PURPOSE In general, cities and townships have primary responsibility for the regulation of land use within their borders. Therefore, it is appropriate that municipal and town govemments act on permits and licenses involving local land uses including use of premises for charitable gambling prior to action by the County. The purpose of this Ordinance is to assure the orderly consideration of and action on permits and licenses for which both County and city or township approvals are required. The Ordinance is intended to reduce overlap and inefficiencies in the processing of applications; while assuring that applications are acted upon in a reasonable time and manner. SECTION 2. DEFINITIONS The terms used in this Ordinance shall have the meaning commonly given them unless specifically stated otherwise. SECTION 3. SEQUENCE OF ACTIONS The following process shall be followed in the processing of permits and licenses issued by Dakota County, except where a different sequencing is required by law. The Dakota County Contiguous Plat Ordinance is specifically exempted from this Ordinance. In the administration of the Shoreland and Floodplain Management Ordinance (No. 50), this Ordinance applies to proposed Conditional Use Permits, variances, and zoning amendments, but does not apply to propased permits-fcr-buildings, shoreland alterati:,n, or sewage treatment systems. (1) Generaf. An applicant for a permit or license to be issued by Dakota County is encouraged to seek any necessary approvals from municipal or township authorities prior to requesting approval from Dakota County. It shall be the practice of Dakota County officials to refer applicants to other local authorities from whom permits or licenses must be obtained prior to acceptance of applications. (2) Applications. On January 6, 1984, we were requested by Gene Baum of Eagan Construction to judge if exposed soils were suitable for support of the intended construction. CONCLUSIONS On January 9 and 11, 1984, we observed the soil conditions in the perimeter strip footing excavations. Most of the exposed soils consisted of natural coarse alluvial sands in what appeared to be a medium dense condition. Based on our observations and hand auger borings, it is our opinion that these natural sands should adequately support the proposed construction. In a small area near the northwest building corner, a 20' length of the western line excava- tion exposed existing fill soils at planned bottom of footing elevation. These fill soils extended to a depth of approximately 18" to 24" below design grades. Compaction tests taken indicate these fill soils exceed the specified 95% compaction level. Based on the results of our hand auger borings and these compaction tests, it is our opinion the fill soils should also provide adequate support for the proposed construction. We have presently performed a total of nine soil compaction tests. The results of these tests, which are attached, indicate specified compaction levels of 95% of the maximum Standard Proctor density have been achieved at the indicated locations and elevations. In areas which did not meet specified compaction levels with initial work, designated retests were performed. RECOMMENDATIONS Presently, all interior footing pads are designed to rest approximately 1'-8" below finished floor elevation. During the cold weather season, frost often penetrates up to 4' below existing grades. If excavation of these interior pads is planned soon, we recommend the interior pads be lowered in elevation to minimum frost depth (42") to prevent the formation of frost below the designed bottom of footing elevation. The pads should be protected from freezing, and backfilled as soon as possible to provide frost protection until the building is enclosed and heated. The structure will be supported by perimeter strip footings and interior column pads designed to rest on soil having an allowable bearing capacity of up to 3000 psf. The exterior footings will be founded at an elevation of 95'-8", while the interior pads will be at 98'-4". Finished floor for the structure will be at an assumed elevation of 100'-0". BACKGROUND INFORMATION No deep soil borings were performed within the confines of the building area. Therefore, we cannot warrant the soil conditions below the depths of our shallow hand auger borings (3.5'). However, based on a review of our available geological information, we feel the likelihood of encountering inferior soils at depth is remote. , OBSERVATION METHODS AND RESULTS On January 9 and 11, 1984, we observed the soil conditions for certain excavated areas. Several shallow hand auger borings were put down to aid in depicting the localized subsurface soil conditions. The soils retrieved by our hand auger borings were then visually and manually classified according to ASTM:D2488, and estimates were made of their strength capabilities. We have observed the soils exposed at planned bottom of footing elevation for all perimeter footings. The majority of these soils consisted of natural fine grained coarse alluvial sands (SP-SM). These natural sands appeared to be in predominantly a medium dense condition. Some localized areas of loose soils were noticed, and surface compaction of the soils was recommended and performed. Based on our observations and hand auger borings, we judged the exposed natural soils suitable to support the anticipated footing loads. Near the northwest building corner, a 20' length of the west building line excavation exposed existing fill soils at design footing grades. These fill soils were