We have provided construction observation and testing services and UBC "Special Inspections"
for this project in accordance with the executed Confirmation and Agreement for Services to you
dated May 25, 2000 and your Purchase Order No. 11922. Our testing and inspection was
performed intermittently during the time period of June through September, 2000.
Requested Scope of Services
Our construction observation and testing and special inspection was performed in accordance
with our proposal, as described in our field reports submitted under transmittal cover letter. To
date, we have submitted transmittal letters dated June 19, June 28, July 6, July 11, July 18, and
August 2, 2000. A transmittal letter discussing testing of pavement subgrade soil will be
submitted in the neaz future. The following services were perfoaned on a part-time, as-requested
basis.
1. Observation and testing of excavation base soil during site grading.
2. Observation and testing of foundation bearing soils to determine suitability for the design
bearing pressure.
3. Observation and testing of foundation wall backfill.
4. Observation of foundation and foundation wall reinforcing steel for compliance with project
requuements.
5. Perform field testing of fresh concrete and field and laboratory testing of concrete test
cylinders cast for foundarions, foundation walls and slab-on-grade to determine ihe
compressive strengths.
6. Observation and testing of pavement subgrade soils to determine suitability for continued
construction.
Handwritten field reports were prepared by our representatives for each day they were on-site.
These field reports were reviewed by Mr. Steven J. Ruesink, P.E., Senior Project Engineer, and
submitted under transmittal cover letter (subgrade soil still to be transmitted). Concrete
compressive strength reports were mailed out sepazately as the tests were performed.

We have completed our review of the construction documents submitted in pursuit of obtaining a
building permit for the above-referenced project. This review is not intended to be an exhaustive
and comprehensive report. Unless otherwise noted, all references are to the 1997 U.B.C. It is
our goal that this review will help you in complying with the applicable codes and we aze,
therefore, requesting that the following items be addressed.
1. A second exit must be provided out of the patio seating area. UBC Table l0A
2. Please revise the occupant load for the building since the seating arrangement and
anticipated staff is larger than the occupant load derived from UBC Table 10-A.
3. If the door leading to the patio is the second exit from the restaurant, verify that the
exitway is maintained direct and obvious. L1BC 1004.2.2
4. Accessible toilet stalls must have clearances as required in the Minnesota Accessibility
Code Section 1341.0448. This code section requires 48" in front of the toilet and 42"
clear floor space on the transfer side. This section also addresses the grab baz locations.
5. Provide an 8-1/2" x 11" and a floppy disk with a fire protection plan. This will be
forwazded to the Fire Department to be used when responding to emergencies for this
building.

We have been attempting to do a plan review on the blueprints submitted for the: Reii
~Robin restaurant proposed for location within the City of Eagan. The documents you
submitted are of good quality but they do not appear to have been designed to the
Minnesota State Building Code (SBC). We are going to need your architect to reevaluate
the documents for this project and resubmit new documents that reflect complete
compliance to the SBC.
Following please find a few examples of items that need to be reevaluated by your
architect (please keep in mind that 1he following items are = meant to be an exhaustive
or comprehensiv.e listing of concerns).
Drawinq Sheet T-1
1. The code summary (project information) must be much more complete than what is
given and must designate occupancy class, construction type, occupant load, etc.
as per the 1988 UBC & SBC. (I have enclosed an "Example Code Summary" for
your reference.)
Please recalculate the occupant load, using both fixed and open-seating calculations
as required by UBC Section 3302 (see the attached example from page 91 of the
1988 UBC Appiication/lnterpretation Manual). Submit a copy of the floor plan that
indicates on it the occupant load for e c area designated with a room number and
the proposed exit travel path from each area (a reduced copy of the floor plan is
acceptable).
2. Accessibility Note 6: All exterior ramps must have a maximum slope of 1:20. (SBC
1340.0300, Subp. 2)

of SBC Chapter 1340 are met (as well as ADA). See attached copies of 1340.0500,

6. Where is the permanent, on-site dumpster going to be located? Is it in the "service"
area? If it is going to be enclosed (located in the "service" area) as part of the
building proper, we would need verification from the Minnesota Department of Health
that this is allowed. Typically, the dumpster is located in a four-sided, open-air
enclosure either attached to or detached from the main building. Please review
Section 11.301 ofthe 1991 Uniform Fire Code (UFC) for requirements for dumpsters
within, or in areas attached to, combustible construction.
7. A suitable space for the separation, collection and temporary storage of recyclable
materials must be designated on the plans. (SBC 16B.61, Subd. 3a)

TH-IS INDENTURS, made this day o£ 1995,
between MGC Partnership, a Minneaota partnership, hereinaftier
referred to as "Grantor", and the City of Eagan, a municipal
cQrporation organized under the laws of the State of Minnesota,

