Dear Mr. Riley:
This letter is to inform you that any development of the above referenced lot
shoul"d'be planned to ensure that no direct driveway aceess is taken from
Denmark Avenue to the west. All driveway accesses servicing this site should
be direeted -to -Town Centre Drive to the south with a minimum 150 foot set6ack
from the east property line to the center line of any proposed driveway.
The necessity to eliminate any potential direet driveway accesses onto Denmark
- Avenue results-from a traffie analysis report commissioned by the City of
Eagan, evaluating the pro3eeted traffic volumes for the greater Town Centre
area. Based on--this study, projeeted traffie volumes on this segment of
` Denmark Avenue between Town Centre Drive and Yankee Doodle Road reach a level
that would preclude any additional driveway accesses onto Denmark Avenue. In
anticipatian.-of.the congestion of the intersection of Denmark and Yankee
Doodle Road, the City and the County will cooperatively be pursuing the
installation_a£. a signalized intersection within the next 1- 3 years.
Results of this traffic study also indicate that significant turning movements
through this interseetion will require additional left turn lanes which will
conflict with any additional driveway accesses.
I wanted to be sure that your firm has this information well in advance of any
specific site planning in anticipation of your proposed building permit
application.

Recently, you and Z have had several discussions regarding the
proposed temporary blacktop curbing to be installed with the Signal
Hills Bank under their current building permit issuance. In order
to ensure uniformity in the application of City Codes to all
businesses, it would be appropriate to document this apparent
variance from City Code with Council action if necessary.
If temporary bituminous curbing is to be allowed through the
variance process, it should be for a stipulated specific period of
time with either a financial security or written commitment from
the property owners to comply with City Code at the expiration of
that time frame.
Because this facility is currently under construction, your prompt
review and action regarding this issue would be helpful to avoid
any conflicts with final occupancy issuance. Similarily, I wou],d
be interested in knowing what the normal process is for similar
such applications should they occur in the future.

After reviewing the final assessment roll for Public Improvement
Project No. 429, I find that we are in basic agreement with the
total contract amounts with regard to the overall development, but
that we are not in agreement as to the specific allocation of
assessment amounts with regard to four of the assessed parcels.
We therefore, request tne following changes:
1) The assessment for Denmark Avenue under Project 429 against
Lot 1, Block 1, Town Centre 70 Third Addition (Burger King) be
reallocated to Outlot E, Town Centre 70 First Addition. The
amount of this assessment presently shown against Lot 1, Blook 1
Town Centre 70 Third Addition is $24,217.69. The entire
$24,217.69 should be reallocated against Outlot E, Town Centre 70
First Addition.

2)__ The_assessment_for_Denmark_Avenue_under_Proje_ct 429 against
Lot 1, Slock 1, Town Centre 100 Second Addition (Signal Bank) be

.4) The assessment for To+an Centre Drive under Project 429 against
Lot 1, Block 1, Town Centre 70 Second Addition (Rainbow Foods) be
reallocated to Outlot E, Town Centre 70 First Addition. The
amount of this assessment presently shown against Lot 1, Block 1,
Town Centre 70 Second Addition is $38.860.05. The entire
$38,860.05 should be reallocated against Outlot B, Town Centre 70
First Addition.
The reallocations which are being requested are reasonable because
the four parcels referred to have been allocated the full cost of
an assessment which should have been spread among several
parcels. however, because it was necessary to plat these parcels
for deaelopment prior to the adoption of the final assessment
roll, the above referenced parcels were assessed the full cost of
an assessment. Consequently, the four parcels referred to have
abnormally high assessments which should be spread to other _
parcels.
I want to emphasize that Federal Land Company is not requestinq by
this letter a reduction of the assessments. This letter is merely
a request to reallocate a few assessments so that the final
assessments are proportionate to the benefits which the above
referenced parcels have received from the Project 429
improvements.

A special thanks for the time you, John LeMay aiid Dave Anderson spent meeting with our staff on
Monday, September 16, to clazify the issues Signal Bank and the City of Eagan aze attempting to
resolve regarding completion of the second story addition and site improvements pertaining to
parking, landscaping and other improvements.
At our meeting, we discussed the way in which the City planned to process the bank's application.
I have discussed this item with the Community Development Department and the City Attorney's
office.
Due to the circumstances, we are streamlining the process while at the same time compiling all of
the information required under the City Code. The City will be preparing a Final Planned
Development Agreement for this site leaving the exhibits (e.g. site plan, landscaping plan, etc.)
unattached at diis time. The prepazation of this agreement will commence immediately. Any plans
which the City has in its files as a result of the original issuance of the building permit which are not
being modified in connection with the 1996 building permit (i.e. utilities) will not need to be
resubmitted by the bank. Any plan which is being modified in connection with the 1996 building
permit needs to be submitted for review and approval by the appropriate City department.
The complete packet of plans which aze required with any Final Planned Development will then be ~
provided directly to the City Council for their approval. It is our intention to place this item on the '
Council agenda as soon as possible following staff acceptance of the submitted plans. Following
Councii action, assuming that everything is approved, the Final Planned Development Agreement
will need to be executed by both the bank and the City and filed for record with the County
Recorder's office.

