Followinq is a list of events that have taken place with regard to
the Waterford Apartment project and the applicant's request not to
provide the buildings with a fire sprinkler system.
1. The Waterford Apartment project has been submitted to the City
on and off for approximately two years.
2. On July 16, 1990, the 1990 State Building Code was adopted.
The requirement for fire sprinkler systems in the waterford
Apartments is part of that Code.
3. The Eagan City Code requires compliance with the State
Building Code and is currently beinq updated to the 1990 State
Building Code by the City Attorneys Office. At present, it
requires compliance with the 1987 State Building Code.
4. The Ventana Corporation should have been aware of the
requirement for the fire sprinkler system as it is stated in
the 1988 edition of the U.B.C. which is adopted as part of the
1990 State Suilding Code and has been available since 1988.
Although the process for adopting the State Buildinq Code can
be very lengthy, it is possible to track it and be aware of
the timing of its adoption.
5. After adoption of a new Code, the City generally allows a
qrace period for development that has been in the planning
process. The length of time allowed has depended on the type
of project, how lonq information on the new codes has been
available to the public, and when the new code documents are
available for purchase.
6. In August 1990, the Ventana Development Corporation contacted
Dale Runkle regardinq the requirement for fire sprinkler
systems in all, or part, of the project. At that time, they
were informed that the two buildinqs proposed for the platted
lots could be built without the sprinkler system. The
remaininq buildings would have to comply with the requirements
of the Code in effect at the time of permit issuance.
Although no date was set as a deadline for applyinq for the
first two permits, it was our understandinq from the urgency
of their request that it would be within the month of August.
The next contact we had with Ventana was in mid-October when
James Stirton met with the Inspections Department to again ask
about deleting the fire sprinkler system from the project. At
this time, we informed him that we would still honor the
agreement to allow the first two buildinqs to be constructed
without the aprinkler system if the permits were issued by
November 9, 1990. We also informed him that we could not
approve the request for elimination of the sprinkler system on
the remaininq buildings because by the time the plattinq was
completed, it would be too long after the July 16, 1990
adoption of the new Code to justify it. We discussed his
options as follows:
a. Request the council to approve issuance of the permits
for the remaining buildings immediately upon completion
of permit application submittal and prior to platting.
b. Request the Council to overrule the State Building Code
requirement.
c. Pick up permits for the first two buildings by November
9, 1990, building them as agreed, and build the remaining
units with the fire sprinkler system.
d. Discontinue the project.
It is the opinion of the Inspections Department that unless the
Council approved issuance of the permits for the remaining
buildings prior to platting, we should not allow those buildings to
be built without fire sprinkler systems. If the Council chooses to
do that we would like the following conditions placed on the
approval:
CONDITIONS:
1. The permits for the first two buildings must be paid for on/or
before Novembei 9, 1990.
2. The permits for the remaining buildinqs must be paid for by
November 16, 1990.
3. The plat must be recorded by a date approved by the Council.
4. Construction of the remaining buildings must beqin within 30
days of the final plat.
We would like the Council to understand that if there was a fire in
one of the buildinqs, and the question of why they were not
sprinklered came up, it would be their responsibility to provide an
answer to that question.

We have completed our review of the plans and specifications which were submitted for the
above-referenced project. It is our hope that this report will be of benefit to you in
achieving a project that complies with the various state and 1oca1 codes, laws and ordinances.
l. Certification by the appropriate design professional must be shown on each sheet of
the plans. Please submit two signed and certified copies of sheets El through E4 and
E6 - Minnesota rules, part 1800.4200 and UBC, section 302(b).
2. The original automatic fire sprinkler design must be done and certified by a licensed
professional engineer - Minnesota rules, part 1800.5200 and UBC, section 302(b).
3. Please note that the Uniform Building Code Standards referenced in the building
code (a list of the standards occurs in Chapter 60) are a part of the code. Other
standards providing equivalent performance may be used only when such alternates
are approved by the building official under the provisions of section 105 of the
building code - UBC, section 6001.
4. Submit energy calculations substantiating compliance with the Minnesota Energy
Code - MEC, section 104.2.
5. Verify that the proposed lighting power budget complies with MEC, section 505,
Subpart 2, as amended by Minnesota rules, part 7670.0800.

