This Escrow Agreement ("Agreement") is entered into as of this .5-+ day of
r, 2000 by and between the City of Eagan, a Minnesota municipal corporation
ity"), Kenneth Greene and Jane Greene, husband and wife ("Greenes") and Joseph Henry and
Kelly Henry, husband and wife ("Henrys"), collectively referred to as the "Parties".
WHEREAS, the Greenes aze owners of Lot 1, Block 1, Verdant Hills in the City of
Eagan, County of Dakota, State of Minnesota (the "Property"); and z
WHEREAS, the Greenes have requested the City to approve a proposed subdivision of
the Property to form Lots 1 and 2, Block 1, Verdant Hills 2"d Addition; and
WHEREAS, the Henrys aze or will become owners of Lot 2, Block 1, Verdant Hills 2"a
Addition; and
WHEREAS, in connection with the approval of the subdivision the City has required the
existing residence located on the Property to be connected to City sanitary sewer and watermain
systems; and
WHEREAS, in connection with the approval of the subdivision the City has required that
all wells and septic systems located on the Property be abandoned in accordance with the City
and Dakota County standazds; and
WHEREAS, the Greenes and Henrys have requested the City to aliow the Greenes until
April 30, 2001 to complete the connection of City sanitary sewer and watermain systems to the
existing home on the Property and to abandon all well and septic systems on the Property; and
WHEREAS, the Greenes are willing to deposit in escrow with the City, funds for
connecting the existing home on the Property to City sanitary sewer and watermain systems and
to abandon all wells and sepric systems on the Property.
NOW, THEREFORE, in consideration of the foregoing and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, the Parties hereby
agree as follows:
1. The Greenes shall complete connection of the City sanitary sewer and watermain
systems, to the existing home on the Property prior to Apri130, 2001.
2. If the Greenes fail to furnish proof to the City by May 10, 2001 that the wells and
, septic systems on the Property have been abandoned, the City shall retain the funds deposited for
that purpose.
3. The Greenes and Henrys shall abandon all wells and septic systems within the
Property in accordance with the City and Dakota County standards prior to Apri130, 2001.
4. The Greenes shall pay upon execution a non-refundable connection fee of
$2,892.50 as itemized om the attached Exhibit "A".
5. The Crreenes shall deposit funds with the City in the amount of $2,800.00, which
amount is two times the estimated cost of constructing and connecting the sanitary and
watermain utilities to the existing home on the Property.
6. The Greenes shall deposit funds with the City in the amount of $8,000.00, which
amount is two times the estimated cost to abandon the well and septic systems contained on the
Property.
7. Upon the Greenes fumishing proof to the City that the existing home on the
Property has been connected to the City sanitary sewer and water main systems, the City shall
release the ftutds escrowed for this purpose.
8. Upon the Greenes fiunishing proof to the City that the well and septic systems on
the Property have been abandoned in accordance with the City and Dakota County standards, the
City will release the funds escrowed for this purpose.
9. If the Greenes fail to furnish proof to the City by May 1Q 2001 that: (1) the
existing home on the Property has been connected to the City sanitary sewer and water main
systems; and/or (ii) the existing wells and septive systems have been abandoned in accordance
with the City and Dakota County standards, the City shall retain the funds deposited as a
forfeiture.
10. The Henrys agree to insure that all wells and septic systems within the proposed
Lot 2, Block 1, Verdant Hills 2nd Addition will be abandoned in accordance with the City and
Dakota County standards prior to Apri130, 2001.
11. Any cross easement in effect between the proposed Lot 1 and Lot 2, Block 1,
Verdant Hills 2"d Addition for use of well and septic systems will not extend beyond April 30,
2001.

