As owner of Carriage Hills Golf Course, I am requesting a waiver to eliminate the permit process
for a fill permit.
Westcott Woodlands road is to be upgraded in August of 1998. Extra fill will be necessary to
bring up the grade on # 2 fairway to prevent it from flooding. When the storm sewer is installed
the city will have approximately three to four thousand yards of fill to be used to bring the grade
up on # 2 fairway. This will not be sufficient to bring the grade up to the desired level. An
additional seven thousand yards would be a sufficient amount of fill to bring up the grade to the
desired level, which we need to access from a source other than the city.
The excess fill that is needed is available at this time.
A delay in granting this request when the fill is available would create a real hardship.

and erect a 40' x 96' x 16' high "Uni-Frame I Code" building for you. Your
building will be manufactured in strict adherance with the building codes of
The State of Minnesota and Dakota County having a 40 lb. snow load roof
system and a 80 M.P.H. wind load frame design. Following please find a
detailed materials listing, a price quotation, two 3-D construction
sketches, and an overhead construction detail.
Detailed Materials list:
1) 8" X 21" Poured concrete footings at base of columns, with re-bar
anchor sets at all column locations.
2) 4 Ply laminated columns of 2x6 and 2x8 #1 Southern Yellow Pine, being
finger-jointed to 2x6 and 2x8 treated SYP for embedment, and placed
at 8' on center as designated by the attached sketches.
3) A single band of 2x8 treated splashplank at base of building.
4) 2x6 #2 Southern Yellow Pine wall girts set into the offset column
configuration.
5) 2x6 #2 Southern yellow Pine roof purlins set in galvanized saddle
hangers within the trusses.
6) 40' Double ply roof trusses set at 8' on center, bearing directly on

Dear Mr. b Mrs. Skajewski:
You have asked whether the City of Eagan has any responsibility concerning the
claim that there have been golf balls that have been hit by golfers on the
Carriage Hills Golf Course, adjacent to the Orrin Thompson subdivision of
which you live, causing damage to the homes along the course. I have been in
touch with representatives of the Carriage Hills Golf Course and also have
talked with one of your neighbors concerning the damage that has been claimed
to have been caused by the golf balls breaking windows, etc.
We have not investigated the Complaints fully, nor have we reviewed the
technical responsibilities of the various parties, but it would appear on the
surface, that the City has no direct responsibility concerning the damage. To
the best of our knowledge, the builder has complied with the City setback
provisions in constructing the homes and had the City imposed greater setback
restrictions, it would perhaps expose itself to a claim of an improper taking,
causing potential damage to the developer for loss of land adjacent to the
golf course. You can also appreciate that this is not an uncommon setting for
residential homes to lay adjacent to golf courses, and in many cases, the
value of the homes has increased because of their lying in that type of
location.
I am sending a copy of this letter to Sill Smith, the owner of the Carriage
Hills Golf Course, and would strongly recommend that steps be taken in order
to avoid any future problems, including the potential for additional
screening, signing the tee-off position, warning golfers of the potential of
damage and possibly moving the tee to a different location to minimize future
problems. There may be other solutions that I am not aware of and would be
happy to work with the neighbors and with the operators of the golf course to
avoid such issues in the future.

In connection with Project 742, it was necessary for the City to acquire 21 separate easements
across the Carriage Hills Golf Course owned by the Rahn Family Limited Partnership. The
drainage and utility easements contain 114,723 square feet; right-of-way easements contain
4,148 square feet; and temporary construction easements of 153,351 square feet. We have been
in negotiations with the attorney for the Rahn Partnership concerning compensation for the
permanent easement acquisition and the temporary easements. The City originally offered $.65
per square foot and the Rahns requested approximately $1.50 per square foot. After further
discussion, the Rahns requested $1.15 per square foot ($153,762.00). The City then retained
Roger Rohrer to provide preliminary analysis of the land value for the golf course. Roger
indicated that the land had a value of $1.00 per square foot, but he did not determine whether
there were any severance damages or other damages associated with the easement acquisition.
The City then offered $.90 per square foot ($120,335.00) and the Rahns countered at $1.00 per
square foot ($133,706.10). Because the Rahn's offer is in line with the appraisal by Mr. Rohrer,
we believe this offer should be presented to the City Council in execution session for
consideration.

