The plans indicate most of the drainage from the Burger King site will drain to the city's storm sewer on Denmark Avenae. Aceording to the city's comprehensive drainage plan, that sewer should drain to the city's pond north of Yankee Doodle Road. However., the sewer is currently draining to a Mn/DOT-owned pond at I-35E. The Mn/DOT pond was not designed to accomodate direet discharge from the city's storm sewer. However, the city is aware of this problem and its potential impaets. The reallocations which are beinq requested are reasonable because the four parcels referred to have been allocated the full cost of an assessment which should have been spread among several parcels. however, because it was necessary to plat these parcels for development prior to the adoption of the final assessment roll, the above referenced parcels were assessed the full cost of . an assessment. Consequently, the four parce2s referred to have abnormally high assessments which should be spread to other parcels. I want to emphasize that Federal Land Company is not requesting by this letter a reduction of the assessments. As a result of that public heazing, the Council ordered in the installation of sanitazy sewer latezals, trunk and lateral water mains, trunk and latezal stoxm sewer, related , services and the construction of Denmark Avenue, Duckwood Drive, and the internal Town Centre Drive streets. As a pazt of this public I~ hearing process, the City estimated the construction costs and related ! assessments to benefited properties. This "preliminary" assessment ~ roll adopted at the time of public hearing approval was based on cost , estimates without the benefit of detailed plan pxeparation or competitive bid solicitation. ' These preliminary assessment estimates are carried as "pending" ' assessments until such time that final costs have been tabulated and a ' final assessment hearing held for formal Council adoption and certification for collection. Aftez reviewing the bids xeceived through the competitive solicitation pzocess for these improvements, it is apparent that the City's original "preliminary assessment roll , estimates will gzeatly exceed what will.be the final assessable cost. Therefoze. I have prepared a Revised cost estimate that can be considered the most accurate estimate of pzoposed final assessments i for Lot 1, Block l, Town Centre 70 Fouzth Addition. This updated I estimate is based on the actual unit prices received through the ' bidding process, adding a 5% continqency for unknown and an estimated 25% for administrative, engineering and other related overhead. The smoothie pitcher and lids will be rinsed in the rinser sink and then washed rinsed and sanitized every 4 hours in the three compartment sink. The time of this rotation must be documented onsite and will be reviewed during future inspections. 5. Food Preparation Sink: No fresh fruit will be used with this operation. 6.
