This memo is in regards to the retaining wall constructed behind
the home located on Lot 8, Block 2, Wilderness Ponds. It was
requested of the home builder to submit a set of plans to the City
prior to the construction of this wall thereby allowing us to
analyze his proposal. The builder failed to submit plans and the
Enqineering Department is concerned with the soil stabilization,
structural integrity and potential public hazard associated with
this wall. It is recommended that a registered structural engineer
and soils engineer certify to the City that this wall complies to
all regulations, industry standards and that it is structurally
sound grior to issuing a certificate of occupancy.

As you are aware, there has been an ongoing problem with the
excavation of Lot 8, Block 2, Wilderness Ponds. This
unauthorized removal of material has been causing problems with .
erosion and the loss of several trees as well as becoming a
hazard. Please be aware that this excavation is not in
compliance with the approved grading and erosion control plan and
any variation to the approved plan in excess of 2,000 yards
requires a separate grading permit unless it is due to the
construction of a home to which a building permit has been
issued. Further, non-compliance of this site excavation will
result in the issuance of citations.
It is further necessary to restore this lot as originally
proposed to eliminate the hazards and reduce the erosion and loss
of trees. The City will be expecting completion of restoration
of this lot by June 1, 1989. Please contact me at 454-8100 if

original amount of the assessments and the payoff amounts of the
