Dear Mr. Stricker:
The Mayor of Eagan has requested that I inform you on the Develop-
ment Procedures for the City of Eagan. It is my lka eZstallding._tbe parcel
under consideration is described as Lot 3 Block 3 Wescott Garden Lots)
According to Eagan's Zoning Ordinance the subject parcel is Agriculturally
Zoned, and the minimum lot size in an Agriculturally Zoned District is five
(5) acres. Since the subject parcel is ten (10) acres you would be able
to divide the parcel into two five (5) acre lots as long as each lot has
3301 feet of frontage on a public street.
Presently, the area you.wish to develop is not serviced by utilities
(Sanitary Sewer and Water) therefore, rezoning probably would not be
granted at this time. However, when utilities are economically feasible
to install for this area that would be the time rezoning would be granted
for a more dense type of development.

A 30 foot half right-of-way has presently been dedicated for the Wescott

existing Lot 3 of Block 3 by way of Trails End Road and Birch Street. With
the proposed split of Lot 3, it will be creating a lot that does not have

anticipated.
CONYIENTS FOR CONSIDERATION
The following oomients should be considered for the approval of this waiver

1. Sufficient right-of-way should be dedicated or obtained by the applicant
to provide for a minimxn 60 foot right-of-way to all newly created lots.
2. Applicant should petition for street inprovement project to provide an
irrProved street access for our newly created lots.

This agreement made this 4/_?,__ day of (5 KK- d/5 , 1990, by
and between the CITY OF EAGAN ("City"), a Minnesota municipal
corporation, and BRAD 'D.'. STRICKER, a single person, hereinafter
referred to as Landowner.
RECITALS
WHEREAS, the undersigned Landowner is the owner in fee of certain
real property located in the City of Eagan, County of Dakota, State
of Minnesota, and more particularly described on the attached Exhibit
A hereto.
WHEREAS, Birch Street is a dedicated right-of-way according to
Easement Document No. 369340 which document is on file and of record
with the Dakota County Recorder.
WHEREAS, said Birch Street in part abuts the property described
on the attached Exhibit A owned by the Landowner.
WHEREAS, said Birch Street has not been opened or improved by the
City and has not otherwise been opened to public vehicular traffic
for that portion of Birch Street described as follows:
That portion of Birch Street lying west of the
westerly right-of-way line of Sunwood Trail.
WHEREAS, the above-described portion of Birch Street that has not
been opened to public vehicular traffic and has not been improved by
the City is that portion which would otherwise serve as access to the
property described on the attached Exhibit A.
WHEREAS, the Landowner has requested that the City approve a
private driveway over the unimproved and unopened portion of Birch
Street.
WHEREAS, the City ordinance does require that a buildable lot
under the zoning code and subdivision codes of the City have frontage
along or abut a publicly dedicated and open roadway or, in the
alternative, have a private driveway approved by the City Council of
Eagan.
WHEREAS, the City of Eagan is willing to allow the Landowner to
use the unopened and unimproved portion of Birch Street for purposes
of a private driveway subject to the terms and conditions hereinafter
stated.
NOW, THEREFORE, THE CITY OF EAGAN AND THE UNDERSIGNED LANDOWNER,
FOR HIMSELF AND HIS SUCCESSORS, HEIRS AND ASSIGNS DO HEREBY AGREE:
1. Under the terms and conditions stated herein, the Landowner is
hereby authorized by the City to use the unopened and unimproved
portion of Birch Street previously described as a private driveway
for the limited purpose of providing access to the real property
described on the attached Exhibit A.
2. Nothing contained herein shall be deemed an opening or an
improvement by the City of the unopened and now unimproved portion of
Birch Street.
3. Nothing contained' herein shall be deemed an assumption by the
City of any responsibility for construction, maintenance or repair of
the unimproved and unopened portion of Birch Street to be used by the
Landowner as a private driveway.
4. Nothing herein contained shall be deemed a waiver or
abandonment or transfer of the right, title and interest that the
City of Eagan holds to Birch Street by reason of the dedication of
said Birch Street, including the unimproved and unopened portion
thereof.
5. The private driveway to be used by Landowner is subordinate to
the dedication of Birch Street to the City.
6. The Landowner shall be responsible for all costs relating to
construction, maintenance and repair, including grading and snow
removal with respect to use of the private driveway.
7. At his expense, the Landowner shall record with the Dakota
County Recorder a certified copy of this Agreement, within 30 days of
City Council approval of this Agreement.
8. No structures shall be placed on the private driveway.
9. The approval given herein by the City is contingent upon all
the conditions expressed herein being met and continuing to be met.
10. The private driveway shall not be used in a manner
inconsistent with the City's right, title and interest in the
dedicated portion of Birch Street, including the unimproved and
unopened portion thereof.
11. The Landowner does hereby agree that when the unopened or
unimproved portion of Birch Street is opened to the public or
otherwise improved by the City, then the private driveway as
contained within the unimproved and unopened portion of Birch Street
will be removed by the Landowner at no expense to the City, but at
the expense of the Landowner. The City will require that the driveway
from the street to the property line will be asphalted or concrete
paved at the time of the road improvement.
12. The Landowner agrees that if the unopened and unimproved
portion of Birch Street is improved and opened to public vehicular
traffic, and if special assessments are levied against the property
described on the attached Exhibit A pursuant to Chapter 429 of the
Minnesota Statutes, then the Landowner shall not object to the levy
of special assessments on the ground that the property described on
Exhibit A had existing access from Birch Street. The Landowner, for
himself, his heirs and assigns does hereby waive any objection to
said special assessments based on the grounds so specified in this
paragraph.
13. This agreement shall be binding upon the undersigned parties
and their successors, heirs and assigns. This agreement shall run
with the property described on the attached Exhibit A and be binding
upon the owner thereof and his heirs and assigns.
14. The Landowner and his heirs and assigns and successors in
interest does hereby agree to defend, indemnify and hold the City
harmless from all costs and expenses, claims and liability relating
to or arising out of the construction, maintenance, use, operation,
interruption, discontinuance, abandonment or termination of the
private driveway.
15. Prior to any residential occupancy permit being issued for
any structure on the property described on the attached Exhibit A,
the Landowner shall construct a private driveway on the unopened and
unimproved portion of Birch Street according to the specifications
described on the attached Exhibit B.
16. The Landowner, and his heirs and assigns and successors of
interest shall be responsible for maintenance and repair and
reconstruction of the private driveway at all times and under all
conditions the private driveway shall be accessible and available to
emergency vehicles, such as fire trucks and policy and ambulance
vehicles.
IN WITNESS WHEREOF, the parties have executed this agreement the
day and year first set forth above.

