Re: Utility Easement Use Restrictions
Dear Mr. Kilgarrif£
I appreciated the opportunity to discuss with you further some of the additional
questions and concerns that you have regarding various development related
restrictions associated with the current drainage and/or utility easements dedicated
on your property.
When your legal description was created through the subdivision and platting
process, drainage and/or utility easements were dedicated to the public as shown
on the plat maps and further documented by subsequent Certificate of Surveys
submitted for the issuance of your structure building permit and pool permit.
These public easements (and street rights-of-way) are reserved for public agencies
and utility companies for purposes necessary to serve the greater community (i.e.,
sanitary sewer, telephone, cable, electric, storm drainage, etc.). The underlying
property owner retains ownership rights to the property and, as such, can use that
property for private purposes so long as the private use is not detrimental to the
purpose for which the easement was originally dedicated.
Due to the variety of uses that these public easements are reserved for, there are
varying restrictions associated with each facility. For example, a drainage
easement that is dedicated to preserve a designated flowage route cannot have any
improvement installed that would restrict or inhibit the flow of water through that
easement area. The existing ground elevations cannot be lowered over
watermains that would place them in a frost depth zone. Fill cannot be placed
within pending easements that would reduce the storage capacity for surface
water ponding requirements. For a buried sanitary sewer line, no improvement of
the property is allowed that would restrict or inhibit the ability of the City to
access that buried utility for maintenance and/or repair activities. This would
preclude the installation of structural footings, foundations, retaining walls, etc.
Fences with removable sections are permissible. Small and insignificant
landscaping is permitted, but it is done so at the property owner's risk of
disturbance for future maintenance or access requirements.
I am enclosing copies of informational handouts relating to the installation of
fences, construction of decks or accessory buildings, installation of swimming
pools and landscaping. These informational brochures all address the need to
identify and preserve the current conditions of the easement area with the
recommendation to contact the Engineering Division if there are any questions
regarding proposed development plans.
I hope this additional information helps to explain and clarify the limitations and
reservations of that portion of your property currently encumbered by public
drainage and/or utility easements. In summary, it is probably safest to presume
that no improvements can take place within these public easements until the
specific proposal has been reviewed by the Engineering Division, and a
determination can be made that the specific proposal would not be detrimental to
the original purpose of the easement dedication. Again, please feel free to contact
me if you have more questions regarding this or other development related
matters.

Dear Mr. Hinners
On September 17, 2001 you called and left a message that park signs at 1504 Thomas
Lane were incorrectly located. I have since coordinated this with our City Engineering
Department and the following is their comments on the issue.
"Upon further review, it appears that the park signs at 1504 Thomas Lane (Lot 2, Block
4, Pinetree Pass 2'e Addition) have been placed on the drainage and utility easement
boundary rather than the actual park boundary. As an indicator of the park property, it
would be most appropriate that the sign be located on the boundary line." Therefore,
where it is demonstrated that park boundary signs are incorrectly located, your
surveyor has permission to relocate signs to the actual park boundary line.
As you are aware, the drainage and utility easement at this location is critical for the
necessary storage of storm water. No grading or altering of the drainage easement will be
permitted. Deep rooted, slope-reinforcing vegetation must remain established within the
easement to prevent erosion. The relocation of these signs is not a green light to
expansion of residential landscape projects on this very steep slope. Slope failure could
put both property and lives at risk. Please inform the homeowners of our concern and to
call if they have any questions.

Dear Mr. Henner:
I am writing in regards to the letter I sent you previously dated July 19, 2001,
about a grading concern on Lot 2, Block 4, Pine Tree Pass 2nd Addition. Under
the development agreement, the grading was to have conformed with the City
reviewed grading plan for the development. An as-built topographic survey of
Lot 2 indicated the slopes were not constructed to meet the City reviewed grading
plan's 3:1 maximum grade in this area.
In that letter I had stated the importance of the development's grading complying
with the grading plan and development agreement. I also stated the need to
correct the grading on Lot 2 by October 1, 2001. Today I visited the site and
found that no grading has been completed by Lundgren Brothers in the area that
the letter addressed. I did notice, however, that the property owner at 1504
Thomas Lane has apparently had some grading completed on Lot 2 outside of the
drainage and utility easement. More specifically, a swimming pool has been
constructed as well as a field stone retaining wall.
The grading completed to accommodate the swimming pool has complicated the
earlier request that Lundgren Bros., Inc. meet the originally reviewed grading plan
requirements. Based on the as-built survey taken of the lot, the construction of a
3:1 grade on Lot 2 between the newly constructed retaining wall and the City park
property would be impossible without impacting the park property or the retaining
wall. Either filling would have to occur within the park property, which is not
acceptable, or undercutting or removal of the soil at the base of the wall, which
may compromise the structural integrity of the wall, and, possibly, the pool.
The City of Eagan cannot, in good conscience, require a developer to correct a
breach of contract that has been convoluted by another property owner's actions
without that property owner's assistance. The owners of 1504 Thomas Lane are
being sent a copy of this letter as acknowledgement of their involvement in this
resolution process. If said owners do not choose to participate in the resolution of
this concern by October 12, 2001, the City will review the area in question with
Lundgren Bros., Inc. to determine the sufficiency of the slope stabilization.

Dear Mr. Henner:
The City of Eagan has become aware of a grading concern on Lot 2, Block 4, Pine
Tree Pass 2nd Addition. Under the development agreement, the grading was to
have conformed with the submitted grading plan for the development. The City
reviewed grading plan indicated the slopes were to meet the City's requirement of
a 3:1 grade. According to an asbuilt topographic survey of Lot 2, the 3:1
maximum grade does not appear to have been constructed.
It is important that the grading for your development complies with the grading
plan and development agreement. A portion of the area of concern is within
dedicated parkland, adding to the significance of the need to correct the grading.
Due to the current temperatures and anticipated weather conditions, it is
recommended that the regrading and establishment of vegetation be scheduled for
the middle of September. Dormant seeding of the native prairie grasses and forbs
should not occur until after September 15. It is preferable to limit the exposure of
an unprotected graded area, particularly adjacent to a water body, so the grading
should not occur until just prior to the time at which the seeding and erosion
protection (fiber blanket) installation is scheduled.
If these requirements are not met by October 1, 2001, the City will take
appropriate actions and meet the requirements at the expense of Lundgren Bros.,
Inc., by means of allocation of funds from the Letter of Credit for Pine Tree Pass
2nd Addition.
After the anticipated completion of the grading by Lundgren Bros., Lundgren
Bros. shall supply an asbuilt topographic survey to indicate the proper slope
requirements have been met.
