A. Vacate Portion of Drainage & Utility Easement (Lot 6, Block 1, Windtree 3rd
Addition)--On September 4, 1990, the City Council considered and subsequently denied
a sideyard setback Variance for this referenced parcel. During that Variance application
process, it was discovered that the existing house was inadvertently located within the
common lot line drainage and utility easement on the east side of this parcel.
Subsequently, the property owner submitted a petition requesting the vacation of a portion
of this side lot line drainage and utility easement. This petition was presented to the Ci_ty
Council on Novembei 6 with the public hearing originally being scheduled for December
4. However, it had to be continued until December 18 to ensure proper notification of
all potentially affected parties. Enclosed on pages through is a sketch and
legal description pertaining to the portion of the easement requested to be vacated and
a letter from the affected property owner. Al] notices have been published in the legal
newspaper and sent to all potentially affected parties informing them of this public hearing
on December 18. As of this date, the staff has not received any objections to the
proposed petitian.
ACITON TO BE CONSIDERED ON 'i'HIS ITEM: To close the public hearing and
approve the vacation of a portion of the side ]ot line drainage and utility easement as
described on Lot 6, Block 1, Windtree 3rd Addition.

W. Renew Joint Powers Agreement For Striping, Sweeping & Seal Coating--Every year,
the communities of Savage, Burnsville, Lakeville, Apple Valley, Rosemount and Eagan
have entered into a Joint Powers Agreement to combine our contractua] needs for traffic
markirigs/striping, street sweeping and/or seal coating to achieve the best prices under the
economies of scale theory. This agreement is again being presented to the City Council
for ratification and approva] for the 1991 construction season. It has been reviewed by
the Director of Public Works and found to be in order for favorable Council action.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the 1991 Joint Powers
Agreement for contractua] striping, sweeping and seal coating services.

APPLICATION SiJMMARY: An application has been submitted requesting a Variance
of 4' from the required 10' side yard setback. Review of this request revealed an exdsting
setback violation that will require an additional Variance of 2' from the required garage
setback of 5' on the opposite side of the lot.
BACKGROUND: The applicant added a third garage stall in March of 1989. Based on
the original site survey, this stall was set back 13' from the applicant's south property line.
However, the applicant had a new survey prepared in consideration for his proposed
three-season porch and this survey shows the house hadn't been placed where the otiginal
survey displayed, but shifted approximately 10' to the east. Because of this, the garage
now encroaches 2' into the setback area, as well as the drainage and utility easement.
COMMENTS: The applicant would like to build a 14' x 15' three-season porch off the
northwestern portion of his house. The house currently exceeds the required setback on
this side by 10'; however the proposed addition will encroach 4' into the setback area.
The applicant also needs a 2' Variance granted to accommodate an eldsting setback
violation on the garage side of his lot. Because the garage encroaches into the easement,
the applicant must petition the City for an easement vacation.
The applicant performed some excavation and had a retaining wall built prior to locating
his ]ot lines. To accommodate the proposed porch, the City must grant two Variances to
the applicant's ]ot. It appears the lot is just not big enough to entertain this proposal.
The applicant could avoid the proposed Variance by relocating the placement of the porch
or by scaling down the size of the porch to 10' x 15'.
If approved, these Variances shall be svbject to:
1. Easement along the southeast side property line shall be vacated prior to any
building permits being issued.
2. All other applicable City Codes.
