completed the proceedings of vacation of certain street easements lying over and
across the following.described property located in TWIN VIEW MANOR ADDITION:

Upon motion by Egan, seconded by Smith, all voting in favor except
Parranto who abstained, item 12 of the Consent Agenda was approved. Upon
motion of Wachter, seconded Smith, all members voting in favor, the balance of
the Consent Agenda items were approved as recommended by staff.
VACATION OF RICHARD LANE END BRIE'S BOULEVARD
Mayor Bea Blomquist convened the public hearing regarding the petition to
vacate a portion of Richard Lane and Erik's Boulevard in Twin View Manor
Addition. Several property owners were present but there were no objections
to the vacation proceedings. Tom Colbert explained the proposal and Smith
moved, Parranto seconded the motion to close the hearing, to approve the
vacation of the streets as designated in the Petition and that the Mayor and
Clerk be authorized to execute the appropriate Resolution. All voted yes.

MICHAEL GRASSER - I.R. FINANCING
The next public hearing convened by the Mayor concerned the application
of Mr. and Mrs. Michael Gresser for industrial revenue financing in the amount
of $1,620,000 to acquire and improve property on Lot 11, Block 1, Sibley
Terminal Industrial Park. The industrial revenue financing would include a
two-phase project covering new construction of an industrial building and
remodeling of an existing building that Gresser, Inc. would move from its
present location at 1971 Seneca Road to the new location at the intersection
of Yankee Doodle Road and Terminal Drive. Mr. Hedges reviewed the proposal
and explained that the plans for waiver of plat had been reviewed by the City
Council at a special meeting. Mr. Colt of Juran and Moody was present and
answered questions on behalf of the applicant. It was further explained that
land was not included in the industrial revenue financing. Parranto moved to
close the hearing and to grant preliminary approval of the application cover-
ing $1,620,000 with the understanding that the land and building acquisition
will be eliminated from the final approval, further, subject to compliance
with all City and State industrial revenue financing requirements. Egan
seconded the motion and all voted in favor.
JEFFREI R. BLOOM - VAIVER OF PLAT
The application of Jeffrey R. Bloom for waiver of plat in order to split
Lot 10, Block 3, Clearview Addition was, upon motion by Smith, seconded
Parranto, continued to the next regular meeting at the request of the appli-
cant. All voted in favor.

Drainage concerns & Final Landscaping
Dear Mr. & Mrs. Musser:
On July 31 of this year, you sent a letter to the City of Eagan
expressing concerns regarding the erosion problems you have
encountered on your property during various rainfall events this
year. The most recent problem was associated with the heavy
rainfall on July 28. You felt this problem was caused by
inadequate upstream drainage facilities in the vicinity of Delores
and Richards Lane in the Twin View Manor east of your property.
After reviewing the pictures you submitted and evaluating the
situation onsite, it is evident that the erosion resulted from the
lack of adequate vegetation being established in your rear yard
area. It was also explained to you that your particular property
is situated in a location where upstream overland drainage is to
be expected. However,. you have indicated that you feel the
upstream storm sewer system in Richards Lane at the intersection
of Delores Lane is inadequate due to the fact that it was not able
to handle all the surface water runoff associated with the storm
of July 28.
The city's storm sewer system is designed to handle a rainfall
intensity of 1.8" in 1 hour or 3.6" over 24 hours. This is a
typical design standard for developing communities. The rainfall
event of July 28 significantly exceeded this rainfall intensity
where 2"-4" of rainfall occurred in less than 1 hour.
Subsequently, excessive surface water runoff is conveyed by
overland drainage.

In performing the final landscaping improvements to your property,
recognition of this overland drainage must be taken into
consideration to divert this surface water runoff away from your
house to the side lot lines and out to the front street. I have
reviewed with you onsite how this diversionary grading could be
accomplished as a part of your final landscaping.
As you are aware, the City performed a simulation whereby we tried
to maximize the amount of runoff on Delores and Richards Lane to
evaluate the adequacy of the existing storm sewer inlet catch basin
facility. After reviewing the storm sewer design, it was
determined that the existing storm sewer facility does have excess
capacity to accommodate additional catch basin inlet facilities on
Richards Lane. The City of Eagan will be pursuing this drainage
improvement to the upstream drainage basin to minimize the volume
of water that would be expected to flow across your rear property.
I believe that between the proposed storm sewer improvements by the
City and proper final landscaping of your property, you should not
anticipate similar future problems as experienced in the past.
In checking the progress of your landscaping improvements, it has
been noticed that additional retaining wall structures being built
to divert this flow to the north of your property have encroached
on the 10' public drainage and utility easement along your north
property line and encroached on to your neighbor's property. While
the installation of this retaining wall structure will not impede
the functional operation of the storm sewer and water main
facilities within this easement, it could possibly impede our
ability to perform any corrective maintenance to these facilities.
You should be aware that the City does not permit the installation
of permanent structures within utility easements due to the
inherent costs associated with their reconstruction should future
maintenance activities be required. Therefore, this retaining wall
should be removed from the public dedicated utility easement unless
you recognize that the City will not be responsible for replacement
if it has to be removed for corrective maintenance requirements.
It is highly unlikely that the situation would ever arise.
However, the situation should be addressed at this time so that you
can make the appropriate decision.
Also, you should be aware that construction of this retaining wall
on your neighbor's property and its resultant diversion of surface
water runoff could create a property right dispute between you and.
your neighbor. I would encourage you to get a written letter of
understanding between you and your neighbor to avoid a future
conflict.

It is unfortunate that you encountered the problems you have during
this past year's rainfall season. However, prompt completion of
your final landscaping improvements should eliminate these issues
in the future. Please feel free to contact the City's Engineering
Division if you would like technical assistance in helping to
design your final landscaping and drainage improvements.
