Re: Complaint regarding blockage of private road
Dear Mr. 6 Mre. Allen and Mr. 5 Mrs. Neary:
Following a phone conversation with Mra. Allen on December 11, 1985, I again
discusaed this matter with Mr. Doug Matteson, the Eagan Police Officer [hat
inveatigated thia matter at my request, he has included a diagram with his
report, a copy of which I enclose.
It does appear that Mr. Loomis has either moved snow in such a way ae to block
the pre-exieting access to the property from Highway 3 or has allowed the road
to be closed due to drifting'of snow. However, he has apparently provided
alternate access from Biecayne Avenue.
I had previously diacusaed this matter with Mr. Neary and adviaed him that an
officer would be aent out and that Mr. Loomia would be cited for public
nuisance in the event that he was blocking access to your homea. Officer
Matteson has investigated this matter and believes that adequate access is
provided. Any dispute between the parties as to whether Mr. Loomis can do
what he has done is atrictly a civil matter that will have to be resolved by
the various partiee.
Having said that we will not prosecute in this matter, I would like to follow
up with my understanding of the aituation. I underetand that the easement
provided to the Neary and Allen property provides that it may be terminated
upon a public street providing access to those two propertiea. Mr. Loomis is
apparently nov claiming that Biecayne Avenue providea such a public accese.
Baeed upon the drawing that Mr. Matteson hae provided to me, thie wonld not
appear to be the case as there ie atill a private drive and no alternative
easement haa been provided or agreed upon by Mr. and Mre. Neary or Mr. and
Mre. Allen. Therefore, my initial reaction is that Mr. Loomie has improperly
denied access over the pre-exieting easement.

Mr. Loomis may be willing to dedicate public right-of-way to provide accesa
for the Nearys and the Allene. I have contacted the Eagan Public Works
Department and have mentioned this to him, however, it would be Mr. Loomis's
obligation [o contact the City to discuas this if this is a posaibility.
Obviously, both sidea have spent considerable amounts of money on attorney's
fees in trying to deal with this issue and I would be glad to suggest that a
mutual diecuseion with a member of the City Attorney's Office as well ae the
Eagan Public Works Department may be able to aseiet the parties in resolving
this iasue. However, I muat reiterate that the City cannot become involved in
representing either faction, nor do I believe that a criminal action can be
brought to resolve this isaue. Please feel free to contact me if we can be of
assistance in setting up such a meeting.

This letter is in response to your request as to the procedure for
obtaining public street status fcr your private road. The exist-
ing status is not acceptable for consideration by the City of Ea-
gan as a public road.
First, a petition for street improvement would have to be obtain-
ed containing the signatures of the owners of at least 35% of the
bene£ited front footage. Once the petition has been presented to
the Council and the Council accepts it, a feasibility study would
be prepared containing preliminary design and cost estimates. If
this project is feasible, the City Council would approve the re-
port and order a public hearing regarding the street improvement.
If, after the public hearing, the Council decides to continue the
project, then plans and specifications would be ordered to be drawn
up. At this time, the necessary right-of-way would begin to be
acquired by permanent highway easements. If easements could not
be negotiated, then the City would have to resort to condemnation
proceedings to secure the necessary right-of-way. Upon obtaining
all necessary right-of-way, the Council would award a contract for
improvement of the street to City standards, that being a minimum
oi a 32' wide street with concrete curb and gutter and bituminous
surfacing. After completion of construction, an assessment hear-
ing is held regarding the spreading of the costs to the benefited
property. At that time, the City would accept the newly construct-
ed street as a public road.
The above paragraph is a summary of the events which would have to
take place before the City of Eagan would accept your access road
as a public road. In short, your private road in its existing
condition would not be acceptable to the City for a public street.

Engineer's Report
We were directed to the location of the house by Leslie
Gates. The house will be in line with a stand of five
(about 24" diameter) cottonwood trees at the south end of
the property. The setback is about 100 feet from the nor-
therly property line. This area is higher than the rest of
the lot, and has a natural slope to the back of the house
for a walkout. The house will be a split level with a
walkout at the back. The house will be built at existing
ground level. Surface water will be directed away from the
house by a berm and the natural slope to the south.
Borings 1 and 2 show reddish-brown loamy sands, an inter-
mediate layer of fine grain sand, and a bottom strata of
sandy loam. There was no water encountered in the £ifteen
feet of boring. There is a dry creek bed at the rear of
the lot at about thirty-five feet lower than the house. No '
mottling was encountered. The reddish-brown color indi-
cates an absense of ground water. It is safe to assume
that there is no gzound water within 4 feet of the bottom
slab. ,
At the 4 foot level the soil tested adequate for a load o£
2000 pounds per square foot. The allowable bearing pres-
sure at the four foot level is 2000 pounds per square foot.
The loamy sand is adequate as a compacted fill. Any com-
paction of sand shall be 95 percent standard proctor den-
sity (ASTM D698) in one foot lifts. Compaction is required
under filled parts of the building pad such as the sloping
part that extends under the floor level of the split level
house. It is also required under garage aprons, etc, where
settling of fi11 will cause structural damage. The sandy
soil found on the lot should provide excellent drainage.
