I was interested in Pinding the lot corner in this srma. I
wanted to know thilt informatio» It1 order to 6e ab2e to mow my
lawn correctly. I also needad to know this location ao Lhat I
could place any pDjpCte auch as a garden within my yard.

my mortgage. I used thie certiPicate in meacuring my lot linen.
Yau noticed that I was measuriag my yard and talkad With me. at
that time I had pleced some saall o6jects st certain pnints olonq
tha line to assist Sn my wark. You noticed that thete abjacte
were well within what you consider pour yerd.
I explained that I was meacurittg in order to detarmina the
locetion of our hack corner. I noted there was something od8
ahout aur front corner. It loaked as if you hud planted the ash
and Crsbapple in my yard. I oPi'ered the explanation that the
house may have baen placed on the lot slightly askeW from ha
certiPicate. I slso atated that I did not see lt ae a problena.
I was happy that I had Pound the back corner.
Two days later I was in my Pront qard whila you vere plcking up
your mail acrosm the straet. Your wife was in the car. You
yelled to me somethfng very similar to "Thase treeQ ar• mina!
And I have noticed that you are mowing further into my yardt" I
was initially dum6POU»dad. Then I met you in youc qarage. I
said that I sass anly trying to Pind the beck Corner, that the
house may be placed slight sekew aY the eurveyor's certificate,
and that I did not see a probles. I wae cimply teatatinq ahat I
had stated ahen I was measuring the lot line. You caltqed dovn
and agreed that thece was not e problem. Perhape you had
~ misunderotood mfl earlier.
I had a deck bui]t in 1991. I needed to provide a map oP my lot
vith the deck detailed in arder to obtain a buildinq permit.
This deck extends six Peet towards our common lot lina lrom my
house. The surveyor's certificata showa that I have 18.35 taet
hatveen the hack corner ot my houce and the lot line. Thia
should allov plenty ot room. But since you seem to be very
sensitive about the lot line, I invited B eurveyor to Pind the
exact lot corners. I obtained n survey oP our entirs development
Pr.om Dakots county end grovided thia and the surveyor'a
certificate for my lot to tha surveyor. I took plcLurea of tha
surveyinq in order to documept the mork.

The surveyor was able to Ptnd two of my four lot cornara mith e
metal detectar. There is normally a marked metal rod placad on
each lot corner by a surveyor vhen a land davelopar oplite a
parcel of land into individual lots. The cornors that ae Pound
were my horthaest and southeas{ cornars. My southsast corner ic
nur back common cornec. T suspect that the metal rod in my
sauthvect cnrnar Wec removed when the aeh tree waa planted and
that tAe met81 rod in my northeast eorner has bean coverod by
enough soiY Pill that e metal detector can not Pind it.
TWO survey points within a line of siqht are needod to compute
snothar aurvey point. Unfortunately my two lncated aurvay pointo
were not Sn a line of aight. They vere on diagonal cornere of my -
house. Sa another original matal roct musi 6e found in or$er ta
compute the location of my snuthwest and northeamt cornara. We
found the metal rod markSng tha corner of the Bohn'o iet naar the
lipht pole in the public right of way at kha interaaction of
Weetbury Drlve and Westbury Path.

the stakes knoWing thst the metal rode remained. 2 vanted to

I started moaing on the surveyed line betwoen our housaa at tha
beqinninq of thic year. Yau aontinued to moa whera yqu hod in
praviaua years. APter I moped a couple of time¦ on th• sutveyed
lot line, you initiated a aonversation about the liaa. I wes on
my deck. Yau vere with your son in your baek yard.
I axplained that I had the lot sucveyed and that T Waa moWing on
the surveyed lot line. I also explained that I did not aee any
problemm vith the trees that you planted. You ahould hav• placad
them aell within your yerd. Sut I am glad that you had the trees
planted. They are an assat to the neighborhood.
You explsined that, according to Joe Miller, the front lot line
ic conaidered to be near a yarticular crack in tha atraYt eurb.

of your mtmLement was that I ghould bou to your n¢seaamont of the
line iocatian rether than trust my own meaaurements or the
measurements of a surveyor.

the computed back corner oY your house and our lot lino. You
have 5 Peet betWeen the computed Pror~t corner of your houce and
our lot line. Your aurveyor's certiPicate alao showa youc house
is alightly askew ot our common lot line. This skev will rsupe
your strip of 1aWn betaeen the driveagy and our eommon lot iine
to narrom lurther aa you progress irom qour houae to the street.
