EAGAN, a municipal corporation, organized under the laws of the State of Mumesota,
(hereinafter referred to as the "City").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does
hereby grant and convey unto the City, its successors and assigns, a percvanent drainage and
utility easement, over, across and under the following described premises, situated within Dakota
County, Minnesota, to-wit:
A permanent draivage and utility easement over southwest 10'
along common lot line between Lots 35 and 36, Block 2,
Wilderness Ponds of Lot 35, Block 2, Wilderness Ponds.
The grant of the foregoing permanent easement for drainage and utiIity purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at a11
reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains;
and the further right to remove trees, brush, undergrowth and other obstructions. After
completion of such construction, maintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, saue
only for the necessary removal of trees, brush, undergrowth and other obstructions.
And the Landowner, its successors and assigns, does covenant with the City, its
successors and assigns, that it is the Landowner of the premises aforesaid and has good right to
grant and convey the easement herein to the City.

DRAINAGE AND UTILITY EASEMENT
THIS EASEMENT, made this~ da of 2001, between

EAGAN, a municipal corporation, organized under the ]aws of the State of Minnesota,
(hereinafter referred to as the "City").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does
hereby grant and convey unto the City, its successors and assigns, a permanent drainage and
utility easement, over, across and under the following described premises, situated witlrin Dakota
County, Miimesota, to-wit:
A permanent drainage and utility easement over southwest 10' RECEIVED - MAIL
along common lot line between Lots 35 and 36, Block 2, DEC 22 20U3
Wilderness Ponds of Lot 35, Block 2, Wilderness Ponds.

The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to constnxct, reconstruct, inspect, repair and maintain pipes, conduits and mains;
and the further right to remove trees, brush, undergrowth and other obstructions. After
completion of such construction, maintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessary removal of trees, brush, undergrowth and other obstructions.
And the Landowner, its successors and assigns, does covenant with the City, its
successors and assigns, that it is the Landowner of the premises aforesaid and has good right to
grant and convey the easement herein to the City.

IN TESTIMONY WHEREOF, the Landowner has caused this easement to be executed
as of the day and year first above written.

Drainage Concerns

As you are aware, the City of Eagan has recently completed drainage improvements
within ChesMar Drive to the southwest of your property which will provide enhanced
drainage for the rearyard portion of your property and will eliminate any of the drainage
concerns that you may have experienced in the past.
These drainage improvements were done by the City of Eagan through enforcement of
the development contract agreement for the Wilderness Ponds subdivision due to the
developer's noncompliance with proper drainage designs.
With the completion of this improvement by the City of Eagan, I feel confident that any
past or future drainage concerns have been properly addressed and resolved. If you

Corrective Drainage Work (Contract 92-05) ~
'Dear Mr. Fladland:
Recently, you contacted me regarding concerns expressed by a poterrtial buyer of your home regarding the uncertainty of corrective drainage improvements affecting your rear ;
yard area. While the history of this problem is complex, it basically resufts from the i
inadequacy of the developer's design engineer to properly handle surface water runoff i
within the Wilderness Ponds development.
Once the problem was recognized and corrective actions identified, it resuRed in a ;
protracted legal process to initiate the necessary corrective work. Due to the developer's !
reluctance to perform this under his own initiative, the Ciry Council formally declared the
developer in default of his contractual obligations. Subsequently, the City of Eagan
undertook the responsibilities for ensuring that this corrective work would be performed
in accordance with Ciry standards and requiremerits.
On August 5, 1992, the City Councii formally entered into a construction coritract with
Ryan Contracting to perform the necessary corrective improvements. This contract has ~
a firm completion date of November 15, 1992. Recognizing the concerns that you and ,
your neighbors have experienced during this process, the staff will make every effort to
try and have the contractor complete this project as soon as possible.

Attached are the results of the 11-27-91 meeting with City staff
and the developer for the Wilderness Ponds development. On
Tuesday's City Council aqenda is a Resolution authorizing
foreclosure of the financial security for the development.
As a result of the meeting, the developer was agreeable to the
following:
• Reduction of approximately $5,000 in negative escrow halance.
• Accepting responsibility for approximately $21,000 of the
storm sewer improvements with the City's share being
approximately $13,000.
• City takinq over project and provide the contract management
for the storm sewer improvements including easement
negotiations.
• The developer would pay escrow balance and provide a cash
escrow amount to cover storm sewer improvements plus a
contingency.
• The City would release the existing Letter of Credit.
After reviewing the above items with the City Attorney's Office,
Mr. Sheldon is recommending a continuation of the 12-3-91 Council
agenda item and preparation of a settlement agreement to present to
the City Council at their 12-17-91 meeting.

