I still have a major problem with my lot. I have been very patient about
this problem.
I had my lot surveyed as you suggested. You then acknowleded that the lot
was not graded properly. After telling Cabbert Developement of the problem
no one has followed up on this situation.
I contacted you again in february 108£3 and again Cabbert Developement has
not responAed to the correction of this problem.
I did receive a copy of the letter you mailed to Gabbert Developement. They
did come out with a grader and pulled the dirt from Williams Pipeline lot
and put it on our lot----- P,Of,Y.S Ai•!7 ALL------.
I would appreciate your attention to tnis matter. I am prepareu to talce
whatever steps are necessary to resolve this problem.

Dear P7r. Gabbert:
~ This letter is prompted by a backyard drainage problem brought to
the City's attention by the resident of Lot 6, Block 2, Westbury 2nd
Addition. At some time during the grading of the subdivision under
the approved grading plan, a small landlocked drainage basin was
created in the northeasterly corner of the above-referenced lot.
Attached is a Certificate of Survey, by J.R. Hill, Inc., which shows
a"proposed house" located on the above-referenced lot. A garage
floor elevation of 893.9 is proposed. Also attached is a
Certificate of Survey, by Sigma Surveying Services, Znc., which
shows the garage floor constructed at an elevation of 892.44.
Therefore, the garage floor as constructed is approximately 1.46'
below the proposed elevation.
The City records indicate that the proposed grading plan elevation
for the house ,pad area is approximately 893.0. The existing ground
elevations around the house range from 891.8 to 892.5.
In summary, the lot grading proposed under the grading plan shows
conveying the backyard dr4nage southerly along the west side of the
existing berm to a low point and then westerly to Westbury Lane.
This is not what appears to be the case. Positive drainage can be
accomplished by utilizing the existing side lot line drainage and
utility easements.
I trust you will forward this concern to the appropriate responsible
' party be it yourself or the builder.

Dear Mr. Gabbert:
For the past few months we have been dealing with a drainage
problem caUSed by the house construction on the above referenced
parcel. More than enouqh time has passed for an acceptable
solution to the problem. Sometime earlier this Spring, there
was an attempt made to remedy the situation, but, the grading was
not restored (topsoil and sodding) satisfactorily.
The City is left with no alternative but to complete the
restoration and bill Gabbert Development for the restoration.
The City is willing to give you the opportunity to complete the
work yourself. I£ the zestoration is not completed by July 15,
1988, the City will hire the work done and bill Gabbert
Development.
Please contact me prior to any further restoration work. If you
have any questions, please feel free to contact me at 454-8100.
