Subject to any and all mineral rights and mineral reservations as pro-
vided by law.
Dear Tom:
At your request, I have examined the title to the property above described,
using for the purpose of such examination a Registered Property Abstract
last certified by the Dakota County Abstract Company as of September 2, 1977,
at 8:00 o`clock a.m.
Based on such examination, I am of the opinion that as of that date record
title to the property was vested in TIMBERLAND DEVELOPMENT CORPORATION, a
Minnesota corporation, free and clear of all liens, charges and encumbrances
thereon, except as fo.tlows:
1. Real estate taxes for 1977 in the sum of $859.54 have been paid in
full.
2. Protective covenants against the property appear according to Doc.
No. 70284. They cover use of the land for residential purposes only and
only residential building permits can be constructed on the property. Other
provisions also appear to restrict the property for park purposes.
3. Easements affecting the property appear according to Book 62 M.R.
page 431 and Book 81 M.R. page 587. They each run to Northern States Power
Company for transmission line purposes and generally cover the Northerly 200
feet of the lot.
4. The Owner's Duplicate Certificate of Title No. 47916 should be de-
livered at the closing for purposes of recording the Warranty Deed.
5. A Highway Easement dated September 18, 1975 and filed October 17,
1975 in favor of the City of Eagan as Doc. No. 79833 covers Wilderness Run
Road along the Northerly boundary of the lot.
6. The Northexly 255 feet of the subject property is zoned P- Public
Facilities according to a Resolution of the Eagan City Council filed June 29,
1977 as Doc. No. 89604.

7. I would request that a special assessment search be prepared by the
Eagan assessment clerk covering pending and levied special assessments.
This opinion is limited to the matters shown by the Registered Property Ab-
stract. All matters not so shown are excepted from this opinion and include:
(a) Rights of any parties in possession; (b) Possibility of liens for improve-
ments in process or completed on the premises within the last ninety (90) days;
(c) General zoning and building laws and restrictions; (d) Special assessments
or pending special assessments; (e) Matters which an accurate survey of the