The grant of the foregoing permanent easement for drainage and utility purposes includes the
right of the City, its contractors, agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains: and the
further right to remove trees, brush, undergrowth and other obstructions. After completion of such
constriction, maintenance, repair or removal, the City shall restore the premises to the condition in

The grant of the foregoing permanent easement for right-of-way and utility purposes includes
the right of the City, its contractors, agents and servants to construct, reconstruct, inspect, repair and

and appurtenances and any signs erected in conjunction with the use of the roadway and appurtenances.
The grant of the foregoing temporary construction easement for site grading purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct and inspect site grading and the further right to remove trees, brush,
undergrowth and other obstructions. After completion of such construction, maintenance, repair or

corporation (hereinafter "City") (hereinafter collectively referred to as the "Parties").
WHEREAS, Landowner is the fee owner of property located in the City of Eagan,
County of Dakota, State of Minnesota and legally described as:
The East One-Half (El/2) of the Northwest Quarter (NW1/4) of Section 14,

WHEREAS, in connection with the creation of Parcel 010-01, a portion of the
assessments under the Project (and other charges) were allocated to Parcel 010-01. These
assessment and other charges include the following:

and has also requested that the City not immediately assess the full utility charges against Parcel
011-25 and Parcel 011-50. Instead, Landowner has requested and the City has agreed to defer
collection of certain utility charges until subdivision or development and all upon the terms and
conditions contained herein.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
the Parties do hereby agree as follows:
1. Assessments for Parcel 011-25.
A. Immediate Assessment. Parcel 011-25 shall be immediately assessed for
the following:

B. Treatment As Connection Charges. The City agrees that Parcel 011-25
shall not be immediately assessed the full sanitary sewer lateral charges,

charges (including any portion not assessed to Parcel 010-01 or not
collected under the Project) will be collected as connection charges and
paid (at the then prevailing rate) when Parcel 011-25 is subdivided, platted

Wensmann/ Carriage Hills Golf Course Sanitary Sewer Study
1. Wensmann Homes, Inc. ("Wensmann) has entered into a purchase agreement for the property
known as Carriage Hills Golf Course in Eagan, located east of Lexington Avenue and south
of Yankee Doodle Road.
2. Prior to development application to the City of Eagan ("City"), Wensmann has requested an
analysis of the capacities of the City's trunk sanitary sewer pipes serving the Carriage Hills
Golf Course and surrounding area be completed.
3. The City has contracted with the consulting firm of Bonestroo, Rosene, Anderlik, &
Associates ("BRAA") for the analysis of the trunk sanitary sewer system and will incur costs
as a result of this analysis.
4. BRAA has prepared a scope of work and cost estimate for analysis of the area trunk sanitary
sewer system. A copy of this scope is attached to this agreement.
5. The City requires that Wensmann establish an escrow account to reimburse the City for the
costs incurred in the analysis of the trunk sanitary sewer system, in the amount estimated with
the attached scope of work and costs not to exceed the estimate.
6. Wensmann reserves the right to terminate the preparation of the analysis of the trunk sanitary
sewer system. Such termination must be submitted in writing to the City Engineer. In such a
case, Wensmann will be responsible for only those costs actually incurred through, and
including, the termination date.

RE: Carriage Hills/Wensmann - Sewer Flow Analysis
Dear Mr. Gorder:
We are happy to submit a budget to review the likely changes in sewer flow rates with the
redevelopment of Carriage Hills golf course. The budget will cover the analysis of sewer flow
demands and evaluate the capacity of the City's existing system to handle the increased flow
rates. Details of the budget are described below.
We propose a Lump Sum budget of $8,200 for the analysis and evaluation. The final product
will be a letter report. Work tasks included in the report are detailed below. Work outside of the
original scope as outlined in this letter will be billed hourly using the previously approved
private developer rate schedule we currently have with the City.
The budget includes the following assumptions and tasks based on our discussion together on
12/11/2003:
The City will provide us with plan information on the sewer system in subdistrict C-00
between the existing club house and CSSP node C-00.1. A portion of the CSSP map is
attached for reference.
2. Three scenarios would be evaluated for issues, impacts and costs (at planning level detail) to
upgrade the trunk sewer system as needed. At this time the three (3) scenarios are as follows:
2.1. No sewer flow from subdistrict N-U to be routed north where existing sewer capacity
constraints exists. All flow would be directed into subdistrict C-00.
2.2. Allow the planned sewer flow (2000 CSSP) from subdistrict N-U to the north and route
the remainder of the flow southwest into subdistrict C-00.
2.3. Assume the trunk sewer system in the North Sewer District is improved as proposed in
the CSSP, and route flow north based on available capacity. The remainder of the sewer
flow would be directed southwest into subdistrict C-00.

We are assuming one meeting will be held with City staff and the developer to review the
preliminary results of the review and analysis.