THE CITY OF EAGAN, a Minnesota municipal corporation, (hereinafter referred to as the "City").
WITNESSETH:
That the Landowners, in consideration of the sum of One Dollar and 00/100 ($1.00) and other
good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do
hereby grant and convey unto the City, its successors and assigns permanent drainage and utility
easement, over, across and under the following described premises, situated within Dakota County,
Minnesota, to-wit:
That part of Lot 3, Block 3, Wescott Garden Lots according to the plat on file and of record
in the office of the County Recorder, Dakota County, Minnesota. Except the South 300.00
feet and except the East 225.00 feet thereof.
Said permanent drainage and utility easement is described as follows:
A strip of land 20.00 feet in width over Lot 3, Block 3, Wescott Garden Lots, according to
the plat on file and of record in the office of the County Recorder, Dakota County,
Minnesota. Except the South 300.00 feet thereof and except the East 225.00 feet thereof, the
centerline of said strip being described as follows:
Commencing at the Northwest corer cf said South 300.00 feet; thence North along
the West line of said Lot 3 a distance of 10.00 feet to its intersection with a line
drawn 10.00 feet North of and parallel with the North line of said South 300.00 feet
to the actual point of beginning of the centerline to be described; thence South 89
degrees 22 minutes 45 seconds East on an assumed bearing parallel with said North
line a distance of 207.55 feet; thence North 42 degrees I I minutes 59 seconds East
a distance of 117.00 feet; thence North 47 degrees 17 minutes 02 seconds East a
distance of 154.38 feet to the West line of said East 225.00 feet and there
terminating.
Said strip of land is to extend by its full width from said West line of Lot 3 to said

The grant of the foregoing permanent easement for drainage and utility purposes includes the
right of the City, its contractors, agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains; and the
further right to remove trees, brush, undergrowth and other obstructions. After completion of such
construction, maintenance, repair or removal, the City shall restore the premises to the condition in
which it was found prior to the commencement of such actions, save only for the necessary removal
of trees, brush, undergrowth and other obstructions.
The Landowners, their heirs and assigns, do covenant with the City, its successors and assigns,
that they are the owners of the premises aforesaid and have good right to grant and convey the
easement herein to the City.
