Re: Damaged City Water gate valve box - 3063 Timberwood L
Dear Mr. Bari,
Recently, you informed our Director of Public Works that there is a damaged utility valve
box located near the above address. On Friday April 20th, Len Bures stopped into our
Central Maintenance Facility to inquire about the status of its repair. Our Utility
Maintenance operations did a field investigation and discovered that the valve lid/cover is
missing and the adjustable valve box stem is broken. A rag was stuffed in the open valve
stem, apparently to prevent debris from getting inside.
As you are aware, the Timberwood Village Townhomes were platted and developed
privately by the original developer with all internal local streets and access driveways
dedicated to a collective homeowners association for perpetual ownership and
maintenance. City sewer and water utilities were also installed privately by the developer
but were located within public drainage and utility easements and conveyed to the City
for subsequent ownership and maintenance.
In the City's response to the notice of a missing valve cover last year (Sept. 26, 2006
letter), you were informed that it is the Association's responsibility to maintain the
private street surfacing (structural condition and elevation) to protect City utilities from
inadvertent damages that may result from your private maintenance operations, such as
plowing. Our recent field inspection also noted that throughout the development, the
Association's private streets have settled over the years exposing several other gate valve
structures to potential future damages. We strongly encourage your Association to have a
"skin patch" installed around each structure that currently sticks up above the street
surface.

In regards to the current damaged utility, it is the Association's responsibility to cover
any costs for its repair. I have enclosed an estimate if the work is performed by City
forces. If the Association prefers, we would be happy to put you in touch with a
contractor who does work for the City and could possibly do the work for less $$.
Because access to the water shut off valve is important to the integrity of the water utility
system, this repair work should be completed by July 1, 2007.
Since I don't have a contact name/address for your Association, I would appreciate it if
you could provide it to us as well. as forwarding this letter on to the appropriate
individual.

would be happy to provide any additional help that you may need.