WITNESSETH:
That the Grantor, in consideration of the sum of One Dollar
($1.00) and other good and valuable conaideratipn, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the Grantee, its successors and assigns, a
nonexclusive, permanent sidewalk easement over and across real
property located in Dakota County, Minnesota, legally described as
set forth in Exhibit A attached herefio ("Easement Area").
The grant of the fbregoing,easement incl,udes tfie.right of- the
Grantee to enter upon the Easement Area ta construct, inspect,
repair., reconstruct and maintain a sidewalk within the Easement
Area, on condition that, after completing such work, Grantee shall
repair and restore ta as near the condition as existed prior to
Grantee's work any landscapiag and improvemenCS affected by
Grantee's work. Such repair and restoratfon sha11 include
relocating and reconnecting any landocape sprinkler pipes and lines
aftected by Grantee's woxk so that the Iandscaping sprinklering _
system functions as a whole. The Grantor shall continue to be able
Co landscape and otherwise use the Easement P.rea in accordance with
applicable laws and ordinances, subject to the rights granted to
the Grantee herein.
This instrument and the dovenanEs and' easements contained
herein shall run with the land and shall inure to the benefit of

THIS INDENTURE, made this 18th day of April , 1995,
between Red Robin International, Inc., a Nevada corporation,
hereinafter referred to as "Grantor"; and the City of Eagan, a
municipal corporation organized under the laws of the State of .
Minnesota, hereinafter referred to as "Grantee."
WITNESSETH:
That the Grantor, in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and _
convey unto the Grantee, its successors and assigns, a
nonexclusive, permanent de:corative monumentation easemeiit over anci
across real property located in Dakota County, Minnesota, legally
described as follows, to-wit:
The South five (5) feet of the North twenty (20) feet of
Lot 1, Block 1, Town Centre 100 Fifteenth Addition ("Easement
Area").
The grant of the foregoing easement includes the right of the
Grantee to enter upon the Easement Area to construct, inspect,
repair, reconstruct and maintain decorative monumentation within
the Easement Area, on condition that, after completing such work,
the Grantee shall replace and restore any sod or ground cover
within the Easement Area disturbed by the Grantee to as near the
condition which existed prior to the commencement of the work as is
reasonably possible. The fee owner of the Easement area shall
- relocate and restore, on a one time basie; any of the lawn
sprinkler system located within the Easement Area which is affected
at the time that the Grantee initially constructs the decorative
monumentation in the Easement Area. The decorat=ive monumentation
shall take the form of a fence, posts and chain, a wall, monument
signage, landscaping, or a similar improvement.
The decorative monumentation shall be subject to the following
height restrictions:
A. The decorative monumentation can_.include up to three (3)
flagpoles;
B. Except for the flagpoles referred to above, the
decorative monumentation shall not excee3 six (6)
feet in height for more than ten (10) toral lineal
feet along the ground, which ten (10) total lineal feet
can be in one continuous run or in two or more separate
areas;

C. The height of the remaining decorative monumentation
shall not exceed three (3) feet, provided that within the
area commencing at the northwest corner of Lot 1, Block
1, of the Town Centre 100 Fifteenth Addition according to
the recorded plat thereof, Dakota County, State of
Minnesota (said Lot 1 being hereinafter referred to as
"Lot 111) and continuing along the northern property line
of Lot 1 a distance of 400 feet, the height of the
remaining decorative monumentation may be increased to 5
feet on condition that the remaining monumentation shall
be so constructed as to preserve a clear, unimpeded view
from County Road No. 28 (Yankee Doodle Road) onto the Red
Robin parcel and of the Red Robin restaurant through not
less than 70°s of the space above the 3 foot mark.
The Grantee shall consult the fee simple owner of the Easement
Area with respect to the color, form of, and materials used in the
decorative monumentation and shall take into consideration any
comments or concerns which the fee simple owner-of the Easement
Area may have. The Grantee shall not, however, be bound by such
comments and concerns so long as the color, form of and materials
used in the decorative monumentation are the same as used
throughout the Central Area/Yankee Doodle Corridor as that term is
described in the Central Area Task Force Final Report, dated
February 13, 1995, or is identified for the area in the final
report adopted by the Eagan City Council pertaining to the
development of the Central Area/Yankee Doodle Corridor. The Grantor
shall continue to be able to use the Easement Area in accordance
with applicable laws and ordinances, subject to the rights granted
to the Grantee herein, provided, however, that no trees or
landscaping, other than sod, shall be planted or maintained on the
Easement Area without the Grantee's permission, and no pylon signs
allocated for Lot 1, Block 1, Town Centre 100 Fifteenth Addition,
shall be constructed or maintained in the Easement Area without the
Grantee's permission. -
The construction of any decorative monumentation shall be in
compliance with all ordinances, codes and requirements of all
governmental entities having jurisdiction over the Easement Area.
The Grantee shall be responsible for obtaining all permits,
licenses and approvals needed for the construction of the
decorative monumentation.
This instrument and the covenants and easements contained
herein shall run with the land and shall inure to the benefit of
and be binding upon the heirs, representatives, successors and
assigns of the respective parties.
