That deferment shall be in effect until development of the parcels identified. While the analysis which was completed preceded development and, therefore, may be inappropriate for collection at the present time, t would be necessary in advance of development, at which time opus orporation would be responsible for its costs. As can be seen from the enclosed correspondences, the City of Eagan has sent several notices to Opus requesting reimbursement. Recent telephone conversations with Marc Anderson of Opus Corporation indicated his understanding was that the City was to perform this analysis for their property as a commitment from the public hearing process when the plan was formally adopted by Council action. Enclosed is a copy of the minutes from the April 3, 1990, Council meeting with those portions pertaining to Opus' concerns highlighted. I do recall their request to have this analysis done to determine what the financial impact would be on a development scenario; however, I do not concur that the City agreed to do it at our expense. I recall reviewing the issue with you as the consultant was performing the work and you had concurred that Opus should bear that expense. I am unable to receive a commitment from Opus to reimburse the City for our costs incurred. Subsequently, since I am unable to assist the Finance Department in collecting this outstanding balance, I would appreciate your direction as to how the City should proceed regarding this matter and, if it is determined that it is not to be pursued, which account this expense should,be charged to. This information was then forwarded to the City's consulting engineer who provided the enclosed analysis for your information. In accordance with the proposed Water Quality Management Plan, if the drainage areas, pond volumes and surface areas within the development itself do not provide the nutrient removal to a degree of efficiency as required by this analysis, a cash dedication may be required to acquire and develop downstream treatment areas to handle any deficiencies from these requirements as noted. This information provides you with preliminary water quality requirements that should be taken into consideration in planning for the future development of these properties. Any modifications or additional detailed information that becomes available will have to be taken into consideration in performing a final review to determine the requirements to be incorporated in a Development Contract Agreement associated with any platting and/or replatting under the City's Subdivision Ordinance. If you have any technical questions regarding the information contained in the consultant's report, please feel free to contact him directly. Block 6, Eagandale Cantor and the Parcels 01-olloo-030 30, 51 and 53, the Northeast Quadrant of Lexington Ave. and Yankee Doodle Road. This analysis was performed based on the proposed characteristics for future development of the two locations as shown on the maps provided and dated April 17, 1990. ASSUMPTIONS Lots I - S, Block 6, Eagandale Center Industrial Park Total Site Area IOS Ac Impervious Future Development BS % No specific layout of buildings No spec layout of Storm Sewers Relatively flat site with potential drainage to the northwest corner or to the south boundary Northeast Quadrant of Lexington Ave, and Yankee Doodle Rd. Total Site Area Impervious Future Development Well define drainage patterns Entire area served by existing pond DP-11 Pending area with available storage capacity for 56 AF Pond bottom at approximately 856.0 Proposed grading for potential HWL at 875.0 RESUL73 Las 1.5, Block 6, Eagandalc Center Industrial Park Three all Pond Wet volume 3.8 AF Nutrient Removal 82 % Phosphorus concentration 92 ppb. 108 Ac 85% Water quality rcqu'aremens for this location are dictated by L.eMay Lake and will be met without the requirement of any cash contribution if the development provides a three cell ponding facility. A three cell ponding facility can be built in an Brea of approximately .9 Ac. There are other alternatives such as the creation of several (four or five) small detention ponds to serve smaller areas but any alternative can only be defined during final design. The combined area for several ponding facilities more than likely will exceed 9 Ac due to the extra open space normally provided around ponds but could be used for aesthetics, Northeast Quadrant of Lexington Ave, and Yankee Doodle Rd. Two cell Pond Wet volume 21.4 AF Nutrient Removal 75% Phosphorus concentration 196.8 ppb, This development is well defined and the proposed parameters for pond DP-11 will provide the required starage, The two cell treatment facility can be obtained by constructing a berm which will divide DP-U to create two separated treatment basins contained in the pond. ALTERNATIVES Pond DP-11 is a DNR protected wetland (W-134 ). In order to divide this pond into a two cell pond as required for water quality treatment, the developer will need a special permit from the DNR. The following paragraph illustrates some of the possible altcrnatives to provide an equivalent nutrient removal if the DNR permit is not granted, Upstream ponding (in the proposed development) L A two cell pond with an area of approximately 1.3 Ac and 4.8 AF of wet storage intercepting runoff from 78 Ac of the proposed development or, b. Two ponds, each with an area of .75 Ac, servicing a total area of 70 Ac, and with a total wet volume of 6,0 AP, or, Downstream ponding (downstream of pond DP•11) G One pond with an area of approximately 1.0 Ac and a wet storage volume of 5.5 AP, or, d. A two cell pond will not be efficient since it will require 1.4 Ac of area for a wet volume of 4.8 AF. COMMENTS The two proposed developments are located in district D which is LeMay Lake's watershed. LeMay Lake is a classified Type I waterbody severely affected primarily by runoff from its direct drainage. The Eagandale Development is located in the direct drainage area to Lemay Lake and therefore the water quality requirements to be met by this waterbody are higher than at other locations in the same district. The importance of treatment in the Eagandale development can not be overemphasized. If you have any comments please give me a all. We thank you for your offer and are enclosing two such site/master plans. The first one is a portion of the unplatted land on the northeast corner of Yankee Doodle Road and Lexington Avenue, surrounding Pond DP-11. This area represents approximately 108 acres. We understand that if the Management Plan is adopted that all plats must conform to it. The second area is a portion of already platted land south of West Service Road, east of Center Court and north of Lone Oak Road, and west of the 35E ramp in Block 6 of Eagandale Center Industrial Park. Here we are trying to determine the effect the Water Quality Management Plan has on a replatted situation. On each of these plans, I have included the impervious surface coverage, the overall acreage and any existing pond areas if applicable. Please determine from our submittal the amount of on site storage in acre feet, as well as any downstream requirements as to additional ponding (or additional dollars) downstream. Because of complications on the leasing side of things it looks like Verizon Wireless will be unable to move forward with this project and will likely let the CUP expire. We may need to move forward at an alternative location in the area. We'll probably be in touch in the future after Verizon Wireless has evaluated its options. I've had a chance to review and provided comment to the Building Inspector. Please note the attached City Council minutes. These conditions must be addressed ASAP. The elevation plans haven't changed since City Council approval. Note condition#4 which must be addressed. The Building Inspector is also seeking information in relation to condition#3. Additionally, conditions 5,6, and 7 must be addressed before the Building Permit if finaled. A dumpster is still located along the side of the building. Most of the trailers are in the rear yard but a few remain in the front yard, and while I cannot be 100%certain given the time of year, it does not appear that the 2 dead deciduous trees were summer. 3 .
