I appreciate you working with me on this project and accommodating my lack of
"planning/engineering speak" as we work to resolve this issue.
In an effort to comply with the concerns expressed regarding the playhouse built in 2010,
I have had discussions with 3 separate structural engineers (as well as calls to Lamperts
and Mendards) since we last had written communication. I have engaged one structural
engineer to ensure that the playhouse roof specs meet the city requirement of having the
rafters/trusses signed off by a Structural Engineer or getting the roof rafters/trusses
manufactured and stamped. All of the engineers expressed confusion as to why the city
would require an structural engineer sign off on the roof (or stamped trusses) if the
playhouse is 120 square feet or smaller and a permit was not needed. I replied to them
that the city wanted assurances that the playhouse is safe, which is my goal as well.
In your letter dated September 15, 2011 you state: "It appears that your accessory
structure is not built to the building code minimum." In previous conversations/emails
with you, I provided requested information on beam size, joist direction and spacing and
beam connection detail. From my understanding the remaining concerns of the city were
the roof rafter/truss engineering sign off and the requirement for the stairs/railings to be
in compliance with code, including not more than 4" railing spacing. The stairs and
railings have since been modified to comply with code after the engineer did an initial
site visit. If there are other issues that need to be addressed which were not discussed
previously, please provide further specifics as to the concerns.
A Zoning Permit was not originally required when I designed and built the playhouse in
2010. Your letter dated September 15, 2011 has requested that I complete a Zoning
Permit, even though this is a new requirement effective June 21, 2011, after the
playhouse was designed and built. However, in an effort to see this issue to acceptable
resolution, I have attached a complete Zoning Permit along with the original drawings
you and I have shared back/forth and a copy of my property survey showing the location
of the playhouse on the property. I this point I have not received drawings from the
engineer.
I believe the only outstanding issue at this point is modification of the roof height so that
it meets the requirements that "no inside wall height shall exceed 8 feed as measured
from the floor to the roof decking." Since the city is requiring me to either have a
Structural Engineer sign off on the modified roof I proposed or have custom stamped
trusses manufactured, this has delayed completion of the project as I explored options and
worked to engage a PE who was willing to do a site visit and take on such a small project.
As you can tell by my engagement of a Structural Engineer, I am committed to resolving
this issue. I have documentation of discussions with 2 other PEs and an email sent to
Lamperts, so please understand that this is not something that has been ignored since we
have spoken. I have had numerous phone calls as well with PEs and Lamperts, and two
visits to Menards as well. The active robin's nest that was built on the roof beam also
delayed the project as I could not destroy an active nest that my 4 and 7 year old children
were aware of. This year I learned that robins can lay three sets of eggs almost
immediately in succession in the same nest in a year!
I am requesting an extension for compliance given I do not have the engineering
drawings at this point and the city needs time to review the Zoning Permit and advise on
next steps. Given the impending harsh winter where I cannot perform
demolition/reconstruction, I will lock the playhouse and ensure that we are in agreement
between the city, the engineer, and myself before demolition/reconstruction occurs. I
will ensure that the playhouse remain locked and is not used until all modification is
completed by spring and it meets the inside wall height requirement (including Structural
Engineering sign off of the roof trusses).