ESCROW AGREEMENT
This Escrow Agreement ("Agreement") is entered into as of this 5+L, day of
Sl~er , 2000 by and between the Ciry of Eagan, a Minnesota municipal corporation
("City"), Kenneth Greene and Jane Crreene, husband and wife ("Greenes") and Joseph Henry and
Kelly Henry, husband and wife ("Henrys"), collectively referred to as the "Parties".
WHEREAS, the Greenes are owners of Lot 1, Block 1, Verdant Hills in the City of
Eagan, County of Dakota, State of Minnesota (the "Pxoperty"); and
WHEF2EAS, the Greenes have requested the City to approve a proposed subdivision of
the Property to form •Lots 1 and 2,.Black 1, Verdant Hills 2nd Addition; and
WHEREAS, the Henrys are or will become owners of Lot 2, Block 1, Verdant Hills 2"a
Addition; and
WHEREAS, in connection with the approval of the subdivision the City has required the
existing residence located on the Property to be connected to City sanitazy sewer and watermain
systems; and
WHEREAS, in connection with the approval of the subdivision the City has required that
all wells and septic systems located on the Property be abandoned in acwrdance with the City
and Dakota County standards; and
WHEREAS, the Greenes and Henrys have requested the City to a11ow the Greenes until
April 30, 2001 to complete the connection of City sanitary sewer and watermain systems to the
existing home on the Properiy and to abandon all well and septic systems on the Property; and
WHEREAS, the Greenes aze willing to deposit in escrow with the City, funds for
connecting the existing home on the Property to City sanitary sewer and watermain systems and
to abandon all wells and septic systems on the Property.
NOW, THEREFORE, in consideration of the foregoing and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, the Parties hereby
agree as follows:
1. The Greenes shall complete connection of the City sanitary sewer and watermain
systems, to the existing home on the Property prior to April 30, 2001.
2. If the Greenes fail to furnish proof to the City by May 10, 2001 that the wells and
septic systems on the Property have been abandoned, the City shall retain the funds deposited for
that purpose.
3. The Greenes and Henrys shall abandon all wells and septic systems within the
Property in accordance with the City and Dakota County standards prior to Apri13Q 2001.
4. The Greenes shall pay upon execution a non-refundable connection fee of
$2,892.50 as itemized on the attached Exhibit "A".
5. The Greenes shall deposit funds with the City in the amount of $2,800.00, which
amount is two times the estimated cost of constructing and connecting the sanitary and
watermain urilities to the existing home on the Property.
6. The Crreenes shall deposit funds with the City in the amount of $8,000.00, which
amount is two times the estimated cost to abandon the well and septic systems contained on the
Property.
7. Upon the Greenes furnishing proof to the City that the existing home on the
Property has been connected to the City sanitary sewer and water main systems, the City shall
release the funds escrowed for this purpose.
8. Upon the Greenes furnishing proof to the City that the wel] and septic systems on
the Property have been abandoned in accordance with the City and Dakota County standazds, the
City wiil release the funds escrowed for this purpose.
9. If the Greenes fail to furnish proof to the City by May 10, 2001 that: (1) the
existing home on the Property has been connected to the City sanitazy sewer and water main
systems; and/or (ii) the existing wells and septive systems have been abandoned in accordance
with the City and Dakota County standards, the City shall retain the funds deposited as a
forfeiture.
10. The Henrys agree to insure that all wells and septic systems within the proposed
Lot 2, Block 1, Verdant Hills 2°d Addition will be abandoned in accordance with the City and
Dakota County standazds prior to April 30, 2001.
11. Any cross easement in effect between the proposed Lot I and Lot 2, Block 1,
Verdant Hills 2"d Addition for use of well and septic systems will not extend beyond April 30,
2001.

error was additional interest related to Waiver #559, which you signed as a condition of

Dear Mr. Hedges:
Thank you for the copy of your recent letter to the Widstrom's
informing them of the Ordinance violation. Confirming our
telephone conversation today, I do want the Ordinance enforced.
As we discussed, I have no objection to the Widstrom's operating
the business or office portion of their trucking business
from their home; what I do object to is the truck traffic,
maintenance, and parking. Not only is it in violation of the
Ordinance, it is unsightly, depresses the value of my property,
and is a danger on our road.
With the several other trucking companies operating within the
City of Eagan from property zoned locations, the Widstrom's
should have no problem relocating the trucks.
I appreciate your cooperation in bringing this matter to a
prompt resolution and enclose for your convenience a copy of
my original letter dated 30 days ago. Please do not hesitate
to call me if further action is required on my part.

Dear Mr. Hedges:
I am writing to inform the City of the operation of a trucking
business from the Widstrom residence at 3560 Trails End Road.
As of this date there are two tractors, one dump truck, and
four trailers on the premises. During the day there.are'-at
least three non-family vehicles parked there which I presume
belong to d=ivers. .
I object to the operation of a commercial business of this type
from a residential neighborhood. It is not only unsightly and
out of character for the neighborhood; I am sure it puts a strain
on our gravel road in terms of maintenance. The City maintenance
_ department does an exceptionally fine job of keeping up the
road and plowing in the winter, which I appreciate. I would,
_ however, hope that in these times of ever increasing cost of
municipal services our road is not receiving special treatment
at tax payers expense because of heavy usage. Trails End Road
is a dead end road with service to four residential driveways.
A comparison of city records of plowing and maintenance between
this road and others of a similar nature will indicate if special
service is being given.
If the operation of this business is in violation of any City
Ordinance, I would like the Ordinance enforced. If any license,
permit,or zoning variance is required, I would like to be informed
of any hearings before they are qranted or renewed. In the event
that this business can be legally operated as is, please advise
me of the appropriate group (planning commissioner and/or City
Council) to bring my objections before.

