I'm sorry to find out that your conversation with Gail Sherrick, of QWEST Telecommunicarions, has le8 you less than satisfied. However, most of the information she provided you was correct. The current cable is a temporary setup for service to your new neighbor to the east. Under the difficult and costly winter construction conditions. we have here in Minnesota, it's the normal scenario for new telephone service, stringing the cable above ground til Spring. I regret that you weren't contacted by QWEST about the installation of this temporary service line for your neighbor. Communicarion between private utility companies and their customers (our residents) is very important, something we here at the City strive for whenever a new project arises in Eagan. I've contacted QWEST to try to improve this situation for both parties. Mark Hemmesch, of QWEST, will be contacring }rou (or possibly has hy t6e time you receive this letter) and work with you to recrify the situarion. Perhaps he will give you the letter you seek. Regardless, this is a matter between you and QWEST at this point.ln the Spring, when the service line is placed underground, QWEST will apply for a Right-of-WaylEasement permit with the City and then City engineering staff will check all work and restoration of the site affected by the construcrion of this project for conformance to City specifications. Later I found through numerous ca11s that the wire was a telephone wire connecting the service to a house at a considerable distance from my home. It is my understanding based upon a ca11 from "Gayle" that the wire would remain until Spring and that no further action to burying or warn of the presence of the wire strung on the ground and hung loosely on my fence (and neighbor's fence) at the back of my property. I was informed that the wire was on the 5-foot easement and the company had the right to place the wire in this easement area. I raised the issue of liability in case of an accident on my property due to tripping or getting tangled up in the loose wire and requested something in writing stating that the wire did not pose a hazazd and that the home owner was not responsible for its presence or safety. "Gayle" informed me that they (her company) was not responsible for such a letter and that I should contact Eagan City Hall engineer for such a letter. I am at this time requesting in writing the approval of Eagan City HaII engineering deparhnent for the current stringing of the telephone line on the ground of my property. The wire is black and has no warning of its presence on the ground.
