearing dates are scheduled, 2 would "
have no disagreement with the continuance of the hearings.
One final note, both the Smiths and the Barkers received
property tax statements which appear to contain figures
representing the canceled assessments. I think that it would
be a good idea if you were to ask the Dakota County Treasurer
to reissue property tax statements less the canceled assessment.

The Eagan City Council on March 17 did approve the texms for dismissal of the
assessment appeals both by Mr. and Mrs. James Barker and Mr. and Mrs. Richard
Smith in the Dakota County District Court. I have-arranged for signature of the
two original letters that you sent me and have retained the originals, forwarding
the fully signed copies of the originals to you for your files. In addition, I
am enclosing a Stipulation of Dismissal and would ask that you execute and
return the original and a fully signed copy of each to me. I will then file the
originals with the Clerk of District Court.
I am also sending a copy of the letter to Tom Colbert, the Eagan Public Works
Director, and would ask that he instruct the Assessment Clerk to mark the
as&essment cards to comply with [he cancellation of the assessments. A copy of
the letter should be held in each of the parcel files and in ~dition the Dakota

Dear Mr. Hauge;
I have received your Eebruary 24, 1981, correspondence and
have had the opportunity to review it with the Barkers and the
Smiths. They agree with the contents of your proposal, however,
both couples requested that, consistent with our original agree-
ment, we include a provision similar to the one which we agreed
to in.my March 29, 1979, correspondence. I have redrafted the
substance of the agreement and have included it in this letter
as paragraphs numbered 1 and 2 below.
1. The staff will recommend to the City Council the following

APPLICATION SUMMARY: An application has been submitted by James M. Barker of
4550 Thomas Lake Road requesting an Interim Use Permit to allow the keeping of a horse,
or horses, in an R-1 (Single Family) district
BACKGROUND: In eazly-February 1992, Mr. Barker contacted City staff regarding having
horses on his property. City Code, Section 10.12, Animals and Foul-Keeping, Transporting,
Treatment, and Housing, Subd. #~-Keeping, states "It is unlawful for any person to keep
or harbor any animal, not in transit, except 1) "farm anunals kept in that portion of the
City's zoned Agricultural and containing not less than five acres. Horses are considered
farm animals by Eagan City Code. Mr. Bazker's property is 5.19 acres.
In a February 7, 1992 letter, Mr. Barker requested that the City Council approve the
continued use of the property as a single family residential hobby farm and by his heirs and
assigns. His request was to keep horses for purely recreational use. Mr. Barker has no
plans for subdivision or other use of the property. At the February 18, 1992 City Council .
meeting, his request was heard. After discussion, the Council made motion to direct the
Advisory Planning Commission to hold a public hearing regarding this matter under the
Interim Use permit process.
The current animal holding azea on the property is located along the far west edge of the
property adjacent to Thomas Lake Road. There is an existing bam on the property which
has five horse stalls. The east property line extends into Thomas Lake. If he should decide
to sell his property, he would like to be able to sell it as a"hobby farm". Staff recommends
a 10-year term for the Interim Use Permit which by Code, is reviewed annually.

This property was assessed in 1980 when Thomas Lake Road was assessed The assessments
were appealed and agreements were entered into wttich stated generally that the assessments
would be defered until such time as the owner or assigns should acquire a change in wning,
request for additional building permit for the pmperty; convert the use of the property w
another purpose or subdivide.
A strict interpretation of the terms of the agreements executed to dismiss the assessment
appeals would cause the following charges to be proposed as a condition for the issuance of
the interim use permit. The charges and improvements are:

The use of the property as a hobby farm will not create additional impact on the City's utility
system as the property is not connected to the utility system, and would not be connected as
a result of ttus interim use permit. As a consequence, it might be appropriate to acknowledge
the previous agreements and continue We deferment until one of the condidons therein is more
cleazly met. The propert~s driveway access is onto Thomas Lake Road.
If approved, this Interim Use Permit shall be subject to the following conditions:
1. This permit shall eaLpire 10 years after the date of approval.
2. The permit holder shall prevent any surface water runoff from animal holding
areas on the premises from reaching either Thomas Lake or the City~s storm sewer
system. -
3. This permit shall be reviewed annually.
4. A limit of five horses.