AGREEMENT RELATING TO PRIVATE DRIVEWAY
This agreement made this /~~L day of (.~=7-~f,-~--J , 1990, by
and between the CITY OF EAGAN ("City"), a Minnesota municipal
corporation, and BRAD 'A'. STRICKER, a single person, hereinafter
referred to as Landowner.
RECITALS
WHEREAS, the undersigned Landowner is the owner in fee of certain
real property located in the City of Eagan, County of Dakota, State
of Minnesota, and more particularly described on the attached Exhibit
A hereto.
WHEREAS, Birch Street is a dedicated right-of-way according to
Easement Document No. 369340 which document is on file and of record
with the Dakota County Recorder.
WHEREAS, said Birch Street in part abuts the property described
on the attached Exhibit A owned by the Landowner.
WHEREAS, said Birch Street has not been opened or improved by the
City and has not otherwise been opened to public vehicular traffic
for that portion of Birch Street described as.follows:
That portion of Birch Street lying west of the
westerly right-of-way line of Sunwood Trail.
WHEREAS, the above-described portion of Birch Street that has not
been opened to public vehicular traffic and has not been improved by
the City is that portion which would otherwise serve as access to the
property described on the attached Exhibit A.
WHEREAS, the Landowner has requested that the City approve a
private driveway over ti:e unimproved and unopened portion of Birch
Street.
WHEREAS, the City ordinance does require that a buildable lot
under the zoning code and subdivision codes o£ the City have frontage
along or abut a publicly dedicated and open roadway or, in the
alternative, have a private driveway approved by the City Council of
Eagan.
WHEREAS, the City of Eagan is willing to allow the Landowner to
use the unopened and unimproved portion of Birch Street for purposes
of a private driveway subject to the terms and conditions hereinafter
stated.
NOW, THEREFORE, THE CITY OF EAGAN AND THE UNDERSIGNED LANDOWNER,
FOR HIMSELF AND AIS SUCCESSORS, HEIRS AND ASSIGNS DO HEREBY AGREE:
1. Under the terms and conditions stated herein, the Landowner is
hereby authorized by the City to use the unopened and unimproved
portion of Birch Street previously described as a private driveway
for the limited purpose of providing access to the real property
described on the attached Exhibit A.
2. Nothing contained herein shall be deemed an opening or an
improvement by the City of the unopened and now unimproved portion of
Birch Street.
3. Nothing contained herein shall be deemed an assumption by the
City of any responsibility for construction, maintenance or repair of
the unimproved and unopened portion of Birch Street to be used by the
Landowner as a private driveway.
4. Nothing herein contained shall be deemed a waiver or
abandonment or transfer of the right, title and interest that the
City of Eagan holds to Birch Street by reason of the dedication of
said Birch Street, including the unimproved and unopened portion
thereof.
5. The private driveway to be used by Landowner is subordinate to
the dedication of Birch Street to the City.
6. The Landowner shall be responsible for all costs relating to
construction, maintenance and repair, including grading and snow
removal with respect to use of the private driveway.
7. At his expense, the Landowner shall record with the Dakota
County Recorder a certified copy of this Agreement, within 30 days of
City Council approval of this Agreement.
8. No structures shall ue placed on the private driveway.
9. The approval given herein by the City is contingent upon all
the conditions expressed herein being met and continuing to be met.
10. The private driveway shall not be used in a manner
inconsistent with the City's right, title and interest in the
dedicated portion of Birch Street, including the unimproved and
unopened portion thereof.
11. The Landowner does hereby agree that when the unopened or
unimproved portion of Birch Street is opened to the public or
otherwise improved by the City, then the private driveway as
contained within the unimproved and unopened portion of Birch Street
will be removed by the Landowner at no expense to the City, but at
the expense of the Landowner. The City will require that the driveway
from the street to the property line will be asphalted or concrete
paved at the time of the road improvement.
12. The Landowner agrees that if the unopened and unimproved
portion of Birch Street is improved and opened to public vehicular
traffic, and if special assessments are levied against the property
described on the attached Exhibit A pursuant to Chapter 429 of the
Minnesota Statutes, then the Landowner shall not object to the levy
of special assessments on the ground that the property described on
Exhibit A had existing access from Birch Street. The Landowner, for
himself, his heirs and assiqns does hereby waive any objection to
said special assessments based on the grounds so specified in this
paragraph.
13. This agreement shall be binding upon the undersigned parties
and their successors, heirs and assigns. This agreement shall run
with the property described on the attached Exhibit A and be binding
upon the owner thereof and his heirs and assigns.
14. The Landowner and his heirs and assigns and successors in
interest does hereby agree to defend, indemnify and hold the City
harmless from all costs and expenses, claims and liability relating
to or arising out of the construction, maintenance, use, operation,
interruption, discontinuance, abandonment or termination of the
private driveway.
15. Prior to any residential occupancy permit being issued for
any structure on the property described on the attached Exhibit A,
the Landowner shall construct a private driveway on the unopened and
unimproved portion of Birch Street according to the specifications
described on the attached Exhibit B.
16. The Landowner, and his heirs and assigns and successors of
interest shall be responsible for maintenance and repair and
reconstruction of the private drivewey at all times and under all
conditions the private driveway shall be accessible and available to
emergency vehicles, such as fire trucks and policy and ambulance
vehicles.
IN WITNESS WHEREOF, the parties have executed this agreement the
day and year first set forth above.