, 6. Please obtain all the proper acknowledgment signatures on the "Special Inspection
and Testing Schedule" as per our phone conversation. Each special inspector must
submit a final inspection report to our division before a Certificate of Occupancy will
be issued for the building - UBC, sections 302(c) and 306(c), item 3.
7. Provide handicap parking sigiis positioned so as to be visible from inside the vehicle
parked in the space - Minnesota 5tatute; 169.346.
8. A janitor's service sink must be provided on each floor level (this includes the
basement floor level) - Minnesota rules, part 1305.1795 Table 5-E.
9. An approved barrier (gate) must be provided in stairway'B' at the ground-floor level
to prevent persons from accidentally continuing into the basement - UBC, section
3309(e).
10. Provide an exit sign in stairs 'B' at the exterior exit door - UBC, section 3314.
11. Verify that Door ol is an automatio-closing fire assembly with smoke gasketing as per
architect's proposal of March 25.
12. If Door 119 is installed, it must not be provided with a lock (special egress-control
devices per UBC, section 3304(e) would be permitted) - UBC, section 3303(a).
13. First and second floor corridor systems, including lobbies, reception areas, and
vestibules, must be provided with a smoke detection system - UBC, section 3305(g),
Eacception #5.
14. Provide space for recyclable materiafs - UBC, section 515, as amended by Minnesota
Rules, part 1305.1775.
15. Provide certified drawings of partition layout, etcetera, for the Metropolitan Federal
Bank tenant portion of building - UBC, Section 302(b).
16. Ductwork openings (except for independent stair pressurization) into stairway
enclosure, Stair 'B' for example, is prohibited - UBC, section 3308(c).
17. Fire dampers must be installed in ductwork penetrating the fire-resistive
corridor/lobby area Ol - UBC, section 43060) item no. 5.
18. Fire-resistive corridor/lobby No. Ol shall not be used to convey air to or from rooms -
UMC, section 1002(a), paragraph 2.
19. Verify ventilation system complies with MEC, section 303.1 as amended by Minnesota
rules, pan 7670.0450.

' 20. Verify integrity of fire-resistive shaft protection for ductwork at pantry 06 area -
UBC, section 1706(a).
21. Verify that the ceramic tile or base in toilet rooms extends upward onto the walls at
least 5 inches - UBC, section 501(b).
22. Where a specifio requirement of Minnesota rules, Chapter 1340, provides for
minimum standards more stringent than those of the federal Americans with
Disabilities Act (ADA), that specific Chapter 1340 requirement wil] apply.
23. The fire department hose connection shall be located near the front entrance to the
building - UFC, section 10.305(b).
24. Alcoves for handicap accessible drinking fountains shall be a minimum of 32" wide -
UBC, section 511(c).
25. Verify that all doors protecting basement corridor/lobby Ol have smoke gasketing in
compliance with UBC, section 3305(h).
26. Verify that stairway enclosure doors OB, 1BA, and 2B are listed for temperature rise
in compliance with UBC, section 3309(c).

Concerning the above mentioned Item, I would Ilke a ruling on the
5" ceramic tfle base. I have spoken with Jeff DeJarlais, Pian
Review Sectlon, Bullding Codes Division, State of Minnesota for
his departments' interpretation of ihis item, since this is the
flrst time I have had it questioned.
We have specified ceramic tile to the 61-8" heig.ht in the toilet
compartments, and typfcal 4-1/411 ceramic tile base In the area
contalning the vanlty with lavatories. Mr. DeJarlais said this
is consistent with his reading of 510 (b), saying the 5" base
applies only to tollet areas, not lavatory and make-up areas.
He a I so poi nted out that the UBC states the ru I es must work
within the use of standard manufactured materiais. Standard
ceramic tile and coved base are 4-114" high, plus foints, and
have been accepted, without question, on every other proJect I
have worked on for over thirty years. Having cleaned more than a
few f loors in my I ifetime, I do not thfnk 1/2" of tf le wi I I
reduce "mop slop".
As Mr. DeJarlais pointed out, regulations speak of many materials
wfth dimensions that are actually nominal, not real dimenstons.
