Re: Cliffton Hills Preliminary Development Plat, Inver Grove Heights Case No. 00-495Z

Recently, one of my Weston Hills neighbors spoke to you of a concem about the Cliffton Hills
development in Inver Grove Heighu. I attended the Inver Grove Heights Advisory Planning Commission
meeting on the same evening because of the same concern. The purpose of this letter is to appeal for your
support to vacate an easement associated with a gravel driveway that runs through our backyazd.
T7:e preliminary Cliffton Hills development plan that was reviewed'oy Eagan last winter did not contain
Outlot A and notation to "Use Existing Access Drive For Temporary Emergency Ingress/Egress" that aze
contained in the current plan. From what I have been told informally by Eagan City Staff, I believe that the
city would have objected to these provisions of the plan. As you may recall when Eagan approved the
Pines Edge development in 1994, there was an attempt to vacate this easement. However, because several
Inver Grove Heights residences would be landlocked, the private driveway remained. With the Cliffton
Hills development, the private driveway purpose is no longer necessary.
I have discussed the plan with a member of the Eagan City Staff and he, in tum, has discussed it with the
Eagan Fire Chief. I have been told that they feel that such an emergency access is unnecessary. I have
raised a number of practical and legal questions to the city of Inver Grove Heights (see the attached letter).
Since this is property within Eagan city limits, I feel many of these issues also impact Eagan. For example,
do the questions about maintenance, gating, and policing of this "emergency access" apply to Eagan? T'he
Inver Grove Heights Ciry Staff recommendation to use the gravel driveway as a gated "emergency access"
if their City Attomey decides that it is legal. Will the Eagan City Attorney review the new public use
easement for legality, liability for future assessments, or compensation? My reason for raising these
questions is to draw attention to this potential "can of worms."
In summary, I ask for any assistance that you may be able ro provide in support of my concerns and in
support of vacating the easement. I believe that this issue will be lost in the upcoming Inver Grove Heighu
City Council meeting due to other concerns over housing densiry and traffic. My feaz is that it will become
a non-issue in the minds of the Inver Grove Heighu City Council and will remain part of the plan if other
concems aze overcome. Personally, Outlot A and the "emergency access" easement aze the only concems I

We Lave a single concem regazding the preliminary Cliflton Hills development plan that is scheduled for review
at the September 25, 2000, City Comcil meeting. We expect that the npcoming meeting will be much like the
September 5 Advisory Planning Commission meeting. Although we presented our opinion at the Advisory
Plannmg Commisson mceting, we felt Nhat our concem was lost in the lengthy debate aver uther issues.
We live at 4724 Weston Hi1L5 Drive (see attached map). The putpose of this let[er is to express oar opposidon W
Outlot A and the use of a gravel driveway as an "emergency access: " We feel that dris planned development
shonld stand on its own mesits u9ng city sriieets and should not have to rely on fhe use of a gcavel driveway
mmning throngh mu backyud to achieve its objecuves. Page 5 of the City staff planning repon, dated AnBast 3 1,
2000, Las a background description. Our objections include cammon sense, practical implicatiams, and legal
concems.
It is our impresson tLat the developer is attempting to respond to concems for a southem access raised by
members of the Planning Comm;ccion and City Cauncil. At best, the "emergency access" is a token solution. It
pmvides an additional access to less tLan ame-third of the lots mcluded in the plan. Apprmdmately Lalf of the
lots remain subject to a 9ngle ingess/egcess point even if the "emergency access" were implemented. If ihe
developer and the City aze serioas about dual-access, a temporary road to the cul-de-sac near Oatlot B thmngh
the eas[ portion of the development is the true answer.
We Lave posed several questions regarding practical issues. Who will plow the snow, control the imderbnuh,
and trim the trees? Who will decide the type of gazing, conuol gate access, and pedesnian haH'ic? Who will
decide if the road sudace conditions are adequate? Who will pick up the txash/construction material if the ouHot
and road aze used as a dwnping sita? W1io will prevent conslruction traffic and others &om using the road oadl
it becomes gated? Who will police the road?
We feel tLat it is important to emphasize that our property is in Eagan. T1ie development plan that was reviewed
by Fagan last winter did not have the Outlot A and "emergency access" provisious. Eagan Ciry siaff dces not
have answecs to my practical issue questions and have indicated no interest in turning tttis drivevvay into a City
maintained street. We have been told that the Eagan fire cLief feels that this "emergency access" is unnecessary.
Our belief is that the eacement on our propecty has a defined pmpose as a private driveway. We object to
rede5niaon of the easement to a desgnated public pucpose regardless of the conditions. We Lave no real
assurance tLat the use of the easement for emergency vehicles wouid only be temporary and tbat u will 1x vacated
in the fimue. We aLso object to any liability for firtare assessments• V?e feel tLat there is a decrease in onr
property value associated with a pnblic use desgnation.
In summary, we are not opposed to the CliBton Hills development. If the "emergency access" and Omlot A were
remmed &om the plan, we would have no objections ro the development. We lived an a cui-de-sac in Inver
Grove Heights for 14 yea:s, imderstand both the benefits and risls associated with limited sa-M access, and
suggest cLanging Oattot A W a bailding site for the Clifiton Hi11s develapment. Please call us at 454-8857
