The nearest utilities are on Wescott Hills Drive at Yankee Doodle Road (? mile to the north). STRF:FTS Access to service this plat is presently handled through a substandard, uniriproved gravel road (Wescott Hills Drive) within an existing 30 foot half right-of-way." EASEMENTS AND R.O.W. A 30 foot half right-of-way has presently been dedicated for the Wescott Hills Drive adjacent to the west line of Lot 3. A total 70 foot right-of- way for Birch Street to the south has already been dedicated adjacent to this lot. Presently, full public right-of-way is provided to service the existing Lot 3 of Block 3 by way of Trails End Road and Birch Street. With the proposed split of Lot 3, it will be creating a lot that does not have full public right-of-way access (Wescott Hills Drive). A 10 foot drainage. and utility ease emt should be dedicated adjacent to all property lines. DRAINAGE With the proposed split into two (2) 5 acres lots, no drainage problems are anticipated. CONYIENTS FOR CONSIDERATION The following oomients should be considered for the approval of this waiver of p)at/lot split: 1. Sufficient right-of-way should be dedicated or obtained by the applicant to provide for a minimxn 60 foot right-of-way to all newly created lots. 2. The private driveway to be used by Landowner is subordinate to the dedication of Birch Street to the City. 6. The Landowner shall be responsible for all costs relating to construction, maintenance and repair, including grading and snow removal with respect to use of the private driveway. 7. At his expense, the Landowner shall record with the Dakota County Recorder a certified copy of this Agreement, within 30 days of City Council approval of this Agreement. 8. No structures shall be placed on the private driveway. 9. The approval given herein by the City is contingent upon all the conditions expressed herein being met and continuing to be met. 10. The private driveway shall not be used in a manner inconsistent with the City's right, title and interest in the dedicated portion of Birch Street, including the unimproved and unopened portion thereof. 11. The Landowner does hereby agree that when the unopened or unimproved portion of Birch Street is opened to the public or otherwise improved by the City, then the private driveway as contained within the unimproved and unopened portion of Birch Street will be removed by the Landowner at no expense to the City, but at the expense of the Landowner. The City will require that the driveway from the street to the property line will be asphalted or concrete paved at the time of the road improvement. 12. The Landowner agrees that if the unopened and unimproved portion of Birch Street is improved and opened to public vehicular traffic, and if special assessments are levied against the property described on the attached Exhibit A pursuant to Chapter 429 of the Minnesota Statutes, then the Landowner shall not object to the levy of special assessments on the ground that the property described on Exhibit A had existing access from Birch Street. The Landowner, for himself, his heirs and assigns does hereby waive any objection to said special assessments based on the grounds so specified in this paragraph. 13. This agreement shall be binding upon the undersigned parties and their successors, heirs and assigns. This agreement shall run with the property described on the attached Exhibit A and be binding upon the owner thereof and his heirs and assigns. 14. The Landowner and his heirs and assigns and successors in interest does hereby agree to defend, indemnify and hold the City harmless from all costs and expenses, claims and liability relating to or arising out of the construction, maintenance, use, operation, interruption, discontinuance, abandonment or termination of the private driveway. 15. Prior to any residential occupancy permit being issued for any structure on the property described on the attached Exhibit A, the Landowner shall construct a private driveway on the unopened and unimproved portion of Birch Street according to the specifications described on the attached Exhibit B. 16. The Landowner, and his heirs and assigns and successors of interest shall be responsible for maintenance and repair and reconstruction of the private driveway at all times and under all conditions the private driveway shall be accessible and available to emergency vehicles, such as fire trucks and policy and ambulance vehicles.
