Dear Mr. Van Overbeke:
This letter will confirm our telephone conversation of May
16, 1990 with regard to the title defect effecting the above-
captioned property. You will recall that the nature of the
subject title defect is that in 1974 the original owner and
developer of Surrey Heights Second Addition inadvertently
conveyed to the first owner of the developed property a garage
which partially rests on Out Lot "A" previously deeded to the
Homeowners Association as common area.
By way of background and to assist you in better
understanding the situation, I am enclosing copies of the
following documents for your review.
1. Enlarged portions of the Surrey Heights Second Addition
Plat Map highlighting in yellow the dwelling and part of the
garage for which the title is clear, and highlighting in pink the
11 X 26 portion of the garage situated on Out Lot "A" which is
the subject of the title defect.
2. Summary of deeds with respect to the subject property,
documenting the historical background underlying the defect in
title, accompanied by a copy of each Deed.
Our firm represents Thorpe Equity Corporation who agreed to
clear the subject title defect as a condition of its sale of the
property to Timothy J. DeFoe. For your information, Timothy J.

DeFoe has recently sold the property to James M. Barber and Linda
R. Barber, subject to removing the cloud on title.
You have indicated that three possible options exist by
which to cure the subject title defect. First, you indicated
that depending on the circumstances the City of Eagan might
recommend to the county that it approve a conveyance of part of
the common area to the homeowner. Secondly, a judicial
proceeding requesting a judgment in favor of the individual
homeowner with regard to the subject portion of the common area
might be appropriate under the theory of adverse possession since
the garage has been located on the common area for over 15 years.
Third, you indicated a procedure to either replat or obtain a
waiver of plat might be required.
As we discussed, this situation has existed from the outset
of Surrey Heights Second Addition. The garage has been used
continuously and exclusively by each homeowner living at 1509
Woodview Avenue West. The townhouse itself sits on Lot 7, Block
5 and is represented by PID #10-73001-070-05 and is a separate
tax parcel. A portion of the garage (2 X 26) is located on part
of Lot 5, Block S, PID Oi10-73001-050-05 and is a separate tax
parcel. The rest of the garage (11 X 26) rests on Out Lot "A"
which I have been informed has no PID number assigned to it nor
is it a separate tax parcel but the taxes for Out Lot "A" are
spread over all the lots having access to it.
Having examined its Bylaws, Articles of Incorporation, the
Declaration, and the Amended Declaration of Surrey Heights Second
Addition, the homeowners association (Surrey Heights Homes
Association), has suggested that it deed all of Out Lot "A" back
to the developer, Gold Medallion Corporation and have Gold
Med'allion execute a corrective deed conveying all of Out Lot "A"
except that 11 X 26 portion to the homeowners association, and
deeding directly to the homeowner that il X 26 portion of Out Lot
"A"'upon which the garage sits. It would be greatly appreciated
if this option would be acceptable to the City of Eagan rather
than being required to pursue either replatting Surrey Heights
Second Addition or obtaining a waiver of plat.
