The following is a response to your question regarding the City Ordinance as it pertains to
accessory buildings, structures and uses. Our ordinance specifically addresses accessory
buildings/garages under Sec. 11.10 Subd. SC and reads as follows:
"The total floor area of a detached accessory building and any attached garage sha11 not exceed
one thousand one hundred (1,100) square feet, except by conditional use permit." Also, item six;
"No accessory building or structure shall exceed sixteen (16) feet in height."
In essence, the ordinance allows for some combination of detached accessory building and
attached garage to total eleven hundred square feet in total size. It appears from our conversation
that a three (3) car garage and an accessory building that is proposed at 13 feet by 60 feet would
far exceed the square footage allowed within Chapter 11 of our City Code.
We clearly enforce this regulation through our building permit process. If you have any

Section 11.10 Subd. 5(Accessory Buildings, structures and uses) Amend to read as follows:
A. General Standards.
1. No accessory building or structure other than a fence or a temporary
construction office shall be permitted on any lot in an R-er- R a residential
zonin~ district prior to the time of construction of the principal building to
which it is accessory, except a residential garage, which prior to the
construction of a residence can be used only for storage purposes pertaining to
and until the completion of the main structure.
2. AccessorY buildingsgreater than one hundred fifly (150) square feet in size
shall exhibit finish materials similar and compatible to those utilized on the
principal building and match the principal building in color.
3. Accessorv buildings shall be maintained in a manner that is compatible with
adiacent uses and does not present a hazard to public health, safety and eg neral
welfare.
B. A'cultural Uses. Buildings and structures accessory to farming operations are exempt
from the requirements of this subdivision except that a building containing more than
two M animal units shall not be less than Lft J50) feet from a lot line.
C. Detached Single Familv Uses•
1. No accessorv use buildin .g or equipment shall be allowed within a required
front vard setback. With the exception of an attached garage, no accessorv
building structure or equipment may be placed within a front vard.
2 No building permit shall be issued for more than two (2) detached accessory
structures for each sin leg family dwellin , except bv conditional use permit.
3. No accessory building shall exceed the size of the principal structure.
4. Accessorv buildings greater than one hundred fifty (1501 square feet in size
shall complv with the following setbacks:

E. Swimmin Pg ools•
1 The interior vertical wall of swimming-pools shall not be closer than five (5)
feet to any side or rear lot line.
2. No swimming pool shall be located beneath or within ten (10) feet of anv
overhead utilitv lines or over anv undergyround utilitv lines.
3. All outdoor swimming pools shall be completely enclosed by a security fence or
wall at least four (41 but not more than six ffi feet high and located at least four
(4) feet from the edge of the pool. The bottom of the fence or wall shall be no
higher than four (4,) inches above the surface of the ground. Fence openings or
points of entry to the pool area shall be equipped with self-closing and self-
latching lockable gates. _

4 No swimming pool shall be used kept maintained or operated in such a manner
as to constitute a nuisance or as to be hazardous to health, life or propertv. All
swimmingpools shall have and operate adequate equipment to filter and

F. Conditional Use Permits. Application for a conditional use permit under this
subdivision shall be regulated bv Section 11.40 Subd. 4 of this Chapter. Such a
conditional use permit may be F-ranted provided that:
1. There is a demonstrated need and potential for continued use of the structure
and the purpose stated.
2. In the case of residential uses, no commercial or home occupation activities are
conducted within the accessorv building or attached garage.
3. The building has an evident re-use or function related to the princinal use.
4 The provisions of 11.40 Subd. 4.C of this chapter shall be considered and a
determination is made that the proposed activitv is in compliance with such
criteria.
Section 11.10 Subd. 6(Required Yards and Open Space) Add Subd. E. to read as follows:
E The following shall not be considered as encroachments on required yard setbacks:
1 Air conditioning or heating equipment chimnevs, flues, sills, vilasters, lintels,
ornamental features cornices eaves gutters, and similaz features, nrovided thev
