at 3485 Trails End Road, project #10P648 in the amount of
$30,077.44 be wholly assessed to lot #4 on the same property.
Lot #9 is where our current residence is located. There will
be no mortgage against the land or house after Thursday,
September 22,1994 when cae close the sale of lots ].-S and 10-12.
The "fair market value" of our house on our 1994 property tax
statement is $133,200.00.
We are also asking to have the payment plan extended to ten
years. The current five year proposal puts our monthly payment
at $718.52.

SUBJECT: HOVELAND ASSESSMENT OBJECTION
I was contacted by Gina Hoveland on Friday, September 16, 1994, with a request to
certify all of the assessments on the Hoveland property at 3485 Trails End Road to the
one parcel they will retain. The assessments in question relate to Project 648 and the
public hearing has been continued once to October 18, 1994.
After the notices were sent, the Hovelands objected to the pending assessment of
$30,077.44 as compared to the feasibility report estimated assessment of approximately
$24,000. In subsequent conversations, I explained that I would recommend to the City
Council that the request to certify all assessments to the one parcei be approved if the
Hovelands agreed to rescind the objection and agreed to the assessment of $30,077.44.
The attached letter contains their written request for the change along with concurrence
with my requirement. They have also requested an extension to the assessment period
from 5 years to 10 years.
Although this assessment will piace a very large burden on the one parcel, wfth the
mortgage situation as it is, I feel it would present minimal risk to the Ciry. Also, since no
bonds have been sold to finance the construction, i have no problem with extending the
term from 5 to 10 years.
I would, therefore, recommend that the Ciry Council authorize the transfer of the pending
assessmerrts to the one lot and also extend the payment term to 10 years. Please let me
know if you have any questions or would like any additional information.

IN CONNECTION WITH EAGAN CITY PROJECT NO. 589
This easement, made this 15th day of yiv , 1993,
between TRYGVE JOEL HOVELAND and GINA D. HOVELAND, husband and wife,
hereinafter referred to as "Landowner", and the CITY OF EAGAN, a
Minnesota municipal corporation, organized under the laws of the
State of Minnesota, hereinafter referred to as "City".
W I T N E 8 8 E T H:
That the Landowner, in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the City, its successors and assigns, forever, the
following easement:
~ A temporary construction easement over, under, and aoross
the east 15.00 feet of the north 115.00 feet of Lot 1, Block
~ 2, WESCOTT GARDEN LOTS, according to the recorded plat
\ thereof, Dakota County, Minnesota. Said temporary easement
expires June 1, 1992.
~ Together with:
A temporary construction easement over, under, and across
that part of vacated Kost Road lying westerly of the west
right-of-way line of Trails End Road and northeasterly of a
line drawn northwesterly from a point on said west
right-of-way line of Trails End Road distant 24.83 feet
south from the southeast corner of Lot 15, Slock 1, WESCOTT
HILLS REVISED 3RD ADDITION, according to the recorded plat
thereof, Dakota County, Minnesota, to a paint on the south
line of Lot 14, said Block 1, distant 78.92 feet west from
said southeast corner of Lot 15. Together with a temporary
easement cvar, under, snd across that part of the east 15.00
feet of vacated Kost Road lying southerly of the above lina.
Said temporary easement expires June 1, 1992.
Together with:
A permanent easement for drainage and utility purposes over,
under, and across that part of vacated Kost Road lying
westerly of the west right-of-way line of Trails End Road
and northeasterly of a line drawn northwesterly from a point
on said west right-of-way line of Trails End Road distant
14.31 feet south from the southeast corner of Lot 15, Block
1, WESCOTT HILLS REVISED 3RD ADDITION, according to the

The grant of the foreqoing temporary easement for construction
purposes includes the right of the City, its contractors, agents and
servants to construct, reconstruct, inspect, repair and maintain a
roadway.
And the Landowner, for itself, and its successors and assigns,
does covenant with the CiEy, its successors and assigns, that they
are the fee owners of the lands and premises aforesaid and have good
right to grant and convey the easements herein to the City.

ASSESSMENT DEFERRAL AGREEMENT
City Project No. 648
WHEREAS, Scott Welter and Cydney Welter ("Welter") are the owners
of property located at 3505 Trails End Road in the City of Eagan,
County of Dakota, State of Minnesota, legally described as:
The East 394.71 feet of the South half of Lot 1,
Block 2, Wescott Garden Lots, Dakota County,
Minnesota, PID #10-83700-014-02 (the "Property").
WHEREAS, the City of Eagan ("Eagan") has levied assessments
against the Welter's Property and other landowners within the
Woodlands North 3rd Addition.
NOW, THEREFORE, in consideration of the mutual promises contained
herein, Eagan and Welter agree as follows:
1. That the payment for the assessment for street and related
storm sewer in the principal amount of $6,876.63 together
with interest at the rate of six and one-half percent (6k%)
per annum from November 15, 1994, to date of payoff, is
deferred until fifteen (15) years from the date of this
Agreement, provided, that in the event the Property is sold,
platted or subdivided, then, in that event, the deferral
shall terminate and the assessment together with all accrued
interest shall become immediately due and payable.