As I indicated in the voice mail message I left you on Tuesday, September 17, the City is prepared
to waive the reimbursement and escrow requirement; In other words, we will not bill for any staff
time pertaining to the Signal Bank project. Furthermore, there will be no application fees chazged
with the understanding that there will be no public hearing requiring the usual prepazation of an
affidavit and actual mailing expenses. The City is agreeing to a waiver of fees due to the oversight
we discovered in reviewing our records of 1989 that this applicalion should have been requested by
the City at that time and further, should have been corrected when you applied for a building permit
this spring. Please accept our apology for any inconvenience this has caused you during the past
several months.
It is our understanding that the azchitect, Dave Anderson, will give us adequate plans in an effort to
mitigate the landscaping and pazking issues we discussed at our meeting on Monday, September 16.
Cleazly, the City wants to work with the bank to maximize the number of pazking spaces; however,
aesthetics and safety are concerns we must be hig}ily sensitive to given the high visibility and
amount of pedestrian traffic at that intersection.
Hopefully, we've resolved any confusion regarding the process and can expedite the application and
complete the project to ihe satisfaction of both parties.

An application has been submitted by Signal Bank, Inc.
requesting a 10 ft, variance to the required 50 ft. building
setback line from Yankee Doodle Road. The request is to allow
a future drive-through facility and canopy extension to
encroach into the setback area.
The City's Engineering Department requested an fncreased
setback of 15 ft. along the west side of the property. As a
result, the proposad buflding plans were changed to accommodate
this. However, when the change was made, the buildinq was
shifted to the east and to the north. The applfcant feels the
building cannot be placed Purther south without undue
interference with the on-site parking. Parking and stackinq
requirements will not be changed for the drive-through and will
exceed the minimum requirements.
Both plans indicated future drive-through stalls and canopy.
At the February 7, 1989 reqular City Council meeting the
Conditional Use Permit to allow the drive-through facility was
approved.
The requested variance meets the required findings as set forth
in Section 11.40 Subd. 3.B.4 and 3.C of the City Code.

It is my understanding that the applicant for the above-referenced permit has
expressed several coneerns regarding two issues that were identified by the
EngineeMng Division during our review of this application. These pertain to
the proposed driveway access to Denmark Avenue and increasing the m3nimum
parking lot setback along their west frontage adjacent to Denmark Avenue. I
thought some additional baekground information would be helpful in
understanding the eoncerns raised by the Engineering Divsion.
DRIBEWAY ISSUE
At the time of the platting of the Town Centre 100 2nd Addition, the City had
not performed a Comprehensive Transportation Plan or detailed traffic
operation studies to evaulate the transportation network in the vicinity of
Pilot Rnob Road and Yankee Doodle Road. Subsequently, when the 2nd Addition
was processed for platting, the site plan accompanied it showing a driveway
access onto Denmark Avenue. Without the detailed traffic study information
being available, a condition was placed indicating a"maximum" of one driveway
access on Denmark Avenue. Shortly thereafter, the City eommissioned with the
consulting traffic engineering firm of Strgar-Roscoe-Fausch, Inc., to evaluate
the City's growing concerns over traffic congestion in this vicinity. As a
result of that study, it indicated that it was anticipated that the
intersection of Denmark Avenue with Yankee Doodle Road would have to be
upgraded to accommodate full traffie volumes anticipated with full development
in the area. Immediately upon receipt of that report, the attached letter was
forwarded to the signators of the development agreement informing them of the
results of this study and the impact it would have on the future development
of their property. I was never contacted regarding any concerns resulting
from this letter. It was hoped that this immediate contact would allow them
the opportunity to evaluate the situation and take the issue into
eonsideration in the design of future site plans assoeiated with development.
The bank has expressed concerns that the elimination of this access will
ereate internal conflicts. from the drive-through bank with their walk-in
customers through their parking lot. The City staff feels that there are
acceptable alternative internal site plan layouts that would eliminate this
confliet and still provide full access and free flowing movement that meets
their concerns.
As we are all aware, right-turn only accesses never funetion in line with
their ariginal intent. The City's consulting traffic engineer has also
reviecaed the situation and coneurs that the elimination of this access to
Denmark Avenue will greatly enhance future traffic operations at this major
entrance into the Town Centre commercial park.

