WEST, LOT 2, BLOCK 3, THE WOODLANDS DRAINAGE , City staff has reviewed the drainage problem at 3683 Woodland Trail over the past several months due to concerns expressed by Mr. John West. The review included meetings with property owners and detailed review of the causes and possible solutions for this lot. Several factors are contributing to the drainage problem in Mr. West's property which are illustrated on the following attachment. First of all, the lot is relatively flat which accounts for several low points in the backyard. In addition, the two sideyard swales located in or near the drainage easements do not have adequate grade to drain the backyard. The effectiveness of the soutY{ swale is further reduced due to a tree which tends to establish a low point and a berm which encroaches the easement and restricts the flow. Although the home on Lot 1, Block 3 was built about 1.5 feet.higher than the development proposal, it does have a 10.25 foot sideyard setback and does not have a significant contribution to the problem. Overall, the drainage for Block 3 of the Woodlands does comply to the grading plan proposed by the Developer's Engineer. However, several of these lots are - quite flat and do not leave much room for error when it comes to a final grade. The existing elevations throughout the yard can facilitate a proper drainage plan for Lot 2, Block 3, but would require careful regrading and the relocation of critical landscape. . ~ ig E. In every case, or.e points to the other as at faulr_, t,y home was the first home built in "The Woodlands" devel- opment. The builder used drainaae p1aTS registered with the Eagan City Engineers. The building inspectors from Eaaan inspecT.ed at every step of construction. The home was certified complete and inhabitable by the City of Eagan. I had a professional landscape architect design *_he landscaping. I had professionals install shrubbery and lawn. The landscaping and lawn was in and established with only one drainage problem--pooling at one location which is being taken care of by the lawn company. My home caent through a fall, a winter, and a spring with no drain- aye problems. Then, homes began to be built on surrounding lots. Now my lot has become the "ditch" that all drainage -2' is channeled through. The lot to the South has been raised at least three feet and drains onto mine. No action by the City Engineer, even after numerous conversations. The lots (2) to the West drain directly onto my lawn. No attempt on their part has been made to create a swale be- tween my lot and theirs. Again, the City Engineer and all involved have been notified and asked to do something. All have said, "Not my problem!" I am tired of hearing "Not my problem!" My home was here first. My home was built to City drainage specifications and inspected by the City. Z have used professionals to finish my lawn. Who's problem is it? If not the "con- troller of drainage," the "inspector of construction," the "giver of building permits," the City of Eagan, then WHO regulates?? If this problem cannot be resolved by all parties, with your direction and counsel, then it will end up in the courts! I am tired of being nice and trying to resolve thi_s problem in a gentlemanly way. The four inches of water in my basement, which came through the basement win- dows, was the last straw! r9y request for an audience with the City Council to state my case, in addition to this letter, is based on wanting to show you evidence of the problem--the damage to my home and contents, and the chronological listing of events-- construc*_ion dates, etc. which are important. Install a catch basin and pipe to the nearest storm sewer line and/or, 2. Regrade the downstream lots to create proper drainage swales to direct water to Woodland Trail. The fust soludon, the catch basin and pipe, is in my opinion not pracucal due to a pmjected cost likely to exceed $5,000.00! In addidon, considernble disrurbance will occur to exisring yards as there is no pipe on Basswood Lane, It is the opinion of myself and Craig Knudsen of the City of Eagan that the clear soluuon is to regrade the downstream lots to create groper swales. Craig reminded me that water has a right to run across these lou and, if it should stop or pond on these lots it is the property owners' responsibility to cut, fill or reshape the yards to ensure the proper flow of storm water to the street . Craig is suggesting regrading Wesu' back yard to create a swale that would divide upsffeam water to flow co both side lot lines. Both side lot lines should be shaped into definite drainage swales adequate to handle the flow. One the south side, Craig said a short retaining wall on Fullzrs' lot may be required to get the swale deep enough. Along Biebels' yard the existing swale is probably OK if Biebels' don't mind it traversing their front yard comer. There are other drainage issues such as whe[her the yazds