On Wednesday, November 27th from 3:00 until 4:30 p.m., Mike
Foertsch and John Wingard met with Douglas Turbak and Rick Sather.
Douglas Turbak is the developer of the Wilderness Ponds development
and Rick Sather is the engineer that designed the utilities and
streets for the developer. We discussed a solution to the storm
sewer drainage problem in the Wilderness Ponds development in the
backyards of Lots 36 and 35 of Block 2 along the east side of Ches
Mar Drive. The solution.that the City proposed at the meeting is
to construct the storm sewer system from Ches Mar Drive to the west
to Pond BP-11. Attached is Plan Sheet #1 of 1 of City Project #86-
RR entitled Wilderness Ponds Storm Sewer that shows the City's
layout of the storm sewer to resolve the Wilderness Ponds drainage
problem.
The City and the Developer agree that the ultimate solution to the
storm sewer problems of this area would be resolved if the storm
sewer as shown on Sheet 1 of 1 could be constructed. The Developer
was unable to obtain the easements to construct the proposed storm
sewer from John and Jo Ellen Dudycha who live on the west side of
Ches Mar Drive. The City has been able to obtain the easements by
extending the proposed storm sewer all the way to Pond BP-11. The
Dudycha's were unwilling to sign the easement with the layout
proposed by the Developer because they felt it might impact the
drainage on their property during large rainfall events and flood
their house. The City's layout provides 100 year rainfall
protection to the lots on Wilderness Ponds and to the Dudycha
property.
The Developer has stated that he does not feel responsible for
extending the storm sewer all the way to Pond BP-11. During our
meeting, the City proposed a solution by helping to finance the
proposed storm sewer project. The City's share would involve
construction from Pond BP-11 up to Manhole 105 which connects to
the existing 15" storm sewer that drains the Dudycha property. The
remaining portion would be financed by the Developer with an
exception of an extra catch basin that is proposed to be
constructed on Ches Mar Drive to collect runoff from Ches Mar
Drive.
Attached are copies of the cost estimate of the Wilderness Ponds
storm sewer with prices supplied by Ryan Contracting, Inc. on
October 10, 1991. The total cost of the project was estimated at
$34,469 as shown on page 1. Page 2 shows the developer's portion
of the cost estimate which amounts to $21,150. Page 3 shows the

City's portion of the cost estimate which totals $13,319. At the
meeting, the Developer agreed to pay his share of the storm sewer.
The City's portion is justified because of the improvements to the
drainage system on Ches Mar Drive and the extra protection that the
storm sewer will provide to the Dudycha house. The City will bid
this project during the winter and through the competitive bidding
process, hopefully get better prices. The City will do the
inspection and surveying and contract management of the project and
anticipate construction to begin in the spring of 1992. The
Developer has agreed to pay cash for his portion of the storm sewer
and is willing to provide a minimum of the $21,150 to the City in
anticipation of this project.
Attached is a five page itemized detail of the expenses charged to
date to the Wilderness Ponds development as prepared by the City of
Eagan Finance Department with latest revision date of November 21,
1991. The balance due by the Developer is $31,111. The Developer
has requested that $5,000 be removed from the balance due to the
City and then the Developer agrees to pay the total amount. The
reason why the $5,000 was requested to be removed is the
approximate cost to date by the City to design the proposed storm
sewer to resolve the Wilderness Ponds drainage problem. In our
meeting the Developer agreed to pay the balance of $26,111 and the
Developer then requested that no more time be charged to this
development. The Developer wants his Letter of Credit reduced so
that this project can be accepted by the City. Currently the City
holds a Letter of Credit from the Developer of approximately
$90,000 for this project.
In summary, Doug Turbak and Rick Sather both agreed that the City's
compromise of paying approximately $13,000 towards the storm sewer
construction plus not charging for the design inspection and
surveying of the storm sewer construction was very agreeable. The
Developer agreed to pay his share of the storm sewer which is
approximately $21,150 plus the balance of $26,111 for development
expenses.