We are sure that Signal Bank does not want to ereate a traffic hazard or
operational problem by construeting a driveway access at a location where the
potential problem has been identified well in advance.
ADDITION9L SETBACB
It was emphasized to representatives of the Signal Bank that the City was not
requiring an increase in the 20' minimum parking lot setback but was strongly
encouraging it to allow them to maintain adequate landscaping and buffering of
their parking lot facilities at this major entranee to the Town Centre
commereial development. In faet, approximately 75% of their frontage is not
affected by this recommendation to inerease the parking lot setback. Also,
with some modification of the site plan and reorientation of the internal
circulation, we feel that this can easily be aceomplished without the loss of
any parking stalls, reduction in building size or reduced stacking space for
the drive-up windows.
It was also explained to the applicant that this increased setback would not
constitute a taking but would only recognize the impaet of a potential future
right-of-way aequisition which would be acquired through a negotiated
acquisition process. This additional right-of-way is not being requested to
be dedieated to the City at the present time. Rather, aceommodations for that
potential future acquisition is being asked to be addressed at the present
time.
The Engineering Division shares the concerns of the Planning Division that
adequate landscaping be provided at this major intersection and entrance to
the commercial park.
Si1MMARY
We rrere all very excited about the prospect of having Signal Aills
construct their facility in the City of Eagan. We look forward to working
very elosely with their personnel and consultants to achieve the best
development possible. We have suggested that the architect provide
alternative site plan layouts addressing the City's coneerns so that we can
try to work out an aceeptable solution. We have not seen any revision showing
how he development could be aecommodated without an access to Denmark Avenue
and an increased setback where appropriate.
If it would be helpful, the staff would be more than willing to perform some
alternative site plan layouts addressing the size, type and orientation of
this facility. We will be happy to address any of these issues in further
detail as necessary at the meeting on February 7.

This letter is to inform you that any development of the above refereneed lot
should be planned to ensure that no direet driveway aecess is taken from
Denmark Avenue to the west. All driveway accesses servicing this site should
be directed to Town Centre Drive to the south with a minimum 150 foot setback
from the east property line to the center line of any proposed driveway.
The necessity to eliminate any potential direct driveway aceesses onto Denmark
Avenue results from a trafFic analysis report commissioned by the City of
Eagan, evaluating the pro,jected traffic volumes for the greater Town Centre
area. Based on this study, pro3ected traffic volumes on this segment oP
IIenmark Avenue between Town Centre Drive and Yankee Doodle Road reach a level
that would preelude any additional driveway accesses onto Denmark Avenue. Ia
anticipation of the congestion of the intersection of Denmark and Yankee
Doodle Road, the City and the County will cooperatively be pursuing the
installation of a signalized intersection within the next t- 3 Years.
Results of this traffic study also indicate that significant turning movements
through this intersection will require additional left turn lanes which will
conflict with anyctadditional driveway accesses.

LOT 1, BLOCK 1, TOWN CENTRE 100 SECOND ADDITION
THIS AGREEMEfVT, made this 15th day of October 1996, by and between the
CITY OF EAGAN, a Minnesota municipal corporation (hereinafter the "City") and Signal
Bank, Inc. a Minnesota corporation (hereinafter the "ApplicanY').
WHEREAS, the City Council of the City of Eagan is the official governing body
of the City of Eagan; and
WNEREAS, the City and the originai Owner and Deveioper entered into a
Preliminary Planned Development Agreement for Eagan Heights Commercial Park
(hereinafter the "AgreemenY") on the 20th day of July 1982 for a term of ten (10) years;
and
WHEREAS, the Agreement -uns with the land until terminated and is binding upon
the successor and assigns of the original owner and developer; and
WHEREAS, Signal Bank is ?he Owner of Lot 1, Block 1, Town Centre 100 Second
Addition, the development of whi,. s governed by the Agreement; and
WHEREAS, the plans attached hereto as (Exhibits A-E) are found to be in
conformance with the Agreement, and the parties hereby acknowledge that this Final
Planned Development Agreement and the attached exhibits constitute the Final Planned
Development for Lot 1, Block 1, Town Centre 100 Second Addition.
NOW THEREFORE, it is hereby agreed to and between the parties hereto as
follows:
1. This Final Planned Development Agreement applies solely to Lot 1, Block
1, Town Centre 100 Second Addition.
2. The applicant shali comply with the plans, labeled A through E, attached
hereto: (full-size plans are on file with the City of Eagan Community
Development Department)
' Site Plan - dated October 4, 1996 (Exhibit A attached hereto).
• Grading Plan - dated October 11, 1996 (Exhibit B attached hereto).
" Landscape Plan - dated October 4, 1996 (Exhibit C attached hereto).

