APPLICATION SUMMARY: An application has been snbmitted by Dale
Johnson requesting a Variance of 5' to the required 10' side yard
setback.
COMMENTS: Lot 14, Block 3, The Woodlands Addition,. has a 50'
Williams Pipeline Co. Easement (Per poc. #826207) running the
entire length of the north property line. 7'his easement
substantially restricts the location of the home on the lot. The
intended location of the home will meet or exceed all other
setback requirements and will not be located within a drainage or
utility easement.
The applicant is requesting the Variance for the following
reasons:
1. To accomodate a substantial private home and retain the
intended character of the development with restrictions by
the pipeline easement.
2. To preserve the natural beauty and trees on the lot.
3. To accomodate a walkout home with the least amount of
disruption to the natural terrain and wilderness.
If approved, this Variance shall be subject to all other Code

TBMPORARY STREET EASEMENT DEED
THIS INDENTURE, made and entered into this -16rk day of
3A&4L,~ , 1988, by and between THE WOODLANDS OF EAGAN LIMITED
PARTNERSHIP, a Minnesota Limited ParCnership, as Grantor and the
CITY OF EAGAN, Dakota County, State of Minnesota, as Grantee.
WITNESSETH WHEREAS, said Grantor is the owner of the tracts of
land in the City of Eagan, Dakota County, Minnesota, legally
described as follows: That part oE Lot 14, Block 3, and Outlot A,
The Woodlands, according to the recorded plat thereof, Dakota
County, Minnesots, lying southeasterly, northeasterly and
northwesterly of the following described line:
See Exhioit A attached hereto and made a part hereof.
Said temporary easement to expire upon the platting and
construction of Woodland Trail north of said Outlot A.
NOW THEREFORE, the said Gcantor in consideration of One ($1.00)
Dollar and other good and valuable consideration to it paid by
Grantee, receipt whereof is hereby acknowledged, hereby conveys,
warrants and dedicates to said Grantee, its successors and assigns,
for street purposes, together with the unrestricted right to improve
the same, the above described tracts of land, together with the
right to lay, maintain, operate and repair utility lines over and
through said above tract, free and clear of all encumbrances, except
for cestrictions, reservations and easements of record, if any.

administratocs and assigns does covenant never to cut, damage,
destroy or cemove any tree or shrub or othar natural growth upon the
