Dear Scott:
Recently, the City was asked to investigate the elevation of storm
manhole #7 located on the common lot line between the above-
referenced lots. The property owners felt that this manhole
elevation was too low in relationship to the existing and proposed
finished yard elevations for Lots 2 and 3. Subsequently, we
reviewed the profile of this storm sewer alignment and top of
castinq elevation in comparison to the plans and specifications for
the storm sewer construction being performed privately by you under
the development agreement for the above-referenced subdivision.
Attached to this letter you will find the profile of the storm
sewer system showing the proposed profile as well as the actual
profile shot by the City's survey crew on May 23. Also enclosed
you will find a copy of the development grading plan in this
vicinity.
Evidently, there were modifications and revisions to the .
development grading plan to accommodate the house plans on these
two lots which limited the amount of grading and tree removal.
While this is obviously a benefit to all parties concerned, it
requires a revision and modification to the storm sewer plan to
adjust the top of casting to meet this revised grading plan. After
reviewing the proposed storm sewer plan and profile as compared to
the actual existing conditions, it is apparent that the top of
casting for manhole 7 should be raised approximately 3+/- feet to
better match the existing ground conditions.

I would encourage you to contact both property owners and work out
an acceptable elevation for this manhole adjustment to make sure
it best fits in with their final grading plans.
The City of Eagan and the adjacent property owners will greatly
appreciate your prompt response in performing this corrective
action as soon as possible so that they may proceed with their
finished landscaping. It is hoped that this work can be completed
by June 18. If you have any questions or concerns regarding this
recent evaluation of your development plans, please feel free to
contact me for further clarification.

It has been brought to the attention of the Developer of I
• Whispering Woods via a letter ftom the City of Eagan something
which we were not aware of.
The grade outside at the most North Westerly corner of the
home was to be finished graded to 963.0 which made for a cut of
' 4.2 feet at that location. This is about the same as the manhole
, cover they aze requesting raised, as the City survey shows and as
per Associated Engineering site plan.
It is and always has been the obligation of the party wishing ~
to raise the ground from the existing grade at the time they took
possession to retain their land or lot if they desire to raise the I
grade on there lan3 cr lot. It has also been noted by observation that you have been
letting gtound, si1t, debris, or whatever, go into the dtainage
area on the rear of your lot You were advised in a letter dated
July 24, 1989 that "no trees, stumps, fill or silt from your lot,
' is to Le disposed of in any adjoining or surrounding lots, as the
low lying area is controlled both by depth and size as to city's
specifications per plat". The letter informed you to keep all
material out of this area or you would be responsible to remove at
your own expense.
Please re-grade by r?r.ioving the exoess g-ou^d placed b=b::_e^
your home and lot 2, before selling you this lot the storm water
from lot 3, ran over and across the rear of lot 2, to a behive in
reaz of lot 2, as we did not want storm water to run into larger
drainage azea on rear of your lot, and remove all tree stumps,
, fill, silt and debris Yrom the drainage area over the rear part of
your lot.
Please advise by return mail whe? this regrading will be
accomplished and the drainage area cleaned.