Dear Mr. Anderson:
As a follow-up to our phone conversations recently, I want to clarify a few items in writing
regarding the above issue since it appears that the pazking lot expansion was placed incorrectly in
relation to the permanent roadway easement recently acquired by the City of Eagan.
Back¢round
The City Of Eagan was awarded possession of the permanent easement, and accompanying
temporary easement, on Signal Bank property June 19, 1996. The buiiding permit for the building
and parking lot expansion issued on May 23,1996 by the City was based on plans(dated May 9,
1996) showing the new parking lot curb expansion placed 2 to 3 feet east of the permanent
roadway easement. As you are awaze, a recent check by our consulting engineers shows the curb
and gutter was placed about 0.5 to 1 foot into the permanent roadway easement.
Action Repuired
The curb and gutter piaced by Langer Construction(the general contractor for Signal Bank) along
the west edge of the Signal Bank parking expansion will need to be removed and replaced 3 feet
to the east(as per the plan approved with the building permit) to allow room for the planned
retaining wall tiebacks with the City project. This removal and replacement of the curb and gutter,
and its associated costs, will be the responsibility of the possessor of the building permit, Signal
Bank.
If the parking stall depths are maintained at 18 feet on the site in this area and the 3-foot reduction
in width for the two parking stall areas and the drive aisle is taken from the drive width, no
varianc- would be required. If the reduction were taken from the parking stall depths, a variat;ce
fronn the City Council would be required.

Nondestructive examination services were performed on this project as authorized. These
services were conducted from July 24 through September 5, 1996, on an on-call basis.
The observations were performed by Len Vos, a level II technician quali6ed as an International
Conference of Building Officials (ICBO) certified special inspector for structural steel and
welding.
Scope of Services
During this time period, the following observations were performed.
• Visual examinations of field welds
• Bolting observations
• Deck weld observations
Results
A summazy of the results for our services is described below. Copies of our Daity Observation
Reports were left at the project after completion of each site visit. All observations performed
were found acceptable as indicated below. For specific information, please refer to the attached
Daily Observation Reports.
Visual Weld Examinations. Visual weld examinations were conducted in accordance with
American Welding Society (AWS) D1.1-1994, Sections 3.6 and 8.15 requirements. These

As requested by W. Russ Zellmez of Langez Construction Compaay, we have prepazed tkris
report to provide a summary of the special inspections and consliuction testing services
performed at the above referenced project. The special insQecrions included observing the
placement of the concrete reinforcemeat and weld and boltiag observations af the structurai
steel. The construction testing services consisted of compression testing af concrete cylinders.
Reinforcing Observations
The concrete reinforcement observations were conducted by a senior engineering assistant
qualified as an International Conference of Building Officials (ICBO) certified speciai
inspector for concrete reinforcemeat. Prior ro concrete placemeat, ohservations of the
transverse footing reinforcemeat were performed. Based on our observations, the reinforcing
was placed in general accordance wirh the available structural plaas and sQecifications. Daily
observarion reports were left on-site with Mr. Ray Lazson of Langer Construction Company.
Structural Steel Observations
The stcuctural steel observations were performed by a level II techniaan qualified as an
International Conference of Suilding Officials (ICBO) ceztified special inspector for structural
steel and welding. The observations consisted of visual weld examinauons and bolting
observations. At the time of our last observation there were no outstanding discrepaacies
remaining on this projecs. A more detailed summary of our structural steel observations was
submitted in our "StrucNral Steel Non-destructive Examination Services" report dateti
September 25, 1996.

Concrete Testing
Concrete testing was performed on footing and floor slab concrete. Tea sets (four cylinders
per set) of compression test cylinders were cast by Langer Construction Company. The
compression test results all met or exceeded the 28-day strength requirement. The
compression test results were previously submitted and aze attached m this report.
Summary
Based on the resulu of our reinforcing observations, the trausverse footing reinforcing was
placed in general accordance with the available structural plans and specificaUions.
Based an the results of our structural steeI observations, no outstandiug discrepancies were
noted of the welds and bolts observed. -
Based on the results of our concrete tests, it appears the footing and floor slab concrete has
met ihe 28-day strength requirement.