ane graded propezly reladve to the houses. These issues are really separate from the quesdon of the proper routing of neighborhood storm water. The ultunace quesrion is "Who pays far the work to be done?" It seems that the homeowner has the responsibility for his pazt of che overall system. In addirion, considenble disturbance will occur tn exisdng yards as there is no pipe on Basswood Lane, It is the opinion of myself and Craig Knudsen of the City of Eagan thaz the clear solurion is to regiade the downsa-eam lots to create proper swales. Gaig reminded me that water has a right to run across these lots and, if it should stop or pond on these lots it is the property owners' responsibiliry to cut, fill or reshape the yards to ensure the proper flow of storm water to the street. • Craig is sug;escing regrading Wesu' back yard to crea[e a swale rhat would divide upstream water w flow to boch side lot lines. Both side lot lines should be shaped into definite drainage swales adequate to handle the flow. One the south side, Craig said a short retaining wall on Fullers' lot may be required to get the swale deep eaough. Along Biebels' yard the existing swale is probably OK if Biebels' don't mind it traversing their front yard comer. There are other crainage issues such as whether the yazds are graded properly relaave to the houses. These issues aze really separyte from the quesrion of the proper routing of neighborhood stonn water. The uldmatc quesdon is "W6o pays for the work to be done?" The building inspectors from Eaaan inspected at every step of construction. The home was certiried complete and inhabitable by the City of Bagan. I had a professional landscape architect design ±he landscaping. I had professionals install shrubbery and lawn. The landscaping and lawn was in and established with only one drainage problem--pooling at one location which is being taken care of by the lawn company. My home went through a fa11, a winter,,and a spring with no drain- age problems. Then, homes began to be built on surrounding lots. Now mv lot has become the "di*_ch" that all drainage '2' . is channeled through. The lot to the South has been raised at least three feet and drains onto mine. No action by the City Engineer, even after numerous conversations. The lots (2) to the West drain directly onto my lawn. No attempt on their part has been made to create a swale be- tween my lot and theirs. Again, the City Engineer and all involved have been notified and asked to do something. All have said, "NOt my problem!" I am tired of hearing "Not my problem!" My home was here first. My home was built to City drainage specifications and inspected by the City. I have used professionals to finish my lawn. Who's problem is it? If not the "con- troller of drainage," the "inspector of construction," the "giver of building permits," the City of Eagan, then WHO regulates?? If this problem cannot be resolved by all parties, with your direction and counsel, then it will end up in the courts! I am tired of being nice and trying to resolve this problem in a gentlemanly way. The four inches of water in my basement, which came through the basement cain- dows, was the last straw! My request for an audience with the City Council to state my case, in addition to this letter, is based on wanting to show you evidence of the problem--the damage to my home and contents, and the chronological listing of events-- construction dates, etc. which are important. YEST, IAT 2, BIACK 3, TFiE VOODIANDS DRAINAGE City staff has reviewed the drainage problem at 3683 Woodland Trail over the past several months due to concerns expressed by Mr. John West. The review included meetings with property owners and detailed review of the causes and possible solutions for this lot. Several factors are contributing to the dratnage problem in Mr. West's property which are illustrated on the following attachment. First of all, the lot is relatively flat which accounts for several low points in the backyard. In - addition, the two sideyard swales located in or near the drainage easements do not have adequate grade to drain the backyard. The effectiveness of the sout~ swale is further reduced due to a tree which tends to establish a low point and a berm which encroaches the easement and restricts the flow., Although the home on Lot 1, Block 3 was built about 1.5 feet higher than the development proposal, it does have a 10.25 foot sideyard setback and does not have a significant contribution to the problem. Overall, the drainage for Block 3 of the Woodlands does comply to the grading plan proposed by the Developer's Engineer. However, several of these lots are quite flat and do not leave much room for error when it comes to a final grade. The existing elevations throughout the yard can facilitate a proper drainage plan for Lot 2, Block 3, but would require careful regrading and the relocation of critical landscape. . ~ ig E.