approximately 18" to 24" in depth, and were underlain by coarse alluvial sands. Compaction tests taken in these fill soils exceeded the specified 95% compaction levels. Based on our hand auger borings and the results of these compaction tests, it is our opinion these fill soils will also provide suitable support for the proposed construction. COMPACTION TESTING Thus far, we have performed a total of nine soil compaction tests for the project. These soils were evaluated according to the Moisture Density Relation of Soil as designated by ASTM:D2488, (Standard Proctor). The results of these tests, which are attached, indicate specified compaction levels of 95% have been obtained or exceeded at those locations and eleva- tions designated. PRECAUTIONS FOR EXCAVATING AND REFILLING DURING COLD WEATHER The winter season in this area presents specific proUlems for foundation construction. Soils which are allowed to freeze undergo a moisture volmne expansion, resulting in a loss of density. These frostexpanded soils will consolidate upon thawing, causing settlement of any structure supported on them. To prevent this settlement, frost should not be allowed to penetrate into the soils be- low any proposed structure. Ideally, winter excavaflon should be limited to areas small enough to be refilled to a grade higher than footing grade on the same day. Typically, these areas should be filled to floor grade. Trench- ing Uack down to unfrozen soils for foundation construction can then be pedormed just prior to footing placement. The excavated trenches should be protected from freezing by means of in- sulating or heating during foundation construction. Backrilling of the foundation trenches should be performed immediately after the below-grade foundation construcrion is finished. In addition, any interior footings, or footings designed without frost protection should be extended below frost depth, unkss adequate precautions are taken to prevent frost intrusion until the building can be enclosed and heated. In many cases, final grade cannot Ix attained in one day's time, even though small areas are work- ed. In the event fmal grade cannot be attained in one day's time, frost can be expected to develop ovemight. The depth of frost penetration can be minimized by leaving a layer of loose soil on top of the compacted material overnight. However, any frost which forrns in this loose layer, or snow which accumulates, should be completely removed from the fdl area prior to compaction and ad- 3itional soil placement. Frozen soils, or soils containing frozen material or snow should never be used as fill material. After the structure has been enclosed, all floor s1aU areas should be subjected to ample periods of heating to allow thawing of the soil system. Alternatively, the frozen soils can be completely removed and be replaced with an engineered £ll. The floor slab areas should be checked at ran- do;n and representative locations for remnant areas of frost, and density tests should be performed to document fill compaction prior to slab placement. Due to the potential problems associated with fill placement during cold weather, any filling operations should be monitored by a full-time, on-site soils technician. Full-time monitoring aids in detecting areas of frozen material, or potential problems with frozen materiel within the fill, so that appropriate measures can be taken. The choice of fill material is particularly . important during cold weather, since clean granular fill materials can be placed and compacted more efficiently than silty or clayey soils. In addition, greater ,nagnitudes of heaving can be expected with freezing of the more frost susceptible silts and clays. This permit authorizes the applicant to construct a right in and right out only access on the east side of TH 13, 0.15 miles north of County Road 28 in the City of Eagan as shown on applicants' plan sheet. The work authorized by this permit shall be coordinated with the construction of the Northbound right Turn Lane being built and the median island being extended to the north under a Cooperative Agreement with the City of Eagan. This permit also authorizes the applicant to outlet a drainage pond to the easterly ditch of TH 13 with a 21 "X 68' RCP as shown on the applicants plan sheets: The invert elevation of this pipe shall match the in place ditch bottom elevation. The applicant shall provide in-house inspection at all times while working on trunk highway right of way. The applicant shall furnish, install and maintain all required traffic control devices according to Temporary Traffic Control Zone Layouts dated January 1998, while performing the construction authorized by this permit. Due to the TNein City rush hour restrictions, no work will be allowed from 6•00 AM to 9•00 AM, or from 3•00 PM to 6•00 PM unless authorized by the Mn/DOT Permit Office at 651-582-1443. If the temporary traffic control zone is to remain in one place for more than 3 days or involves a detour, road closure or a situation where the typical layouts do not apply, the applicant shall prepare a specific Traffic Control Plan for approval by Mn/DOT prior to start of any construction. All persons while performin' authorized work on Mn/DOT Right of Way shall be required to wear a"Mn/DOT" approved HiQh Visibilitv Safety Vest and . oft Cao/Hard at. OF AMERICA It shall be the responsibility of the applicant to utilize the "Gopher State One Call" excavation notice system as required under Minnesota Statute Chapter 216D, 48 hours prior to performing any excavation (phone 651-454-0002 