Dear Sir:
I wish to respond to the accusations and facts of the situation presented
to you by Mr. Thomas Gold. As Mr, Gold is now aware, his statements were
founded upon an outdated development plan that both he and I had posession
of throughout this Spring. The actual final development plan shows complete
consistency with proposed and actual grades. I gained privy to this info-
rmation on Sune llth. I believe the questions of Mr. Gold have been answered.
I feel Mr. Gold's letter is an act of misunderstanding, mistrust, and poor
timing. I have concern of the negative credibility implied upon Grand Oaks
an myself personally. I therefore choose to present some facts of the
situation:
1. The atiached copies of development plan and actual elevations show
Mr. Gold's house to be within k" of proposed elevation.
2. Mary Ann has communicated with Mr. Gold no less than 30 times for
situation upda[es. I have talked with Mr. Gold no less than three
times on the specifics of the situation.
3. Since Mr. Gold first talked with me in early winter my response has
always been Che same:
a. There existed excess fill in the general area which needed to
be hauled out with trucks when conditions allowed
b. The grades proposed on the original development plan were
inconsistent with actual final grade.
c. Jim Hill Engineering provided all of our individual lot
surveys and staked each house we built in Westbury. I should
(and did) hire Jim Hill Engineering to study the situation to
determine what happened and what could be done to correct the
situation.
d. Grand Oaks would address the questions of grade and complete
the.fittal grading in the Spring as weather permits.
4. In Mid May we put a wide track dozer to work in the area to provide

temporary positive drainage to prevent Spring water problems. At
this time the wide track dozer was the only piece of equipment able
to work in this area of super-saturated clay soils (mud).
5. In late May I requested Jim Aill to schedule in a survey crew to
check existing grades and propose finai grades.
6. In late May Jim Hill crews shot elevations and plotted information.
7. On June lOth Grand Oaks hauled about 50 loads of excess dirt from the
- general area. ,
8. On June llth Jim Aill crews staked proposed final grades of drainage
swale,
9. On 7utte llth it rained and neighborhood kids pulled most of the stakes.
10. On June llth Jim Hi11 crews gave me a copy of revised development plan.
11: Dn Tune 13th I met with Mr. Gold and reviewed the situation.
12. I intend to continue finish grading according to the development
plan and requested restaking of Jim Hill. This will proceed as
as conditions allow. We cannot finish grade mud.
I hope my statements of facts will clarify the positive intent and positive
actions taken by Grand Oaks. I feel the negative implications of Mr. Gold's
are founded only upon his impatience of getting a12 the facrs before he
acted with his letter of June 10.

This is a'fqllow-on letter to my June 14, 1486 letter addressed
. to yoi!r firm. This letter also covers my concerns about
noncompliance with applicahle huilding codes and Minimum Froperty
Standards. Specifically:
1. Uniform Ruilding Gode sectien 2447.(a) General -
Foundations supporting wvod shall extend at least 6 inches abvve
the adjacent finish grade.
2. Minimum Froperty Standards and IJniform Buiiding Cvde - On
, graded sites, the top vf any 2X.'t?!'lOr foundation shall extend
above the elevation of the street gutter at point of discharge or
the inlet vf an approved drainage device a minimum vf 12 inches
plus 2 percent.
3. City of Eagan Approve3 Deveiopment Plan - The location of
the drainage swale falls aivng the southern property line.
The three requirements Iisted above are not being complied with
on my lot(Ibt 3, 61ock 2s Westbury Third Addition).
I have been unable to get any answers ar action from Grand Oaks
Develepment Company(buiider), Your assistance in answering how
Gat+6ert Development Co. will ensure that their development wil2
comply with these requirements will be appreciated.
As Tom Egan was quoted in the newspaper in reqard to problems
with Tellef<en Buildersi city council should limit their concerns
to code vialations, not aor4cma.nship items. Therefore, in
parallel with this letter, I shali be at the next city cauncil
mee±inq to ask for the co{!ncil's assistance in cvrrecting these
violativns. I shall also be at the neut Advisory Planning
Cvmmission meeting to bring to their attentivn that the
Development Plan that they carefuliy reviewed and approved has
not been complied with. Any information that you can provide me
prier to these meetings will be appreciated.
