Hello,
wnUng today, May 22, 2000, conceming on going erosion problems with
adj ning property at 3591 Woodland Court Jay Sheehan and I Irve at 3587
Woodland Court. We discussed erosion issues with you two weeks ago after the
first occurrence, on May 6. i am writing ro let you know that it happened again
after rain last week from May 18. We are waibng for clean up.
The property @ 3591 is under consVuction with Vennehejm Construction. After
the first occurrence, Vennehejm's solution was to cover the dirt with straw.
This was obviously not a viable solution, given the slope of the hill.
Actually, I specifically stated that this would not work, asking for you see it
first hand. The last we taiked you and another inspector were gomg out to the
property.
A mud slide last week caused the dirt, straw and debris to land up against our
fence, which is now holding back a ton of muck. The fence was installed April
14, 2000. Within one month, it has bom the brute weight of 2 ft of run off per
occurrence. In addition, our sod was damaged, we lost 2 Mums and a Maple
sapling planted the prior weekend. Nothing has been done to replace those.
This is unacceptable. Be advised that if the sod dies, we will be seeking
replacement.
With a second occurrence in two weeks, we have reason for long term concem.
While Vennehejm has the equiPment to deal with clean up, the new owner will not
have those resources. Something must be done before the owners move in. The
grade of the Iot is the source of the problem and is onty accentuated by forces
of nature. While mild rains have caused the damage to date, severe weather will
be devastating. During construction excavation, last September, there were
discussions conceming erosion control with both the owners and buitder. Both
of them fully comprehend the scope of the issue.
This is not acceptable and will no longer be tolerated. Eagan City Code
Chapter 13 and City Code Chapter 10 exists to protect exisfing home owners. The
City must enforce the law to ensure that a third occurrence is prevented.