Twin Cities Metro Area or Toll Free 1-800-252-1166). The applicant shall contact the owners of the in place utilities and make all arrangements for their relocation or revisions as required due to the construction authorized by this permit. No material shali be deposited on the traveled roadway. If roadway signs are in the way of construction the applicant shall be responsible for the removal and immediate temporary installation until such time the sign can be permanently reinstalled. All damaged signs shall be replaced immediately. Any lane closures for TH 13 shall be approved by this office at 582-1443, 24 hours prior to the lane closure. The hours of the lane closure shall be determined by this office. All excavations along T.H. 13 shali be backfiiled at night to a height within 2 inches of the driving surface. The outside edge of the inplace bituminous roadway shall be saw-cut to provide a - uniform edge for the new construction to abut. Provide a 1.0 foot sub cut below the top of the grading subgrade. Backfill with select granular material. Where connecting new surfacing adjacent to inplace pavement that will remain inplace, no material shall be removed from inside an approximate 1:1 slope drawn downward and outward from the bottom of the inplace pavement. The access shall be bituminous surfaced within the State's right of way. All bituminous surfacing shall extend to and match the in place bituminous roadway. M-A-98-0899 C.S. 1901 TH 13 TRANSPORTATION CORP. OF AMERICA Bituminous surfacinJ disturbed by the construction authorized in this permit shall be removed from the MN/DOT right of way. Compaction of all grading and bituminous items shall be obtained by the "Ordinary Compaction Method" requirements. Use Tack Coat, MN/DOT Spec. 2357, between all bituminous lifts. The slope along the right turn lane shall match the existing inslope along the highway. The right turn lane and shoulder shall slope at 0.02 ft./ft. downward toward the ditch area. The side slopes along the access shall be 6 to 1 or flatter. A 1.5 foot wide Class 2 Aggregate shoulder shall be placed along the access and right turn lane within the State's right of way. Strip and salva;e inplace slope dressing from areas to be disturbed by construction, and reuse as slope dressing. The final grade of the access shall be - 0.5 % for a minimum distance of 50 feet back from the outside edge of the right turn lane. • The applicant shall replace, in kind, all bituminous, concrete, curb and gutter, and sidewalk disturbed by the construction authorized by this permit. It is expressly understood that this permit is issued subject to the applicant's compliance with the Rules and Regulations of the Minnesota Environmental Quality Board and any other affected Governmental Agencies. All areas disturbed by the applicant, or their contractor, shall be res[ored to original or better condition. All turf establishment shall have a minimum of 6" of topsoil (accordinc, to MN/DOT Standard Spec. 2105 Table 1 Topsoil Borrow), then sodded or seeded. If the areas are seeded, MN/DOT seed Mixture Type SOA with Type 1 Mulch and Disc Anchoring shall be used according to MN/DOT Specification 2575. NI-A-98-0899 C.S. 1901 TH 13 TRANSPORTATION CORP. OF AMERICA STRIPING & SIGMNG The applicant has the option having the striping and signing required for this permit done by the contractor for the Cooperative Agreement on TH 13 or having MN/DOT perform the work at the applicant's expense. The actual cost of this work will be furnished to the applicant upon request. The applicant shall contact the permit office @ (651) 582-1443 or (651) 582-1446 at least thirty (30) days prior to construction to inform MN/DOT if they are going to hire MN/DOT. All signs, paint, and tape shall be manufactured and installed according to current MN/DOT specifications and the Minnesota Manual on Uniform Traffic Control Devices. The applicant or contractor shall provide a sample or an invoice from the manufacturer of all materials used to MN/DOT. If MN/DOT is selec[ed to perform the signing and striping all fees shall be paid by the applicant within 30 days of billing. The applicant shall coordinate removal and installation with the permit office (phone numbers listed above), by giving at least 30 days advance notice for fabrication of signs and at least 5 days advance notice for removal and instaliation. Installations outside of MN/DOT right-of-way is the responsibility of the applicant. Traffic will not be allowed to use the access covered by this permit until all si;ning and. markings are in-place, or otherwise authorized by the Traffic Engineering Section. The applicant shall perpetuate all existing drainage. The applicant shall relocate and ~ reconstruct the in place drainage ditch along the highway as necessitated by the construction authorized by this permit. The new ditch shall match the grades and contours of the in place drainage ditch. The applicant is required to preserve all existing survey monuments. If MN/DOT determines that monuments have been disturbed or destroyed during construction activities, the applicant shall accept full responsibility for all costs incurred in the re-establishment of the monuments. NI-A-98-0899 C.S. 1901 TH 13 TRANSPORTATION CORP. OF AMERICA Winter work shall be considered from November 1 through April 15. Work during this period shall be on a day to day basis at the discretion of the Roadway Regulation Supervisor. All work authorized by this permit and the restoration of the State's right of way shall be satisfactorily completed by December 1, 1999.
